Hai ragione, questa può essere una fonte. Bisogna tuttavia fare attenzione alla data retention e all'uso che la PA fa dei dati (v. vari progetti di schedatura e controllo di massa). Il problema è però che l'altra grande fonte (le imprese) stenta invece a passare a logiche di apertura dei dati, se non agli amici... A. IMHO la strada da seguire è la collaborazione tra pubblico e cittadino: alla PA passano tra le dita molti dati che, a rigor di legge, devono essere cancellati. Il patto pubblico-cittadino potrebbe essere: - la PA, a richiesta del cittadino, conserva i dati e li tiene a sua disposizione. - il cittadino (oltre ad usare i dati per quel che vuole) autorizza l'uso dei dati per fini di ricerca "etica" (secondo il paradigma della scienza aperta). m.c. Non a caso uno degli autori non appartiene ad un'università, ma è un dipendente di Facebook. In questo scenario dominato da (pochi) detentori di grandi masse di dati e relativi sistemi di analisi, emerge la criticità di continuare a condurre ricerche libere ed indipendenti, non solo per la carenza di fondi, ma anche per l'accesso ai dati. Non ho una risposta, ma vedo un problema in termini di indagine e competizione nella ricerca. AM

Finche' non discrimini pacchetti, questo pero' e' alla portata di tutti. ed e' sempre stato cosi'. io ci ho fatto una azienda che faceva di essere la meglio interconessa il suo vantaggio competitivo non c'e' un vero svantaggio competitivo per le aziende che operano localmente ad un paese (anche i CDN proviedr hanno presenze puntuali, nei vari paesei, non capillari) e per quanto riguarda la presenza internazionale i servizi cloud abbassano i relativi costi in modo estremamente significativo. iniziare un servizio solo 5-6 anni fa costava moltissimo di piu' di quanto costa adesso. ciao, s. per chi fosse interessato The Data Surveillance State in the US and Europe Joel Reidenberg Princeton University - Center for Information Technology Policy; Fordham University School of Law November 2, 2013 Wake Forest Law Review, Forthcoming Abstract: The democracies on both sides of the Atlantic are trying to balance the legitimate needs of the law enforcement and intelligence communities to access online transactional data with the basic rights of citizens to be free from state intrusions on their privacy. From the recent revelations of massive collection of telecommunications data by the US government to the disclosures of the UK tapping transatlantic telecommunications cables, and of the Swedish government’s warrantless wiretap rules, national data surveillance seems to have few boundaries that the law has effectively protected. American law has generally focused on access restraints for government to obtain privately held information, ignored the collection and storage of data, and granted special privileges to national security actors. By contrast, Europe emphasizes rules related to the collection and retention of data and focuses less on due process obstacles for government access, while also giving government easier access for national security. In each system, the elusive linkage between retention and access, the privatization of state surveillance activity, and flawed oversight for national security create extensive transparency of citizen’s data and undermine values of democracy including the presumption of innocence, the state’s monopoly on law enforcement, and the zone of individual freedom. In effect, government data surveillance law in both Europe and the United States has reached a turning point for the future of information privacy online. Three proposals can help to secure privacy that is necessary to preserve democratic values: stricter retention limits must be combined with stronger access controls; government access to personal information must be logged and transparent to citizens; and government officials must be personally liable for over-reaching behavior.

Hai ragione, Giorgio, in questi anni la questione neutralità si è parecchio complicata. Il faro guida, però, rimane lo stesso, ovvero cercare di ridurre la concentrazioni di potere, le possibilità di gatekeeping, ovvero, di controllo dell'ecosistema Internet. Il vero problema (regolatorio, economico, tecnologico) è come riuscirci, che il "pericolo" sia una Telco o Google o domani chissà quale altro attore.
