Treccani online

Nel caso non ve ne siate ancora accorti, mi permetto di segnalarvi che l'Istituto dell'Enciclopedia Italiana Treccani ha messo online sul suo sito http://www.treccani.it una quantità enorme di contenuti di elevata qualità. Ve lo dico perché magari avete notato il sito (online in questa forma ormai da qualche anno), ma l'effettiva ricchezza di contenuti non è immediatamente percepibile se ci si ferma alla superficie: occorre cercare un po', seguire gli approfondimenti per rendersi conto di quante voci siano disponibili. Non vorrei rischiare l'iperbole, ma a mio avviso è davvero in assoluto uno dei più importanti contributi alla cultura italiana presenti online! ciao, juan carlos

Segnalo un evento per i nexiani romani o di passaggio Giulio Think Digi Tank. Strumenti digitali per la ricerca L'attività dei centri di ricerca politico-culturale è resa oggi sempre più difficile dalla contrazione delle risorse pubbliche, dall'aumento dei costi per la diffusione dei materiali, dalla distanza dalle giovani generazioni. Di fronte a tali criticità il Crs si è fatto promotore di una proposta per la costruzione di una piattaforma digitale in grado di sostenere il lavoro dei soggetti impegnati, a vario titolo, in questo campo. L'iniziativa, che ha ottenuto il contributo della Regione Lazio e intende favorire il coinvolgimento dei principali soggetti del settore (tra cui Fondazione Basso, Italianieuropei, Istituto Sturzo, Fondazione Gramsci, Fondazione Di Vittorio) sarà presentata in occasione dell'incontro pubblico "Think Digi Tank. Strumenti digitali per la ricerca politico-culturale", che si terrà il prossimo mercoledì 10 dicembre, dalle ore 15, nei locali del Coworking Millepiani, in Via Nicolò Odero 13 a Roma. Based on over fifty face-to-face interviews, the book centers on the stories told by interviewees describing how and why they create and innovate and whether or how IP law plays a role in their activities. The goal of the empirical project was to figure out how IP actually works in creative and innovative fields, as opposed to how we think or say it works (through formal law or legislative debate). Breaking new ground in its qualitative method examining the economic and cultural system of creative and innovative production, The Eureka Myth draws out new and surprising conclusions about the sometimes misinterpreted relationships between creativity, invention and intellectual property protections. About Jessica Silbey Professor Silbey's scholarship draws from her interdisciplinary background in the humanities and law. One of her interests is in intellectual property law, particularly in the investigation of "IP communities:" activities, groups and organizations with a particular creative or innovative focus. She studies the common and conflicting narratives within those communities in relation to intellectual property law and legal institutions that purport to regulate them. She is especially interested in the connections between cultural narratives of creation, discovery, incentive and labor and their legal counterparts in IP communities, statutes and legal cases. The empirical dimension of this project (conducting and analyzing interviews with artists, scientists and intellectual property professionals) will be published by Stanford University Press in 2014. Another of her interests is in the interrelationship of law and film in legal practice and popular culture. Her research and writing in this area investigates how film and video are used as legal tools and how they become objects of legal analysis. A long-time interest since she was a graduate student in literature and film, her work explores questions such as: how does automated surveillance film become testimony in a court of law? How do cultural perceptions about film and video affect their evaluation by jurors, advocates and judges? How might legal actors and lay citizens mobilize the audiovisual technology of our twenty-first century to further the promises of our justice system? A current project in this area concerns ultrasound technology and the politics of reproductive choice. Professor Silbey teaches courses in constitutional law and intellectual property. Professor Silbey received her B.A. from Stanford University and her J.D. and Ph.D. (Comparative Literature) from the University of Michigan. Before joining the faculty of Suffolk University Law School, Professor Silbey was a litigator at the law firm of Foley Hoag LLP in Boston. She also served as a law clerk to the Honorable Robert E. Keeton on the United States District Court for the District of Massachusetts and to the Honorable Levin Campbell on the United States Court of Appeals for the First Circuit.

Grazie a Carlo per questa sintetica, ma molto chiara panoramica sulle questioni chiave della faccenda (e per avermi spiegato il senso di un suo tweet in cui diceva di non capire bene gli americani - non che io li capisca meglio, nonostante i miei sforzi nel "gong native" :). Da persona di origini siciliane, concordo assolutamente sull'importanza del contesto. Devo dire che questo è uno degli aspetti della cultura italiana che trovo più difficili da spiegare ai miei colleghi e amici da questa parte dell'oceano. D'altronde, ho sempre avuto difficoltà a spiegarlo anche ai miei colleghi del nord Europa. :) Ciò che comprendo bene è lo stupore nel voler "trovare un principio lineare e codificabile". Nell’articolo di giornale “over internet” è la ragione del pezzo (sti giornalisti!), là dove le questioni di causa sono solo accidentalmente collocate su FB; le questioni riassunte nell’atto introduttivo del ricorrente, Elonis, che in tutta evidenza dalla narrativa dei fatti cercava visibilità e l’ha ottenuta, sono questioni che in Italia sono oggetto di giurisprudenza consolidata. Tieni conto che la minaccia è una delle modalità operative della criminalità organizzata, articolo piuttosto tipico del made in Italy giurisprudenziale: spesso la minaccia “mafiosa” è un “salutami i tuoi” o uno “spero di veder presto i tuoi figli”, che detto da me a te è una frase gentile, detta da Totò Riina ti gela il sangue. E dunque è sul contesto e sull’elemento oggettivo del reato calato nel contesto che il disvalore meritevole di sanzione va valutato. L’elemento soggettivo del dolo non si estende mai alla concreta volontà di attuare quanto minacciato: non è quello il bene giuridico protetto dal reato di minaccia che non è un reato di pericolo, almeno in Italia. L’elemento soggettivo del dolo copre la coscienza e volontà di dire una frase che per il contesto in cui è pronunciata (noto al minacciante) è idonea ad esser oggettivamente percepita come minacciosa dalla vittima, secondo <<id quod plerumque accidit>>. Ciò che mi stupisce è il pensare di trovare un principio lineare (e codificabile) per delimitare la libertà di espressione sul confine dei diritti dei soggetti attinti dalle parole: è un errore più che giuridico di concetto, soprattutto oggi con le mutate modalità di comunicazione.
