Casson: Un ddl per diritto d'autore, Agcom sospenda iter regolamento
"Il Parlamento si modifichi la normativa sul diritto d'autore sulla Rete e
l'Agcom sospenda l'iter del suo regolamento in materia". A chiederlo è il
sen. Felice Casson, vicepresidente della commissione Giustizia e primo
firmatario di un ddl in materia sottoscritto da altri 9 senatori del Pd.
"Appare ormai urgente e necessario - spiega - modificare la disciplina
vigente, contemperando adeguatamente i diritti degli autori ed editori con i
diritti di libertà degli utenti della rete che non svolgano attività
lucrativa, al fine di cogliere appieno le opportunità del digitale e
restituire così al mercato un settore delleconomia come quello
dellinnovazione e della conoscenza, che può fare dellItalia un caso di
eccellenza nel panorama europeo". "In particolare - aggiunge - occorre
circoscrivere in maniera chiara le violazioni del diritto dautore che
avvengono sul web, limitando la repressione solo ai fatti che mettono in
pericolo il legittimo sfruttamento del diritto dautore, con esclusione
delle attività meramente non lucrative. In secondo luogo, bisogna perseguire
più duramente le violazioni relative alla attività di pirateria sul web,
attraverso lidentificazione dei soggetti che realmente realizzano i
profitti legati alla pirateria, adottando lo standard internazionale del cd
follow the money. E in terzo luogo, è necessario liberare il più possibile
gli usi delle opere tutelate dal diritto dautore per finalità di didattica,
ricerca scientifica, critica e discussione e riconoscere e promuovere i
diritti dei consumatori di opere protette da diritto dautore anche e
soprattutto nel contesto digitale, al fine di renderli soggetti attivi nel
mercato dei contenuti online". "E' bene chiarire - sottolinea - che il
testo, discusso con le associazioni provenienti dal mondo del consumo, delle
imprese e per la tutela dei diritti civili, è volto a tutelare le libertà
fondamentali delle e nella Rete, senza mettere in discussione la necessità
di remunerare il lavoro intellettuale. L'era digitale impone infatti di
aggiornare una normativa che appartiene ad una stagione superata". "Per
questo - conclude Casson - Sarebbe opportuno che l'Agcom sospendesse l'iter
del suo regolamento in materia. Le più ampie prerogative del legislatore
consentiranno infatti di adottare una riforma del diritto dautore armonica
ed equa, che tratti quindi entrambi gli aspetti relativi allenforcement e
alla promozione del mercato legale, senza dimenticare in primis di
precisare, dettagliare, riconoscere e promuovere i diritti dei consumatori
nel nuovo contesto digitale, perchè altrimenti parlare di sviluppo del
mercato legale dei contenuti risulterebbe veramente velleitario se non
ingannevole".

Gianni Cuperlo:
L AGCOM è nata per garantire i diritto costituzionali dei cittadini ma è
fortemente deficitaria nella tutela del pluralismo sia in periodo elettorale
che fuori da questo periodo.
Non solo le regole sul copyright (lAgcom ha assunto in questi mesi una
posizione limitativa della libertà della rete fortemente criticata), ma
anche sulla net neutrality, sul ruolo e le forme di responsabilità dei
provider, sulle garanzie di accesso ad internet.

