By subverting the internet at every level to make it a vast, multi-layered and robust surveillance platform, the NSA has undermined a fundamental social contract. Cari tutti, In effetti, il DL introduce importanti novità, come notato nella mail precedente. E' interessante anche l'esclusione dal novero della esecuzioni pubbliche, di quelle effettuate "all'interno delle biblioteche, a fini esclusivi di promozione culturale e di valorizzazione delle opere stesse". Ancora più rilevante è la disposizione volta a garantire "l'accesso aperto, libero e gratuito, dal luogo e nel momento scelti individualmente, l'interoperabilita' all'interno e all'esterno dell'Unione Europea e la conservazione a lungo termine in formato elettronico" (sempre art. 4 del DL) di tutte le pubblicazioni contenenti i risultati di ricerche finanziate per una quota pari o superiore al cinquanta per cento con fondi pubblici, Peccato che, come è usuale da tempo, questa norma contenga la clausola di invarianza finanziaria, e quindi non si prevede alcun fondo per l'istituzione (o il potenziamento) dei previsti "archivi elettronici istituzionali o di settore" Staremo a vedere cosa succederà in sede di conversione. DL 8 agosto 2013 n. 91

Cari tutti, qualche giorno fa mi hanno segnalato l'approvazione del d.l. 8 agosto 2013 n. 91 (http://www.normattiva.it/uri-res/N2Ls?urn:nir:stato:decreto-legge:2013-08-0…) recante disposizioni urgenti per la tutela, la valorizzazione e il rilancio dei beni e delle attività culturali e del turismo. Il d.l. contiene (soprattutto nel capo I) talune disposizioni che possono interessare alcuni di voi (in particolare: le disposizioni sulla digitalizzazione di archivi pubblici, sull'open access dei risultati di ricerche finanziate con fondi pubblici, sulle utilizzazioni libere di opere dell'ingegno). La controversa questione del borderò SIAE

Cari tutti, forse qualcuno ha già seguito il tutto sui canali social... Ad ogni modo, nei giorni scorsi il sito Patamù ha sollevato nuovamente un'annosa questione: quella dell'obbligo generalizzato di compilare il famoso borderò SIAE. Ne è emersa una complessa riflessione giuridica che porterebbe alla conclusione che non vi è un obbligo generalizzato perchè la norma su cui si basa quest'obbligo sarebbe da tempo abrogata (art. 51 regolamento attuativo della l. 633/41). Il problema è che questa abrogazione non è molto chiara... tant'è che SIAE continua a sbandierare questa norma a tutti coloro che organizzano eventi musicali e spettacoli. Speaker Marco Ricolfi Ingresso libero This event will be webcast live: http://nexa.polito.it/upcoming-events Per più di tre secoli nella nostre società la tecnica giuridica dell'esclusiva ha fornito l'incentivo all'*innovazione* e alla *creatività*. Questa tecnica ha sorretto il paradigma, basato sui contributi provenienti dalle organizzazioni di impresa e di ricerca pubbliche e private, che si è affermata in tutti i settori della proprietà intellettuale: nel campo delle invenzioni, delle opere dell'ingegno, dei segni distintivi. Da venti anni circa ci si chiede però se, in un'epoca nella quale gran parte delle creazioni ed innovazioni assume formato digitale e le piattaforme digitali aprono inedite possibilità di collaborazione nella creazione, condivisione e disseminazione delle innovazioni, il *paradigma "esclusivo-centrico"* non debba essere rivisto, corretto ed integrato. In occasione del 56° Mercoledì di Nexa questo tema verrà approfondito e discusso da *Marco Ricolfi*, co-direttore del Centro Nexa su Internet & Società e professore di Diritto della Proprietà Intellettuale all'Università di Torino. L'idea che si stesse affacciando un paradigma nuovo si è in un primo momento affermata nel campo del copyright: il software libero <http://en.wikipedia.org/wiki/Free_software> prima e Creative Commons <http://creativecommons.org/> dopo hanno aperto la strada ad un *profondo ripensamento dell'idea che non si dia creazione senza l'incentivo fornito dall'esclusiva*. Allargando lo sguardo agli altri settori, ci si accorge che a ben vedere la trasformazione può essere ancor più radicale di quanto non fosse in un primo momento parso ai teorici del Copyright 2.0 <http://www.communia-project.eu/node/110>: non solo l'esclusiva può non essere indispensabile, ma sempre più spesso risulta controproducente, e questo anche nel campo dell'innovazione tecnologica, come esemplificato dagli studi sulla tragedia degli anti-commons <http://en.wikipedia.org/wiki/Tragedy_of_the_anticommons>, cui si assiste in settori che vanno dai farmaci, alle biotecnologie all'ICT. D'altro canto, gli economisti e i tecnologi ci hanno insegnato che le risorse digitali sono non rivali non solo nel consumo, ma anche nella produzione. Questi elementi sono sufficienti per lavorare all'ipotesi che *al paradigma tradizionale dell'innovazione si sia affiancato un altro paradigma*, che si regge non sulla regola dell'esclusività ma su regole che forniscono incentivi (non all'appropriazione solitaria dell'esclusivista) ma alla *collaborazione* in rete e che quindi sono finalizzate alla salvaguardia dell'interoperabilità, delle infrastrutture e delle risorse comuni.
