The Court of Justice sees it as a victory for privacy protection; Google sees only censorship. The company that aims to catalog the world's knowledge thinks it has a right to know it all. It introduces deeply anti-democratic measures that presume a person's guilt and attempt to prevent intention rather than actions, bypassing judiciary control in the name of the fight against terrorism. *** This new bill institutes a permanent state of emergency on the Internet that allows the judicial system to be largely bypassed and favours instead recourse to police and administrative systems that, besides failing to guarantee fair hearing, are largely disproportionate, ill-equipped and thus ineffective in reaching the stated goal of fighting terrorism. The anti-democratic measures introduced by the bill are based on vague concepts whose application can easily be extended, such as “apologie du terrorisme” (apology of terrorism), and that restrict the right to freedom of movement (art. 1), freedom of the press (art. 4), freedom of information and communication (art. 9), the protection of journalistic sources (art. 11), the right to a fair trial (art. 13) or that are simply disproportionate (art. 12, 14). These provisions have already drawn significant opposition from associations of legal professionals, freedom of speech and information advocates, human right defenders, as well as several advisory bodies. See for example the Syndicat de la Magistrature's (magistrate union) observations [4], Reporters Without Borders' press release [5], the memo [6] publlished by the CNNum (French Digital Council) and this op-ed [7] published by some of its members. The French parliament's Digital Committee also issued [8] a recommendation critical of the bill to the Law Commission. “We must not let the French government force on us a repeat of the repressive policies all too common during Nicolas Sarkozy's presidency. We can't allow to be slowly put in place a system that suspects everyone, presumes the guilt of everyone and creates an ‘intention police’ which bypasses judiciary control. Government censorship and attacks on freedom of communication and information can not be justified by this crass exploitation of fear. The French parliament is risking a lot: should French MPs prove unable to kill or modify the bill, our fundamental rights will be threatened in new and dangerous ways. One reason for this may be the divide between the ways in which people from different classes access and are exposed to health-related information. "If you are in a higher socioeconomic position, you are more likely to know about and better understand health risk factors, and to have the capacity to act on this information," said K. This information environment can affect their health in a variety of ways, such as influencing their beliefs about healthy behavior and limiting their ability to make informed decisions about medical treatments. Despite the seeming ubiquity of smartphones, only 70% of low-income people have Internet access, Viswanath said, and even that number may be an overstatement. *Vittoria in Italia: il tribunale dichiara Wikipedia “un servizio basato sulla libertà degli utenti”* La scorsa settimana, la comunità di Wikimedia ha ottenuto dal tribunale italiano una vittoria fragorosa. Per oltre quattro anni, Wikimedia Foundation e Wikimedia Italia[1] sono state coinvolte in una causa avviata dal politico italiano Antonio Angelucci e suo figlio, Giampaolo. Gli Angelucci chiedevano a Wikimedia Foundation €20.000.000 per affermazioni presumibilmente diffamatorie, che comparivano su due pagine in lingua italiana di Wikipedia. Il 9 luglio 2014 il Tribunale Civile di Roma ha emesso la sua sentenza in relazione a Wikimedia Foundation, archiviando il caso dichiarando che la Fondazione non è legalmente responsabile per i contenuti che gli utenti caricano liberamente sui progetti Wikimedia. Ad ogni modo, la vittoria, ha delle ripercussioni più profonde del caso in questione. La sentenza costituisce il primo e completo riconoscimento della posizione di Wikimedia in Italia [2]e la sentenza stessa ha spianato la strada a una maggiore tutela della libera comunicazione su Internet nell’ordinamento giuridico italiano.
