Within this process, the Commission launched a number of legal and economic studies on certain aspects of the legal framework, as referenced in the "Communication on Content in the Digital Single Market <http://ec.europa.eu/internal_market/copyright/licensing-europe/index_en.htm…>". The "Study on the application of Directive 2001/29/EC on copyright and related rights in the information society <http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:32001L0029:EN:N…>", prepared by a Belgian law firm De Wolf & Partners (Framework Contract PN/2009-35/D), comprises an assessment of the extent to which the implementation of Directive 2001/29/EC is appropriate to the economic and technological realities of digital markets. The focus of this study is on the exclusive rights (the "making available right" and its localisation, and other aspects of rights related to transmissions of content in digital networks) as well as on a number of key limitations and exceptions (libraries and archives, research and educational purposes, persons with a disability, user-generated content, and press review). ABSTRACT: This article presents an analysis based on data from an open dataset made available by an independent empirical research on the topic of "Copyright in the digital age". The original data includes information about attitudes, social perceptions and levels of awareness. After describing the initial objectives of the research and presenting the set of variables considered, an in-depth analysis is here discussed, focusing on the similarities and differences encountered in distinct categories of respondents. The main objective of this analysis is to test the soundness and the descriptive power of the classification proposed in the original study, which divided respondents into the four categories of "Generic", "Active", "Creative" and "Professional creative" users. Other possible clusters are identified here, and their possible associations with those groups is discussed. Results indicate that the views of authors of digital content about the practice of illegal download tend to differ from those of non producers. Non publishers of digital content seem to be almost equally distributed between those who are against download, and those who tolerate it. Grazie. This fundamental human right has been rendered null and void through abuse of technological developments by states and corporations for mass surveillance purposes. A person under surveillance is no longer free; a society under surveillance is no longer a democracy. To maintain any validity, our democratic rights must apply in virtual as in real space. * Surveillance violates the private sphere and compromises freedom of thought and opinion. * Mass surveillance treats every citizen as a potential suspect. It overturns one of our historical triumphs, the presumption of innocence. * Surveillance makes the individual transparent, while the state and the corporation operate in secret. As we have seen, this power is being systemically abused. * Surveillance is theft. This data is not public property: it belongs to us. When it is used to predict our behaviour, we are robbed of something else: the principle of free will crucial to democratic liberty. Re: [nexa] Agcom: col trattore sui diritti

Al suggestivo titolo di Arturo idealmente aggiungerei '... scavalca il Parlamento, colpevolmente immobile, da anni, e impreparato e/o ottuso quando si è trattato di attuare le direttive europee in materia di diritto d'autore digitale e commercio elettronico'. Non funziona come titolo giornalistico, ma fa capire che il problema non è il Regolamento AGCOM approvato oggi, ma la situazione assurda e non da Paese sviluppato che si è venuta a creare, anche con la contrapposizione frontale di varie lobbies (non solo quella delle industrie creative, suvvia, non scherziamo, questa è una lista di persone spesso esperte e soprattutto navigate). Mi meraviglio che da un Parlamento e da un governo così deboli e delegittimati qualcuno si aspettasse un intervento legislativo desiderabile in grado di "fermare" l'AGCOM. In un panorama politico-legislativo attualmente fuori controllo l'AGCOM si è assunta una precisa responsabilità. Vedremo che succederà, in concreto; e se il regolamento sarà impugnato in sede di giustizia amministrativa, vedremo chi la spunterà, sono curioso. Non condivido per nulla i toni drammatici delle email che abbiamo letto ieri e oggi; ripeto, il dramma per me consiste in altro. G.
