Un abonné de Numericable soupçonné à tort de centaines de délits Le Monde | 08.03.2016 à 16h56 • Mis à jour le 08.03.2016 à 19h26 La Commission nationale informatique et libertés (CNIL) a sanctionné d’un avertissement public la société Numericable, pour avoir à de multiples reprises transmis par erreur aux services de police et à la Haute Autorité pour la diffucion des œuvres et la protection des droits sur Internet (Hadopi) les coordonnées d’un même internaute innocent. Pendant près de deux ans, cet abonné a ainsi été « identifié 1 531 fois pour délit de contrefaçon et inculpé 7 fois », et soupçonné dans une affaire de pédopornographie, écrit la CNIL dans un communiqué publié le 8 mars. Il a « en outre fait l’objet de nombreuses perquisitions à son domicile et de plusieurs saisies de ses équipements informatiques ». Une erreur dans le logiciel de traitement A l’origine de ce dysfonctionnement majeur, une erreur informatique dans le logiciel mis en place par Numericable pour traiter de manière automatisée les demandes qui lui sont transmises par la Hadopi et par les services de police et de gendarmerie. « Lorsque l’application ne parvenait pas à associer une adresse IP à une personne, elle ne générait pas de message d’erreur et renvoyait par défaut à un même abonné », détaille la CNIL. Ce même abonné a donc été accusé de l’ensemble des délits pour lesquels Numericable ne parvenait pas à identifier le « réel » utilisateur de l’adresse IP signalée. Le problème, qui a perduré pendant un an et neuf mois, n’a finalement été identifié qu’avec l’aide d’un service de police qui enquêtait sur l’un des délits pour lesquels l’abonné était soupçonné à tort. Entendu par la CNIL, Numericable a reconnu l’existence du problème, mais a estimé n’avoir qu’une « obligation de moyens et non de résultat ». 19 MARZO 2016 ORE 10.30-13.00 Aula Magna, Palazzo del Rettorato, Via Verdi 8, Torino Immaginate che UBER o Facebook siano una proprietà indivisa della comunità degli utenti, e gli eventuali ricavi delle transazioni possano finanziare “voucher” per coloro che sono in difficoltà o altri progetti collettivi. Immaginate un sistema di transazione di affitti temporanei e senza scopo di profitto alimentato dalla collaborazione dei partecipanti. O ancora una piattaforma metropolitana parzialmente distribuita come collettore di queste e altre forme di transazione. Questo è possibile attraverso le nuove tecnologie di archiviazione distribuita (TAD). Si tratta di sistemi che permettono di render nota a tutti gli utenti una data transazione e di certificarla senza intermediari. Ne discutiamo con Matan Field, fisico teorico e progettista digitale in questo campo innovativo e di potenziale grande impatto sociale. Insieme ad altri ha ad esempio creato La’Zooz, una applicazione collaborativa per la mobilità urbana tra pari, ed ora sta sviluppando nuovi progetti per il cooperativismo di piattaforma. Un cordiale saluto, **** INSCI 2016 - Openness, Collaboration and Collective Action 3rd international conference on Internet Science *September 12-14, Florence, Italy * [image: Immagine incorporata 1] IMPORTANT DATES - submission of papers: March 15th 2016 - submission of workshops: March 15th 2016 - notification of decision: May 15th 2016 - early registration deadline: June 1st 2016 SCOPE OF THE CONFERENCE Internet science is a very broad concept. It includes the technical parts concerning protocols and connections, but also the contents (i.e., the Web) and applications, and, more important, the people. Internet is changing our lives, and therefore many crucial questions arise: How do people behave in the Internet? Are they changing their lifestyle and how? Can Internet promote sustainability, cooperation and collective intelligence? Can it support open democracy and policy making? How can the awareness of possibilities and dangers of Internet be promoted? What about topics like intellectual properties, privacy, reputation and participation? What are the juridical aspect of Internet? What about arts and humanities in general? The third International Conference on Internet Science, INSCI2016, is going to address such questions. We think that it is possible to focus some broad main areas: Technical aspects of Internet (protocols, apps, etc.), Internet, individuals and society (human behavior, e-health, education, economy, art, etc.), Internet and politics (participation, crowdsourcing, bottom up, top down, etc.), Internet and rights (privacy, intellectual property...), but we are open to other suggestions. Care e cari Nexiani, perdonate il disturbo (e il cross-posting), ma dato che sto "dismettendo" il mio mandato quale Presidente del Circolo dei Giuristi telematici, mi permetto di comunicarvi che sabato 12 marzo organizzeremo il convegno annuale, sul tema "10 anni di diritto dell’informatica: come le tecnologie hanno cambiato il diritto". Il Convegno è organizzato dal Consiglio Direttivo del CGT con il patrocinio morale di Centro Studi Processo Telematico e di ANORC.
