Critical scholarship has exposed how big data brings along new and opaque regimes of population management, control, and discrimination. Building on this scholarship, this pre-conference engages in a dialogue with traditions that critique the dominance of Western approaches to datafication that do not recognize the diversity of the Global South. Moving from datafication to data activism, this event will examine the diverse ways through which citizens and the organized civil society in the Global South engage in bottom-up data practices for social change as well as resistance to “dark” uses of big data that increase oppression and inequality. L’applicazione mobile consentirà agli utenti di monitorare: ● Il blocco dei siti web; ● La presenza di sistemi responsabili di azioni di censura o sorveglianza; ● Velocità e performance della rete, inclusa la propria. Are the US-EU data agreements still alive?

Privacy Shield potrebbe essere già morto... <https://edri.org/are-the-us-eu-data-agreements-still-alive/> Late on the first day of Computers, Data Protection and Privacy (CPDP) Conference on 25 January 2017, word came through that US President Donald Trump had issued Executive Order (EO), “Enhancing Public Safety in the Interior of the United States”, which included the following: Privacy Act. Agencies shall, to the extent consistent with applicable law, ensure that their privacy policies exclude persons who are not United States citizens or lawful permanent residents from the protections of the Privacy Act regarding personally identifiable information. Member of the European Parliament (MEP) Jan Philipp Albrecht immediately tweeted <https://twitter.com/JanAlbrecht/status/824553962678390784> that the European Commission must suspend Privacy Shield and sanction the US for breaking the Umbrella Agreement. To the many experts at CPDP, the situation was less clear-cut. Much of the conference’s closing discussion, the Caspar Bowden panel on Privacy Shield and Mass Surveillance, focused on it. The executive order places three things at risk: Privacy Shield, the EU-US Umbrella Agreement, and the EU-US Passenger Name Records (PNR) Agreement. The Umbrella Agreement is a framework for transferring law enforcement data from the EU to the US, and was created under the Judicial Redress Act (JRA). Passed in 2015 as an enabler for Privacy Shield, the JRA gives citizens from the EU and its member countries limited rights under the US Privacy Act. The Umbrella Agreement and the list of EU countries were published in the Federal Register on 23 January 2017. Because the pre-conditions have now been met, a data protection lawyer Peter Swire, speaking at CPDP, said that the Umbrella Agreement will enter into force on 1 February. [] Alberto

Opportunità di fellowship Marie-Curie in Irlanda

Il GRCTC (http://www.grctc.com/) è un technology centre sito a Cork, Irlanda, finanziato da Enterprise Ireland ed ospitato dall'University College Cork (UCC). Si occupa di soluzioni per governance, risk e compliance nel settore finanziario. I nostri progetti sono incentrati su una piattaforma per la traduzione di testi giuridici in database semantici. A tal fine stiamo sviluppando un Controlled Natural Language chiamato Mercury, una ontologia di nome FIRO (Financial Industry Regulatory Ontology, http://www.grctc.com/platform-research/firo/) ed un tool chiamato Ganesha. Lo scorso 30 Gennaio è stata pubblicata una call Marie-Curie cofinanziata da Enterprise Ireland: http://www.horizon2020.ie/career-fit/ La call è diretta ai Technology Centre irlandesi, dei quali il GRCTC è uno dei pochi, e quindi abbiamo una buona possibilità di riuscita. Il salario è ottimo (EUR 60.000), il contratto da tre anni. La nostra intenzione è di sottomettere più di una application, e siamo alla ricerca di candidati all’altezza. Qualora doveste conoscere ricercatori con dottorato o almeno 4 anni di ricerca alle spalle che desiderano fare domanda, sarei felice di valutare assieme l’opportunità ed eventualmente aiutarli con l’application. What Vizio was doing behind the TV screen

But according to a complaint filed by the FTC and the New Jersey Attorney General <https://ftc.gov/news-events/press-releases/2017/02/vizio-pay-22-million-ftc…>, consumers didn’t know that while they were watching their TVs, Vizio was watching them. The lawsuit challenges the company’s tracking practices and offers insights into how established consumer protection principles apply to smart technology. Starting in 2014, Vizio made TVs that automatically tracked what consumers were watching and transmitted that data back to its servers. Vizio even retrofitted older models by installing its tracking software remotely. All of this, the FTC and AG allege, was done without clearly telling consumers or getting their consent. What did Vizio know about what was going on in the privacy of consumers’ homes? On a second-by-second basis, Vizio collected a selection of pixels on the screen that it matched to a database of TV, movie, and commercial content. What’s more, Vizio identified viewing data from cable or broadband service providers, set-top boxes, streaming devices, DVD players, and over-the-air broadcasts. Add it all up and Vizio captured as many as 100 billion data points each day from millions of TVs. Vizio then turned that mountain of data into cash by selling consumers’ viewing histories to advertisers and others. And let’s be clear: We’re not talking about summary information about national viewing trends. According to the complaint, Vizio got personal. The company provided consumers’ IP addresses to data aggregators, who then matched the address with an individual consumer or household. Vizio’s contracts with third parties prohibited the re-identification of consumers and households by name, but allowed a host of other personal details – for example, sex, age, income, marital status, household size, education, and home ownership. And Vizio permitted these companies to track and target its consumers across devices. That’s what Vizio was up to behind the screen, but what was the company telling consumers? Not much, according to the complaint <https://ftc.gov/enforcement/cases-proceedings/162-3024/vizio-inc-vizio-insc…>. Vizio put its tracking functionality behind a setting called “Smart Interactivity.” But the FTC and New Jersey AG say that the generic way the company described that feature – for example, “enables program offers and suggestions” – didn’t give consumers the necessary heads-up to know that Vizio was tracking their TV’s every flicker. (Oh, and the “Smart Interactivity” feature didn’t even provide the promised “program offers and suggestions.”) The complaint <https://ftc.gov/enforcement/cases-proceedings/162-3024/vizio-inc-vizio-insc…> alleges that Vizio engaged in unfair trade practices that violated the FTC Act and were unconscionable under New Jersey law. The complaint also alleges that Vizio failed to adequately disclose the nature of its “Smart Interactivity” feature and misled consumers with its generic name and description. To settle the case <https://ftc.gov/enforcement/cases-proceedings/162-3024/vizio-inc-vizio-insc…>, Vizio has agreed to stop unauthorized tracking, to prominently disclose its TV viewing collection practices, and to get consumers’ express consent before collecting and sharing viewing information. In addition, the company must delete most of the data it collected and put a privacy program in place that evaluates Vizio’s practices and its partners. The order also includes a $1.5 million payment to the FTC and an additional civil penalty to New Jersey for a total of $2.2 million. [...]

Google, unlike Microsoft, must turn over foreign emails: US judge

U.S. Magistrate Judge Thomas Rueter in Philadelphia ruled on Friday that transferring emails from a foreign server so FBI agents could review them locally as part of a domestic fraud probe did not qualify as a seizure. The judge said this was because there was "no meaningful interference" with the account holder's "possessory interest" in the data sought. "Though the retrieval of the electronic data by Google from its multiple data centers abroad has the potential for an invasion of privacy, the actual infringement of privacy occurs at the time of disclosure in the United States," Rueter wrote. Google, a unit of Mountain View, California-based Alphabet Inc, said in a statement on Saturday: "The magistrate in this case departed from precedent, and we plan to appeal the decision. []
