solo due piccole precisazioni.
La Corte costituzionale si pronuncia, ai sensi dell'art. 134 Cost, solo su leggi e atti aventi forza di leggi, mai su normativa secondaria.
Non è detto che la Consulta entri nel merito pronunciandosi su accoglimento o rigetto (della questione di costituzionalità), non è da escludere che venga adottata una decisione di matrice processuale ( decisione di inammissibilità o manifesta inammisibilità o restituzione degli atti al giudice a quo)

Entered into force on 1 April 2014, the AGCOM Regulation allows AGCOM itself, without intervention of a judicial authority, to order the Italian mere conduits to block a website that is hosting infringing content after a very short administrative procedure.
>From the short extract of the decision that this blogger had the chance to read, however, it would appear that the TAR's referral goes far beyond that. Indeed, along with the AGCOM Regulation, the Court also questioned the constitutionality of 14(3), 15(2) and 16(3) of the Legislative Decree No 70/2003. The latter transposed into the Italian system Articles 12(3), 13(2) and 14(3) of the E-Commerce Directive , which in turn allow "a court or administrative authority" to require mere conduits/caching/hosting providers to "terminate or prevent" infringements. io ho scritto quello che pensavo sul punto in un documento abbastanza analitico (che tu hai avuto la bontà di allegare al tuo ricorso, magari la prossima volta comunicamelo prima di farlo ;) ne sono comunque onorato) ed in vari articoli apparsi su riviste , non voglio tediarvi ulteriormente.

Appunto! E’ per questo che il rinvio non è sul Regolamento ma sulle fonti del Regolamento.
Dire che il TAR ha dichiarato la legittimità del Regolamento e che il rinvio è avvenuto solo sulle leggi alla base è ovviamente falso.
Tu che sei molto ascoltato ovunque dovresti farlo presente.
L’ultimo inciso dovresti spiegarlo meglio, e già che ci siamo invece di spiegare la procedura, dovresti spiegare il tuo punto di vista, che ritengo
di grande interesse per tutta la lista.

A few days ago, an Italian administrative Tribunal referred to the Italian
Constitutional Court a question regarding the constitutionality of the
Italian Communication Authority's ('AGCOM')

have reported in

the Regulation, which entered into force on April 1, 2014, empowered AGCOM
to enforce online copyright infringement. Under the Regulation, AGCOM may
order access and hosting providers to block access to websites hosting
infringing materials or remove allegedly infringing contents after a short
administrative procedure.
Following a claim brought by a number of consumer associations, the Regional
Administrative Tribunal of Lazio asked the Constitutional Court whether
website blocking orders issued by an administrative body, such as AGCOM,
comply with constitutional principles, including freedom of expression,
economic freedom and proportionality. Additionally, the administrative
Tribunal questioned the constitutionality of the whole notice and take down
system put in place by the Italian implementation of the EU E-Commerce
Directive. In fact, the administrative Tribunal asked the Constitutional
Court to review the constitutionality of those European provisions allowing
"a court or administrative authority" to require Information Service
Providers to "terminate or prevent" infringement. Those provisions served as
the legal basis for the enactment of the AGCOM Regulation. In referring the
review of these provisions to the Constitutional Court, the administrative
Tribunal noted:
The "double track," administrative and judicial, provided for by the
European Directives that AGCOM referred to [as a legal basis to enact the
"Regulation"], should be construed by taking into consideration the
necessity that the limitations to access the Internet in order to protect
copyright should be balanced with other rights protected by European law,
such as the principle of proportionality. However, those limitations should
be subject to a preliminary judicial review. In any event, it should be
considered that the implementation of those Directives in the Italian legal
system cannot undermine the protection provided by our Constitution to other
potentially conflicting fundamental rights.

Fulvio, grazie per i commenti sui quali ci attiviamo subito.
Quanto alla differenza tra code.org e la registrazione su
programmailfuturo.it la principale è che il secondo sito consente
l'associazione immediata docente/classe/scuola con la conseguente
registrazione di tutte le informazioni connesse e l'attivazione di
azioni di indirizzamento e sostegno.
In un secondo momento la differenza sarà più sostanziale, in quanto sul
sito comparirà ulteriore materiale "italiano" sia di carattere
divulgativo che didattico.
Vorrei sottolineare che al momento il sito è stato aperto per una
sperimentazione in vista della Code Week EU (http://codeweek.eu/) per
una prima valutazione da parte di un gruppo limitato di scuole.
Il nostro obiettivo principale è l'Hour of Code di dicembre
(http://hourofcode.com/us) per la quale stiamo lavorando.
Di nuovo grazie per questi commenti e suggerimenti. Siamo perfettamente
consapevoli che il sito e le azioni collegate sono e saranno
migliorabili, ma occorreva partire per dare un segnale forte.
Speriamo di riuscire nell'intento.
