UNESCO to make its publications available free of charge as part of a new
Open Access policy
Paris, 14 May—UNESCO will make its digital publications available to
millions of people around the world free-of-charge with an open license.
Following a decision by the Organization’s Executive Board in April, UNESCO
has become the first member of the United Nations to adopt such an Open
Access policy for its publications. The new policy means that anyone will
be able to download, translate, adapt, distribute and re-share UNESCO
publications and data without paying.
Janis Karklins, UNESCO’s Assistant Director-General for Communication and
Information, announced the new policy during the opening of theWorld Summit
on the Information Society Forum<

“Researchers from all countries, but especially from developing and least
developed countries will benefit and capitalize on Open Access to
knowledge,” said Janis Karklins, UNESCO’s Assistant Director-General for
Communication and Information. “Our new policy will enable us to increase
the visibility, accessibility, and rapid distribution of our publications.”
By adopting this new publishing policy, UNESCO aligns its practice to its
advocacy work in favor of Open Access and strengthens its commitment to the
universal access to information and knowledge.
The Open Access (OA) movement was born in the scientific community to
address the spiraling costs of the scientific literature, which is
essential to researchers. A wide range of universities, institutions and
governments support it as an alternative to the traditional model of
knowledge dissemination through costly academic journals.
Starting from July 2013, hundreds of downloadable digital UNESCO
publications will be available to users through a new Open Access
Repository with a multilingual interface. All new publications will be
released with an open license. UNESCO will also seek ways to apply it
retroactively, i.e. to works already published. If UNESCO enters into
special agreements with publishing partners the Open Access policy need not
apply. Co-publishers will be strongly encouraged to adhere to the
requirements of the new policy.
By championing Open Access for its publications, UNESCO reinforces a
fundamental goal of an Intergovernmental Organization - to ensure that all
the knowledge it creates is made available to the widest possible audience.

Brutte storie - agricoltore condannato per avere riusato dei semi Monsanto, dal
proprio raccolto, infrangendo le politiche della multinazionale che obbliga gli
agricoltori a ri-comprare ogni anno sementi nuove. Il monopolio, tra l'altro ha

Ribadirei un punto: le riprese sono lecite soltanto se la visibilità a terzi sia possibile senza l'utilizzo di espedienti particolari, che invece possono superare gli "schermi" posti a tutela della riservatezza (muri di cinta, altezza dell'immobile etc).
Ora, un "guarDrone" (meravigliosa definizione di Francesco Paolo Micozzi, twittata poco fa) rientra evidentemente in tale categoria.

*** sempre che la v.camera sia installata senza entrare nella proprietà del
soggetto ripreso (quindi da altra proprietà privata o da luogo pubblico).
Diverso ragionamento forse va fatto se da strumento entrato nel sovrasuolo
(colonna daria) del soggetto ripreso : ad es. riferendo linteresse ad
escludere lingresso ex 840/2 c.c. proprio al rispetto della propria sfera
privata (detto interesse mica consisterà solo nella rimozione di ostacoli
allo svolgimento di ipotetiche attività economiche ! ).

il mezzo per superare lo schermo preesiste (es. tra i molti: palazzo più
alto che vede i piani bassi del palazzo adiacente , con posizionamento di
videocamera fissa) è lecito , mentre se viene realizzato ad hoc (videocamera
su drone, su palo appositamente piantato etc.) è illecito?

su drone, su palo appositamente piantato etc.) è illecito?

Monica mi ha preceduto, e concordo appieno con lei.
Ribadirei un punto: le riprese sono lecite soltanto se la visibilità a terzi
sia possibile senza l'utilizzo di espedienti particolari, che invece possono
superare gli "schermi" posti a tutela della riservatezza (muri di cinta,
altezza dell'immobile etc).
Ora, un "guarDrone" (meravigliosa definizione di Francesco Paolo Micozzi,
twittata poco fa) rientra evidentemente in tale categoria.

Mi permetto di inserirmi, anche se non espressamente chiamata in causa.
La proprietà nel diritto civile italiano si estende teoricamente
all'infinito (usque ad sidera, usque ad inferos), salvo ciò che prevede
l'art.840 c.c. il quale stabilisce che: "Il proprietario del suolo non può
opporsi ad attività di terzi che si svolgano a tale profondità nel
sottosuolo o tale altezza nello spazio sovrastante che egli non abbia
interesse ad escluderle".
Negli U.S.A. (da quel che leggo nel post) l'aria sembra invece essere una
"public highway".
Ciò detto, le differenze non sono, come spesso accade, mai così nette.
In Italia, infatti, come ho scritto nella precedente mail, al concetto
stretto di proprietà si è sostituito il principio giurisprudenziale del
"visibile a terzi", ed immagino che negli U.S.A. si possa agevolmente far
ricorso al principio della "ragionevole aspettativa di privacy", introdotto
dalla sentenza Kats vs. United States del 1967

le protezioni a schermo della riservatezza degli "spiati".
Senza contare, ovviamente, i profili di trattamento illecito di dati
