EDPS Opinion on the Privacy Shield draft

Non mi pare sia già passato in lista (sennò vi prego di scusarmi), ieri l'EDPS ha emanato un parere sul draft del Privacy Shield, in cui tra l'altro si osserva "The draft Privacy Shield may be a step in the right direction but as currently formulated it does not adequately include, in our view, all appropriate safeguards to protect the EU rights of the individual to privacy and data protection also with regard to judicial redress. Significant improvements are needed should the European Commission wish to adopt an adequacy decision. In particular, the EU should get additional reassurances in terms of necessity and proportionality, instead of legitimising routine access to transferred data by U.S. authorities on the basis of criteria having a legal basis in the recipient country, but not as such in the EU, as affirmed by the Treaties, EU rulings and constitutional traditions common to the Member States." Safety Shield bocciato da Parlamento UE e EDPS (mentre US pensa di espandere la sorveglianza)

*EU-US privacy shield: Back to the drawing board for the final stretch!* Today, the European Parliament adopted its resolution about the proposed EU-US Privacy Shield, adding its voice to the opinion of the Working Party 29 from last April and preceding the vote of national representatives in the Article 31 Committee next month. Following the 2013 Snowden revelation, Viviane Reding, then Vice-President of the Commission, launched the reform of Safe Harbour to ensure that data flows across the Atlantic in full compliance with data privacy. Two years and a half later, substantial progress has been made. Not enough for Viviane Reding, now Member of the European Parliament, who still considers the draft decision by the Commission incomplete: "I welcome the numerous and wide-reaching improvements in terms of transparency, oversight and monitoring of the companies' practices. Nevertheless, I regret that few guarantees have been obtained concerning the activities of the US intelligence services. The problem is, has always been, and remains the use of national security as a blanket exemption. Together with our American counterparts, further work is needed to turn written assurances into legal obligations, and words into the reality of our citizens. If passed, the change would expand the reach of the FBI’s already highly controversial national security letters. The FBI is currently allowed to get certain types of information with NSLs — most commonly, information about the name, address, and call data associated with a phone number or details about a bank account. Since a 2008 Justice Department legal opinion, the FBI has not been allowed to use NSLs to demand “electronic communication transactional records,” such as email subject lines and other metadata, or URLs visited. The spy bill passed the Senate Intelligence Committee on Tuesday, with the provision in it. The lone no vote came from Sen. Dalla Direttiva 95/46 al nuovo Regolamento europeo"/ Questo volume è una sorta di viaggio per aiutare il lettore a orientarsi nel mondo della protezione dei dati. Esso si propone tre obbiettivi. Il primo, mettere a fuoco la differenza strutturale fra il concetto di Privacy e il Right to Privacy americano, da un lato, e il Diritto europeo alla protezione dei dati personali come diritto fondamentale della persona, dall’altro. Per questa parte esso contiene anche molti riferimenti alle differenze tra la tradizione americana e quella europea. Il secondo obbiettivo è di ricostruire il diritto europeo alla protezione dei dati personali, basato su un intreccio continuo fra l’ordinamento della Convenzione europea dei diritti dell’uomo e quello della Unione Europea. Il terzo obbiettivo è costruire una passerella che consenta di mettere a confronto il diritto europeo esistente, basato sulle Direttive, col nuovo Regolamento, ormai in attesa soltanto dell’ultimo esame formale in Consiglio. Si tratta di un mutamento di grandissima importanza non solo perché si passa da un sistema basato su Direttive di armonizzazione e legislazioni nazionali di attuazione, a un Regolamento di immediata applicazione in tutti gli Stati membri, ma anche perché si danno regole certe a fenomeni che all’epoca della Direttiva 95/46 non erano nemmeno all’orizzonte e, soprattutto, si cerca di anticipare, per quanto possibile, una normativa adeguata anche all’imminente futuro. Per questo nel volume si dedica molta attenzione anche al confronto fra le nuove norme e quelle contenute nelle Direttive ancora in vigore. Si tratta dunque di un viaggio tra passato, presente e futuro, che ha come bussola aiutare a comprendere non solo le regole ma anche, e soprattutto, i valori che sono alla base di una visione della protezione dei dati intesa come presidio fondamentale di ogni libertà. In addition, as the open source community grows and becomes more global, so too has the need to establish strong governance models and corporate structures that allow an organization to achieve its mission, and foster a sustainable community both creatively and financially. In order to do this, it is helpful for open source organizations to understand the corporate structures and governance models available to them so they may evaluate the pros and cons of different approaches to institutional management and financial structure. In this session, we plan to discuss the various corporate structures and governance models available to open source organizations, including a discussion on when it is appropriate for an open source organization to seek tax exempt status. About Dalia Dalia Topelson Ritvo is the Assistant Director of Harvard Law School’s Cyberlaw Clinic, based at Harvard’s Berkman Center for Internet & Society. She is also a Lecturer on Law at HLS, where she co-teaches Counseling and Legal Strategies in the Digitial Age. Dalia has concentrated her legal practice on privacy, consumer protection, intellectual property and media law, particularly in the areas of technology, media and digital content. Prior to joining Harvard Law School, Dalia worked as in-house counsel at Amazon.com. From 2004-2009, Dalia worked as an associate in the New York law offices of Weil, Gotshal & Manges LLP and DLA Piper LLP, focusing on intellectually property and technology issues. Brussels urges more caring for sharing economy

The European Commission will this week set out guidelines to harmonise the often wildly different treatment faced by businesses trying to shake up sectors ranging from accommodation to transport across the 28-country bloc. But while the bulk of the new guidelines will be welcomed by the predominantly US groups that dominate the so-called sharing economy sector, some will cause concern in Silicon Valley. The commission suggests that companies that do not allow their operators to set their own prices or that force them to take customers could be considered an “employment relationship”. The commission move comes after services such as Uber faced partial prohibition in countries across the EU, including Belgium, the Netherlands, France and Germany.Any such definition would be resisted by Uber, which has vociferously argued that its drivers are not employees, meaning that the company does not have to do things such as contribute to social insurance schemes on their behalf. Brussels also criticised moves such as Berlin’s attempt to crack down on Airbnb hosts by introducing fines of up to €100,000 for people who rent out their entire apartments on the home-letting website. The commission said such rules were “generally difficult to justify”. Instead, countries should consider measures such as introducing limits on the number of days someone can rent out an apartment on websites such as Airbnb. The commission also came out in defence of rating systems used by the likes of Uber, arguing that being able to rate a driver can lead to safer services. Critics of this system have argued that relying on reviews to judge drivers was potentially unsafe. The guidelines are intended to encourage EU countries to look again at their regulation of sharing-economy businesses. Companies such as Uber have already complained to Brussels — which has the task of ensuring EU treaties are enforced — about their treatment in various countries. Results of these investigations are expected in a few months. In general, the commission has given sharing economy businesses a more sympathetic hearing.