Il diritto d'autore digitale è stato ed è ancora oggetto di un dibattito
acceso, in Europa come nel resto del mondo. E' sempre più sentito
infatti il bisogno di chiarire i confini del diritto d'autore in un
mondo in cui opere creative, programmi per elaboratore e la semplice
aggregazione di dati possono risultare oggetto di esclusive, con
conseguenti restrizioni all'accesso e nell'uso di tali risorse. E'
altrettanto sentita l'esigenza di garantire effettività a prerogative
che hanno l'obiettivo fondamentale di remunerare il lavoro degli autori,
proteggere gli investimenti delle industrie creative e, in ultima
istanza, incentivare e premiare (economicamente e non) la creatività e
l'innovazione. In questo contesto il Centre for European Policy Studies
<http://www.ceps.be/> (CEPS) ha formato una *task force con l'intento di
stimolare un'analisi e un dibattito concernenti lo stato dell'arte e il
futuro del diritto d'autore* che ha coinvolto attivamente tutti i
portatori di interessi, esponenti autorevoli della Commissione e del
Parlamento europeo ed esperti provenienti dal mondo dell'università e
della ricerca. Il risultato di questo lavoro è un volume - /Copyright in
the EU Digital Single Market/ - che contiene una serie di conclusioni e
raccomandazioni di policy e di cui è autore, in totale autonomia,
*Giuseppe Mazziotti*, ospite del 59° Mercoledì di Nexa, ideatore e
coordinatore del progetto. Il volume è stato presentato prima a
Bruxelles e poi in varie università e centri di ricerca in Europa e
negli Stati Uniti ed è liberamente accessibile on-online in formato PDF
<http://www.ceps.eu/book/copyright-eu-digital-single-market> sul sito
del CEPS.
La sfida odierna per policy makers e legislatori è quella di
modernizzare il diritto d'autore in modi e con forme che lo rendano
compatibile con la tutela di valori e obiettivi potenzialmente in
conflitto, quali la libertà d'espressione e di comunicazione digitale,
la concorrenza, la protezione dei consumatori e la riservatezza degli
utenti di Internet. In Europa tali obiettivi sono resi ancora più ardui
da divergenze nella legislazione, nelle pratiche contrattuali e
nell'approccio a questioni giuridiche fondamentali che oltre vent'anni
di direttive europee non hanno rimosso o attenuato. Dal 2010 in poi,
nell'ambito della sua 'Digital Agenda for Europe
<http://ec.europa.eu/digital-agenda/>', la Commissione Europea persegue
l'obiettivo di favorire la creazione di un '*Mercato Unico Digitale*'
che si estenda anche ai contenuti creativi. La Commissione intende cioè
creare le condizioni affinché domanda e offerta di tali contenuti
possano svilupparsi - e, verosimilmente, crescere - a livello paneuropeo
o transnazionale, e non più all'interno dei singoli Paesi membri, come
tutt'ora accade.
Tre, a grandi linee, sono le aree del diritto d'autore in cui paiono
condensarsi i *maggiori ostacoli alla realizzazione di mercati digitali
unici*, e attorno alle quali si è sviluppato il lavoro della task force
formata dal CEPS: (i) la *gestione, individuale e/o collettiva*, di
diritti d'autore da parte dei relativi titolari secondo criteri di
rigida territorialità; (ii) la *definizione di eccezioni e limitazioni a
tali diritti*, inclusa l'eccezione di copia privata e il relativo
compenso, che tengano nella dovuta considerazione le caratteristiche
salienti dell'ambiente digitale e in particolare della comunicazione via
Internet; e (iii) il c.d. */enforcement/ del diritto d'autore* mediante
misure restrittive dell'accesso a contenuti non autorizzati rese
possibili dalla cooperazione - spontanea e non - di intermediari quali
fornitori di connettività, hosting providers, motori di ricerca, e altri.

Avvocato, docente e ricercatore universitario, *Giuseppe Mazziotti* è
fondatore del progetto Mediartis (http://mediartis.it) e consulente del
Centre for European Policy Studies (CEPS) di Bruxelles. Nel corso della
sua carriera è stato professore di diritto della proprietà intellettuale
presso l'Università di Copenhagen (2009-2012) e professore ospite presso
le università di Versailles, Roma Tre e Sassari. Tra il 2010 e il 2012 è
stato prima Visiting Scholar presso la Facoltà di Legge della Columbia
University a New York e poi Fellow del Berkman Center for Internet and
Society a Harvard. In qualità di esperto di proprietà intellettuale e
diritto delle nuove tecnologie ha inoltre collaborato con la Commissione
Europea, il Parlamento Europeo e, in Italia, con il Ministero dei beni e
delle attività culturali. E' 'Of Counsel' dello studio legale Nunziante
Magrone. Si è laureato in giurisprudenza col massimo dei voti e la lode
presso l'Università di Perugia (2001) e ha conseguito il PhD in legge
all'Istituto Universitario Europeo di Firenze (2007).

Italy Attempting To Have Copyright Enforced By Regulators, Not Courts.

A year and a half ago, we thought this plan was

-trying-to-regulate-copyright-online.shtml> dead in the water, but
apparently while we weren't paying attention, a plan moved forward in Italy
to take significant copyright enforcement powers out of the courts and,
instead, give it to the Italian regulator AGCOM. If you want to see a recipe
for a bad idea, this is it.
Regulators are very much subject to regulatory capture, and a regulatory
board entirely focused on copyright enforcement will almost certainly be
controlled by maximalists who come from industry, rather than those with the
public benefit in mind.

