The unprecedented move highlights the start of a new era for how companies use online personal data and will start a debate about privacy. Admiral Insurance will analyse the Facebook accounts of first-time car owners to look for personality traits that are linked to safe driving. For example, individuals who are identified as conscientious and well-organised will score well. The insurer will examine posts and likes by the Facebook user, although not photos, looking for habits that research shows are linked to these traits. These include writing in short concrete sentences, using lists, and arranging to meet friends at a set time and place, rather than just “tonight”. Whenever I receive bad service from a brand, I typically fire off an angry tweet and hope the company or organisation I’m complaining about notices the blue tick next to my name and takes action accordingly. It’s ungracious, makes me look like a bit of a dick, and similar to trying to shift a caffeine-induced headache by consuming more caffeine, hardly ever works. Enter Resolver, a U.K. startup that’s built tools to help you complain the correct way. They include automating parts of the complaint letter-writing process and tracking the progress of your grievance. It’s Finally Legal To Hack Your Own Devices (Even Your Car)

Last Friday, a new exemption to the decades-old law known as the Digital Millennium Copyright Act quietly kicked in, carving out protections for Americans to hack their own devices without fear that the DMCA’s ban on circumventing protections on copyrighted systems would allow manufacturers to sue them. One exemption, crucially, will allow new forms of security research on those consumer devices. Another allows for the digital repair of vehicles. Car insurance industry to disappear by 2030?

Le considerazioni fatte sulle assicurazioni salute e sono invece agghiaccianti. <http://www.carandsuv.co.nz/news/car-insurance-industry-disappear-2030> Dr Michael Naylor, a senior lecturer in insurance at New Zealand’s Massey Business School, has undertaken a meta-analysis of how a range of technologies will change the industry in the coming decade. His report: ‘A Perfect Storm in Insurance: How to survive the looming waves of disruptive technology’ aims to help insurers prepare for a very different future. Naylor says the car insurance industry will probably be the first to sector to face major disruption. “Once networked, autonomous cars are widely available. It’s been predicted that car crashes will reduce by 80 to 90%. This development is not as far away as you might think – Volvo, for example has an aim of eliminating car crashes by 2020.” * *Naylor believes car theft will largely become a thing of the past as voice and face recognition technology will make them nearly impossible to steal, leaving insurance only for damage caused by things bumping into the car or extreme weather events. The result is car insurance premiums will fall drastically, probably by as much as 90% by 2030, says Naylor. He says that while many might view his report as speculation, there are plenty of examples of innovative insurers overseas who are using technology to change their business models. British insurer Drive Like A Girl monitors the drivers it insures via a telemetric device that sends real-time reports, including alerts of any crashes. The company is popular with young drivers who can prove they shouldn’t have to pay the high rates generally imposed on them. “New Zealand and Australian insurers are probably a few years behind those in the US and Europe, but they need to start grappling with these changes now. If they don’t, new disruptors will emerge to take their business from them,” he says. He explains that insurers need to change their view of their business as a provider of insurance products to being a data company with real-time links to customers, specialising in personal services. “Any organisation that is not a big data house now, or is unable to become one soon, is already a legacy company,” he says. Naylor’s vision of the future also has many implications for consumers. He predicts that in the future all insured objects will give constant, real-time feedback to the insurer’s data centre, and that includes people. “Wearable technology can provide minute-by-minute blood pressure readings and tell if your blood chemistry indicates an illness,” he says. “Through the connection of objects to the internet it will be possible for insurers to know how healthy the food in your fridge is or how often you exercise. Imagine how accurately they can then predict your health risk for insurance purposes.” If a person agrees to sharing information and they are healthy their insurance premiums would plummet but if they refuse they would be classed as high-risk, says Naylor. Facebook says users can't stop it from using biometric data

The companies insist that gathering data on what you look like isn't against the law, even without your permission. If judges agree with Facebook and Google, they may be able to kill off lawsuits filed under a unique Illinois law that carries fines of $1,000 to $5,000 each time a person's image is used without permission -- big enough for a liability headache if claims on behalf of millions of consumers proceed as class actions. A loss by the companies could lead to new restrictions on using biometrics in the U.S., similar to those in Europe and Canada. Facebook declined to comment on its court fight. Google hasn't responded to requests for comment /(Scroll down for a closer look at the court cases)/. Courts have struggled over what qualifies as an injury to pursue a privacy case in lawsuits accusing Facebook and Google of siphoning users' personal information from e-mails and monitoring their web browsing habits. Suits over selling the data to advertisers have often failed. *This year, the U.S. Supreme Court set a “concrete injury” standard for privacy suits, a ruling that both sides are using to argue their case ahead of a hearing Thursday in San Francisco over Facebook's bid to dismiss the biometrics case.* Google is fending off suits in Chicago, arguing that the Illinois statute can't apply outside the state under the Constitution's interstate commerce rules. Google also contends the Illinois law doesn't regulate photos. RAND: "Can Smartphones and Privacy Coexist?"

*Can Smartphones and Privacy Coexist?** * /Assessing Technologies and Regulations Protecting Personal Data on Android and iOS Devices// / As smartphones become more ubiquitous around the globe, policymakers inevitably have to grapple with issues related to the security and privacy of these devices. To aid in this understanding, in 2015, the Defense Advanced Research Projects Agency (DARPA) commissioned a team of researchers from the Massachusetts Institute of Technology (MIT) Lincoln Laboratory and the RAND Corporation to assess smartphone users' privacy from both technical and regulatory perspectives. This report documents the team's approach and findings. On the technical side, it describes a literature review and experiments performed by MIT Lincoln Laboratory investigating the state of privacy of the two major smartphone platforms in 2015: Google's Android and Apple's iOS. On the regulatory side, this report describes a review by RAND of major federal regulatory mechanisms for protecting privacy in the United States and provides a tool to understand both privacy regulation and technology. While privacy-preserving technology is improving, users' privacy concerns have not been fully addressed by the technology itself. Appropriate regulatory protections also play a role in protecting smartphone users' privacy. Currently, many gaps exist between regulation and technology: The two are not adequately paired to provide the desired protections. We believe that many of these gaps can be identified using a tool that the project team developed for policymakers. By combining technical and regulatory components associated with smartphone privacy, this matrix-based tool will help policymakers guide directions for future research and assess the impact of technical and regulatory solutions that have been or will be implemented.
