How the Internet Saved Turkey’s Internet-Hating President

ANTALYA, Turkey — When I was stuck at the airport in this city in southern Turkey, on Friday night, I had many things to worry about. A coup attempt had just begun and the country was in turmoil. My plane to Istanbul had almost flown into the worst of the fighting, but luckily we were prevented from taking off at the last minute when the airspace was closed.One thing I did not have to worry about, though, was running out of data on my phone. In the early morning hours, Turkey’s leading cellphone provider topped up the internet allowance of every subscriber. This was more than unusual. Turkey has experienced many crises recently, including deadly terrorist attacks, and they usually lead to a closing of information flows, not the government-aligned service provider’s making it easier to transmit information. Come saprete, questo mercoledì sono stato relatore dell'88° mercoledì di NEXA intitolato "Verso i Big Data giudiziari? Problemi di copyright e privacy nella diffusione di sentenze sul web"; un tema a me molto caro a causa del Progetto JurisWiki.it (http://juriswiki.it/) Nel ruolo di discussant c'era il collega Carlo Blengino che ha portato il punto di vista del penalista e anche di chi suggerisce un approccio più prudente a questo argomento. A presiedere le due ore di approfondimento scientifico e dibattito (che in alcuni momenti si è fatto anche abbastanza acceso), è stato invece il professor Marco Ricolfi, condirettore del Centro NEXA. Interessantissimi gli spunti e i commenti provenienti dalla platea dei circa venticinque partecipanti, tra cui posso annoverare (e ringraziare per la presenza) alcuni nomi di massimo rilievo nell'ambito del diritto delle nuove tecnologie e del diritto di Internet. L'esito non poteva che essere un ricco e interessante confronto che di certo può portare ad un passo avanti nella ricerca e divulgazione su questo tema delicato quanto strategico e di frontiera. Alla fine il Nexa ha salutato tutti i presenti con un brindisi di fine stagione, dando appuntamento a settembre. Condivido l'album completo Flickr delle foto scattate durante l'evento. I server di Outlook all'estero sono salvi per il momento/ venerdì 15 luglio 2016 di Alfonso Maruccia Roma - La Corte di Appello del Secondo Circuito ha emesso una sentenza in favore di Microsoft, chiudendo (per il momento) una vicenda che si trascina da anni e che riguarda il tentativo di accesso a un account utente gestito dalla corporation su server stranieri. I giudici hanno ribaltato la sentenza di primo grado che costringeva Microsoft a tirare fuori i dati, stabilendo che il Governo americano non può costringere un'azienda privata a consegnare le informazioni gestite per conto terzi: le norme dello Stored Communications Act (SCA) non valgono fuori dalla giurisdizione USA, e men che meno per il territorio irlandese come nel caso in oggetto. Given those constraints, I still want to discuss something which has altered “the game” so much that the existing guidebook needs to be significantly revised. I am not a military strategist, but I have lived through a couple coups here in Thailand, so I have some first hand experience of what they look like. The focus of those provisions is protection of a user’s privacy interests. Accordingly, the SCA does not authorize a U.S. court to issue and enforce an SCA warrant against a United States‐based service provider for the contents of a customer’s electronic communications stored on servers located outside the United States. The SCA warrant in this case may not lawfully be used to compel Microsoft to produce to the government the contents of a customer’s e‐mail account stored exclusively in Ireland. Because Microsoft has otherwise complied with the Warrant, it has no remaining lawful obligation to produce materials to the government. We therefore REVERSE the District Court’s denial of Microsoft’s motion to quash; we VACATE its order holding Microsoft in civil contempt of court; and we REMAND this cause to the District Court with instructions to quash the warrant insofar as it demands user content stored outside of the United States." -- Prof. Avv.
