Currently the bulk of these companies provide Document Automation, Marketplace and Practice Management services but there is also significant growth in companies offering Compliance, Analytics and Legal Research services. After a succinct analysis of the related market, the aim of this presentation is to*highlight the main critical aspects as well as the evident opportunities * which could arise from the introduction of these new services throughout the legal sector. The main critical aspects are related to *fairness and reliability of the algorithm*, while the opportunity is to create an efficient, transparent and speed process for receiving legal services that it could mean a significant saving of the public fund. The legal profession is at an important, delicate crossroads. Legal tech services and, chiefly, the use of artificial intelligence must not be overestimated, but neither should they be ostracised. *The best policy must be gradual * because Italy and Europe are far behind the United States which has already gained considerable experience. The goal in order to develop the future of the legal profession is *to transform*, where appropriate,*the legal service into an organised process*. Once this transformation has been happened, it will be possible to appreciate which aspects can be automated and which areas, out of necessity, must remain within the remit of professional lawyers. BIOGRAFIE - e informazioni supplementari [VACIAGO] A lawyer since 2002, *Giuseppe VACIAGO * is a Partner of R&P legal since 2013. He focuses on criminal law relating to new technology, and corporate criminal law as well as advising on the drafting of organizational models pursuant to Italian law 231/01; he acts for a number of leading national and international companies in the IT sector. Giuseppe Vaciago has a PhD in Digital Forensics from the University of Milan-Bicocca and lectures in IT law at the University of Insubria. He is Lead Auditor ISO/IEC 27001/20013, IT Security. He attended Stanford Law School and Fordham Law School in New York as a Visiting Scholar. He has also been invited to speak on a number of occasions by the most prestigious Italian universities as well as universities abroad. The Drone Revolution Shakes Up Tort Law

The advent of drones has led to calls for new law to regulate the skies. One such proposal from the Uniform Law Commission is causing a stir in the United States. <https://www.cfr.org/blog/drone-revolution-shakes-tort-law> [...] The draft act contains two fundamental proposals. First, it contains a “new bright line” rule. Any intrusion—even those that cause no harm—by an unmanned aircraft into airspace above private property up to 200 feet without the owner’s consent constitutes a trespass, with exceptions, including for conduct during emergencies or pursuant to a court order. Second, the draft act creates the tort of acquiring images, recordings, or physical or electronic impressions of private acts or trade secrets with a drone in a manner highly offensive to a reasonable person, excluding acquisitions protected by the First Amendment or that conform to the Fourth Amendment, a warrant, or court order. The proposals provoked criticism, especially from drone companies and industry associations [PDF] and alliances [PDF]. Negative reactions included, among others, assertations that the draft act: Interfered with the federal government’s exclusive authority to regulate the nation’s airspace and to pre-empt state and local regulations on drones; Ignored that existing tort law on aerial trespass developed with manned aircraft in mind, which requires a showing of substantial interference with property rights, is very appropriate to apply to drones; and Created new rules on property and privacy rights that will spawn litigation and uncertainty for drone operators and inhibit innovation and development of commercial opportunities. The draft act has defenders too. Jason Snead of the Heritage Foundation argued that the act’s “bright line aerial trespass standard balances the interests of the nascent [unmanned aerial systems] sector with the traditional rights of property owners to exclude unwanted intruders from their property.” Reginald Govan, former FAA chief counsel, dismissed the notion that the FAA’s rules had pre-empted state and local governments from regulating how drones affect property rights. Govan also argued that, absent federal legislation, state governments have the authority “to protect privacy through trespassory tort doctrines,” as proposed by the draft act. [...]

Ciao Roberto, mi spieghi il modello economico di riferimento? Quando sento questa argomentazione mi chiedo sempre: perché chi gli imprenditori dovrebbero spendere (collettivamente) di più per robot il cui costo deve assorbire stipendi più alti dello stesso numero di persone e garantire anche un margine a chi li produce? Ovvero: dati X lavoratori che costano in media Cx perché sostituirli con Y robot che costano in media Cx + Ix + My? (dove My è il margine di chi produce quei robot ed Ix è l'incremento salariale medio ottenuto dal "remix" dell'organico) Questo processo non dovrebbe ridurre i margini degli imprenditori? O aumentare i prezzi dei prodotti, producendo inflazione e riducendo il potere d'acquisto dei lavoratori stessi (potenzialmente azzerando l'incremento salariale medio o peggio impoverendo gli stessi lavoratori)? E se invece la disoccupazione aumenta e la domanda dei beni si restringe... chi ci guadagna? Nota che la mia è una domanda prettamente economica: fingiamo di ignorare, per un momento i problemi socio-politici come i costi della riqualificazione del personale sostituito e le varie esternalità del processo (aumento del costo dell'energia, etc...)