From Wikipedia to Open Source Software, Peer Production -- a
large-scale collaborative model of production primarily based on
voluntary contributions -- is emerging as an economically
significant production model alongside firms, markets and
governments. Yet, its impressive success remains difficult to
explain through the assumptions of standard economic theory.
In this talk, Jerome Hergueux will engage the audience in a
reflection about the prosocial foundations of cooperation in this
new Peer Production economy, taking Wikipedia as one paradigmatic
example. Based on the results from an online game-theoretic
experiment in which hundreds of Wikipedia contributors took part,
Jerome will assess economics' traditional understanding of the
other-regarding motives that can foster online cooperation. In this
process, he will ask the question: how can we start to build a
workable theory of individuals' motivations to freely contribute
time and efforts for the provision of global public goods?
About Jerome
Jerome is a Ph.D. candidate in Economics at Sciences Po (Department
of Economics) and the University of Strasbourg (Institute of
Political Studies) specialized in behavioral economics and
experimental methods. He is a Research Fellow at the Berkman Center
for Internet & Society at Harvard University (2011-2014), where he
does most of his Ph.D. work. At Berkman, Jerome couples tools from
experimental economics and computational social science to uncover
how social preferences shape our behavior over the Internet. He is
strongly involved in Professor Yochai Benkler's Cooperation project.
He is also involved with the Mindsport Research Network, which he
helped launch together with Professor Charles Nesson in 2011.
Jerome is primarily interested in applying the analytical tools of
experimental and behavioral economics to the understanding of the
evolution of culture, broadly defined as any set of norms of
cooperation shared by a group of individuals trying to overcome
particular collective action issues (be it in online or offline
settings). He then tries to assess the relevance of those norms for
determining a wide range of economic outcomes at the community
level. Jerome originates from the French region of Alsace. He holds
a B.A. in Economics and Finance from the University of Strasbourg
and Masters degrees in International Relations and Affairs and
International Economics and Trade from Sciences Po. Jerome speaks
French, English and Arabic, and is heavily interested in the Middle
East's politics and culture.

** Rationale **
Crowdsourcing - the provision of goods by large numbers of people contributing via an online platform - is used to generate and sustain policy ideas, labour markets, business investment, charitable donations, knowledge commons (such as Wikipedia), cultural goods and artefacts, libraries, government transparency, public management reform, education, scientific development and the institutions of democracy itself. This pattern of technology-enabled institutional change, where a known few are replaced by an indefinite many, has deep and diverse implications for government, business, civil society, democratic life and public policy-making. Researchers and policy-makers have barely begun to examine the opportunities and challenges that the crowdsourcing model presents.
The Internet, Politics, Policy 2014 conference is dedicated to facilitating discussion on crowdsourcing across disciplinary boundaries. The conference calls for papers on the observed and potential implications of crowdsourcing for politics, policy and academic practice. Perspectives are welcomed from across science, social science and the humanities as well as from academic and policy-making communities. We aim to identify both what is novel in crowdsourcing, and the ways it enables and extends existing social and political processes.
** Topics **
The conference aims to attract papers from a range of disciplines analysing crowdsourcing-related phenomena. We welcome both theoretical and empirical papers reporting original research on crowdsourcing and related concepts such as microwork, peer production, human computing, co-creation, open innovation and e-government. We particularly welcome comparative approaches and papers drawing on new empirical findings and novel research methods.
Topics of interest include (but are not limited to):
How is crowdsourcing changing politics? Topics of interest include citizen participation in government and the political process, and online collective action.
Uses of big data in evidence-based public policy, including probabilistic, and conditional and predictive policy-making and the use of social media data for government self-improvement.
Online labor markets, new organizational forms, and the blurring of boundaries between work and play, as well as the economics of crowdsourcing more generally.
Co-production and co-creation of public policy, through (for example) the use of feedback facilities, rating, ranking and reputation applications.
Crowdsourcing for conflict management, peace building and humanitarian intervention, including crisis mapping.
Crowdsourcing for educational, scientific and technological development, such as citizen science, crowd-funding, massive online open courses, and the methodological, epistemological and ethical issues involved.
New methods for analyzing crowdsourcing, such as computational social science and big data analytics, including sentiment analysis, topic classification, sampling from social media platforms, and inferring from socially generated data to the wider population.
Ethical issues arising from the use of such methods, such as de-anonymisation, privacy, and inequalities created by the use of predictive analytics in decisions concerning individuals.
When crowds turn into mobs: online hate groups, organized cyberbullying, their dynamics and effective policy responses.
Perspectives from any academic discipline are welcomed, including: political science, economics, law, sociology, medicine, information science, communications, philosophy, computer science, physics, psychology, management, organization science, geography and humanities. Papers should attempt to frame their object of study in relation to established concepts and theories. 'Crowdsourcing' need not be the central concept in a paper as long as it deals with the issues and topics identified in this call.
** Proposal submission **
* Paper proposals
Paper proposals should consist of a title and a 1,000-word extended abstract that specifies and motivates the research question, describes the methods and data used, and summarises the main findings. Abstracts will be peer reviewed, and the authors of accepted proposals are expected to submit full papers prior to the conference. Applicants will have the opportunity to co-submit their paper to the journal Policy and Internet, which will operate a fast-track review process for papers accepted to the conference.
Paper submissions can also be considered for a Best Paper Award (sponsored by the journal Policy and Internet). The prize will be awarded at the closing session of the conference. As the paper is intended to be published in a future issue of the journal, authors should indicate whether they would like their paper to be considered for the prize.
* Poster proposals
Posters should summarise in a visually engaging manner the purpose, methods and results of an original piece of research. All accepted submissions will be considered for a Best Poster Award. The prize will be awarded at the closing session of the conference.
