NTIA finalizes privacy guidelines for the commercial use of facial recognition

<http://www.biometricupdate.com/201606/ntia-finalizes-commercial-facial-reco…> The National Telecommunications and Information Administration (NTIA) <https://www.ntia.doc.gov/> finalized its privacy guidelines for the commercial use of facial recognition last week [] The stakeholders, according to the National Law Review <http://www.natlawreview.com/article/ntia-multistakeholder-group-reaches-con…>, recommended in the final code of conduct that commercial entities do the following: • Disclose their practices regarding collection, storage, and use of facial template data to consumers, including any sharing, retention, and de-identification policies; • Provide notice to consumers where facial recognition is used on a physical premises; • Consider privacy concerns when developing data management programs; • Protect facial recognition data by implementing a program that contains administrative, technical, and physical safeguards appropriate to the entity’s size, complexity, the nature of its activities, and the sensitivity of the data; • Take reasonable steps to maintain the integrity of the data collected; and, • Provide a means for consumers to contact the entity regarding its use of the data. Trade organizations involved in the process, including the Consumer Technology Association, the Interactive Advertising Bureau, NetChoice, the Software & Information Industry Association and the International Biometrics Industry Association (IBIA), were generally pleased with process. In statements issued at the conclusion of the process, they noted that the code of conduct would give businesses that employ facial recognition technology greater certainty about how the Privacy Blueprint’s principles apply to them. GDPR: Flexibilities in the General Data Protection Regulation

EDRI On 14 April 2016, the European Parliament adopted two legal instruments that will regulate the fundamental right to data protection of individuals: the General Data Protection Regulation (GDPR) and the Law Enforcement Data Protection Directive (LEDP). Despite the overall positive outcome of the GDPR, we regret that many of the initial high expectations for the Regulation were not realised. Once the final text was passed, and ahead of the preparation of guidelines for its implementation, we have published two documents where we analyse the numerous national flexibilities contained in the text of the Regulation. Free Basics By Facebook – An Interview With Nishant Shah | Spheres

Following up the internet’s early democratic dreams, the Facebook-led initiative Free Basics, formerly known as internet.org, seeks to create a connected world by establishing internet access in areas, which, often due to financial reasons, have been disconnected so far. Despite the seemingly sensible purpose, the initiative has been highly scrutinised. Particularly in India, internet.org faced many complaints, ultimately resulting in the project being abandoned in the country. Questa "dualità" pone alcune serie problematiche nella gestione della *privacy*, soprattutto in un mondo come quello di oggi fortemente rivolto alla raccolta, rielaborazione, diffusione di grandi masse di dati (il cosiddetto fenomeno del "*big data*"). Qual è il confine dell'*interesse pubblico* a conoscere l'operato della macchina della giustizia? E quale il confine dell'*interesse privato* a mantenere riservate vicende giudiziarie non sempre piacevoli? Un equilibrio davvero difficile da raggiungere. A questo livello di criticità se ne aggiunge anche un altro, indipendente ma comunque sovrapposto: quello del *copyright*. Buona parte di questi documenti, infatti, pur essendo senza dubbio di pubblico dominio e fuori dalla tutela del copyright, sono raccolti in grande banche dati proprietarie commercializzate (spesso a caro prezzo) dalle case editrici. [image: Online le linee guida di design per i siti web di Regioni e Comuni] Prosegue il percorso intrapreso dall’Agenzia per l’Italia Digitale verso la definizione di servizi online più semplici e orientati alle esigenze dei cittadini. Sono online le linee guida di design per Regioni e Comuni (link is external) <http://design.italia.it/>, che hanno l’obiettivo di definire standard web di usabilità e design condivisi da tutta la pubblica amministrazione. Dopo le amministrazioni centrali, anche quelle locali saranno guidate nella creazione di portali istituzionali più chiari e di più semplice fruizione. Da oggi sono online come progetti pilota i siti web del Comune di Biella, (link is external) <http://www.comune.biella.it/> del Comune di Matera (link is external) <http://www.comune.matera.it/> e della Regione Sardegna (link is external) <http://alpha.regione.sardegna.it>, cui farà seguito la progressiva integrazione dei contenuti. Le linee guida nascono per semplificare l’accesso ai servizi e alle informazioni di carattere istituzionale. Rappresentano uno strumento volto a favorire il dialogo via web tra pubbliche amministrazioni e cittadini, colmando il divario che ci separa dai principali paesi europei. L’obiettivo finale è quello di fornire un’esperienza web più utile, semplice e intuitiva e che consenta un risparmio di tempo e risorse per cittadini e PA. Nei prossimi mesi, AgID ha previsto la definizione di specifiche indicazioni rivolte al mondo della scuola e delle università, nonchè l'ampliamento delle linee guida dai siti web ai servizi digitali.
