Fair-use proponents score early win in copyright case

The three-judge panel on the court determined Stephanie Lenz, who posted a YouTube video of her child dancing to a Prince song in 2007, could proceed with her lawsuit seeking damages from Universal Music Corp., which pressed YouTube to remove the video under the Digital Millennium Copyright Act (DMCA). “We hold that the statute requires copyright holders to consider fair use before sending a takedown notification, and that failure to do so raises a triable issue as to whether the copyright holder formed a subjective good faith belief that the use was not authorized by law,” according to the majority opinion. The video was eventually restored, but Lenz is seeking damages with help from the Electronic Frontier Foundation. The ruling is an early victory for advocates who argue music and movie publishers are too quick to allege infringement when requesting that Web companies — like YouTube or Twitter — remove copyrighted content. Tribunale di Roma: No alla Rimozione di contenuti su Facebook per diffamazione e violazione privacy. E' contraria all'art 21 della Costituzione.

Tribunale di Roma: No alla Rimozione di contenuti su Facebook per diffamazione e privacy. Prevale la libertà di manifestazione del pensiero riconosciuta dallart 21 della Costituzione. La diffusione di notizie su persone e fatti specifici sui social network, quandanche tali persone non rivestano ruoli pubblici, è protetta dallart 21 della Costituzione, e il diritto di critica e di cronaca sono soggetti alle stesse guarentigie previste dalla disciplina dellattività giornalistica. In particolare si applicano alle notizie fornite sulle proprie pagine Facebook, o su Forum pubblici, laddove esistenti, i principi di tutela del diritto di critica e di cronaca. E quanto ha stabilito la prima Sezione del Tribunale di Roma, con due ordinanze rese di recente, in sede cautelare ed in sede di reclamo. Secondo il Tribunale Capitolino non appare corretto ordinare la rimozione di contenuti sui social network o sui forum, e ciò anche quando siano presenti, come nel caso di specie, dati personali del presunto diffamato. Si tratta del primo provvedimento noto nel quale lart 21 della Costituzione, nella propria interezza ed a prevalenza sul diritto allonore ed alla reputazione ed al diritto alla privacy, viene applicato alle manifestazioni del pensiero che si svolgono attraverso la Rete. La vicenda ha riguardato un Imprenditore molto noto del settore finanziario che aveva a sua volta chiamato in giudizio in sede cautelare un piccolo imprenditore con il quale aveva avuto un rapporto di natura commerciale, conclusosi bruscamente. Il ricorrente aveva agito per ottenere la rimozione dei contenuti posti sulla pagina Facebook del ricorrente, e su diversi Forum finanziari di titolarità di terze persone, vantando lesioni del diritto allonore ed alla reputazione e lamentando la violazione della privacy, per sé stesso, e per alcuni dirigenti della stessa società. There are many different approaches for addressing the ethical issues related to robots (e.g., in both retrospective and prospective manners) as well as many different approaches to what ethics means in relation to robots (e.g., addressing quality of life issues versus usability and acceptance issues). Social robotics researchers need to address legal, societal and ethical issues before robots become widespread within our society. Not only should researchers focus on preventing undesired outcomes, but they also need to investigate the social roles that robots can (not) or should (not) perform in the future according to the opinions of potential future users and in the light of the ethical and societal values at stake. When ordinary people start using autonomous technologies, such as robots, in their everyday lives, robotics researchers need to map all possible interaction scenarios and their potential consequences for both individual users and society as a whole. If the rise of robotics is similar to that of personal computers a few decades ago, we can expect some important legal, societal and ethical issues to emerge from robotics as well. Therefore, robotics researchers need to attend to these issues if we want to anticipate the potential (negative) consequences of the ubiquitous use of robots in our society as well as to design robots that foster our preferred ethical and societal values. *Aim of the workshop* ------------------ This workshop aims to bring together HRI scholars from multiple disciplines to stress the need to incorporate the users’ needs not only from a usability perspective but also from an ethical perspective. We therefore believe it is vital to involve prospective users as active testers in the design process. Their opinions and perceptions help researchers, designers, and engineers to create social robots that fit the special needs and demands of potential future users. We believe that also philosophers, legal scholars, policy makers should be involved in the deliberation process about the design of future robots. *Call for papers* ------------------ Participants are invited to submit a short paper (max. 2 pages) on their ideas for the most pressing issues to address in robot ethics in the next decade including at least one case or scenario. The best ideas will be asked to give a 5 minute pitch during the workshop day to open new discussion topics. Please use the ICSR conference style when preparing your paper. As self-contained, non-connected portable servers, these devices can be used to circumvent governmental firewalls, distribute information in areas of political upheaval, reach the most remote areas to deliver healthcare information, and help recovery efforts after natural disasters. This presentation will be an overview of the LibraryBox project and its current state, goals and development roadmap, and a discussion of possible next directions and needs. About Jason Jason Griffey is the founder and principal at Evenly Distributed (http://evenlydistributed.net) a technology consulting and creation firm for libraries, museums, education, and other non-profits. Jason is a Fellow at the Berkman Center for Internet & Society at Harvard University, where he studies hyperlocal micronetworks such as his LibraryBox project. He has written extensively on libraries and technology, most recently a chapter in The Top Technologies Every Librarian Needs to Know: A LITA Guide. His previous book, Mobile Technology and Libraries, is a part of the award-winning Tech Set series. Named a Library Journal Mover & Shaker in 2009, Griffey has written and spoken internationally on topics such as the future of technology and libraries, personal electronics in the library, privacy, copyright, and intellectual property. An unfair competition model, as proposed before the enactment of the databases Directive 96/9 turned into a clear copyright model, with the difference that this time, a new sui generis right was instituted to protect not original works of the mind but data collections. The cases that came before the ECJ on the interpretation of the Directive gave the chance to “domesticate”, as Professor Hugenholtz has aptly described, this unruly database right. The Court for a long time limited the application of the Directive to cases where unfair use was truly present. But in 2015, with Ryanair, the Court took an abrupt step to the entirely wrong direction: towards rendering proprietary, at any terms, data that never before one would deem possible to be enclosed as such. The choice is now ours: either we fight, as quickly as we can, to negate the results of this manifestly wrong decision, or we decide that in the EU, there can be no open data, public data, anymore.
