Today’s electronic Silk Roads ferry information across continents, enabling individuals and corporations anywhere to provide or receive services without obtaining a visa. But the legal infrastructure for such trade is yet rudimentary and uncertain. If an event in cyberspace occurs at once everywhere and nowhere, what law applies? How can consumers be protected when engaging with companies across the world? From Facebookistan, to online gambling and PRISM, the new trade routes raise urgent questions of law and policy. About Anupam Anupam Chander is Director of the California International Law Center and professor of law at the University of California, Davis. Basti pensare che ci sono voluti 126 anni prima che al mondo ci fossero un miliardo di telefoni fissi, ma appena 8 per avere un miliardo di persone su Facebook. Per non parlare degli smartphones, che fino a poco fa appesantivano le tasche solo dei più fanatici, ma ora rappresentano oltre il 50% dei telefoni venduti al mondo. Cambiamenti molto rapidi che riguardano miliardi di persone: è inevitabile che i problemi siano elevati al cubo. Problemi, ma anche benefici, o le reti sociali non avrebbero tanto successo: vengono apprezzate soprattutto perché offrono un’alternativa alla posta elettronica, giudicata da molti (soprattutto i più giovani) limitata e formale, per condividere video, libri, musica, eventi, fotografie, testi, notizie sulla propria vita personale. Invece di «lettere» che si impilano inesorabili, un flusso continuo di stimoli, come una radio accesa in sottofondo, più discreta e meno esigente della posta. Bella iniziativa, certo nell'ottica dei beni comuni sarebbe auspicabile creare iniziative maggiormente aperte a tutti e non ad invito. Capisco la ricerca di competenze, ma certo i workshop chiusi (di cui non si conoscono a volte neppure ex ante i partecipanti) forse sono un modo di procedere un po' insolito per parlare di beni comuni e collettività. IRPILEAKS permette proprio di evitare esposizioni mediatiche o ritorsioni verso coloro che decidano di farlo. Con la piattaforma di segnalazione IRPILEAKS, costruita grazie al software GlobaLeaks, progettato dal Centro Studi Hermes, è possibile fare segnalazioni in forma confidenziale o anonima. L’anonimità dell’informatore è legata all’utilizzo di Tor, tecnologia all’avanguardia per quanto riguarda la protezione digitale dell’anonimato. GlobaLeaks è “La prima piattaforma realizzata in software libero, che ha l'obiettivo di abbattere le barriere che ostacolano la creazione di iniziative di whistleblowing" dice Claudio Agosti, presidente di Hermes, "Abbiamo notato anni fa che la rete avrebbe potuto raggiungere tutte quelle persone che soffrono silenziosamente l'omertà, che hanno perso la speranza di poter risolvere i problemi che li circondano. Le informazioni che verranno sottoposte a IRPI tramite la piattaforma IRPILEAKS verranno quindi accuratamente studiate e solo le segnalazioni ritenute di interesse pubblico verranno affrontate e presentate sotto forma di inchieste giornalistiche da veicolare attraverso i media mainstream. Sul sito di IRPI alla sezione INFORMACI troverete tutte le informazioni sul software e una guida sui rischi connessi al leaking e sui comportamenti da adottare per proteggere la propria identità.
