Campaigns against the privatization of digitized public domain material in France

Dear all, A small point of information on what be of interest to all of you. For several years, the French National Library BnF (as well as the French National Audiovisual Institut INA) have been engaged in negotiating public-private partnerships for digitizing part of their collections. These agreements receive public funding through a stimulus plan (named "grand emprunt" = "great loan" under the former government and "investissements d'avenir" = "investments for the future" under the new government). The agreements regard collections that include public domaiun material, orphan works, out-of-publication works and commercially distribued works, with different provisions. For now two years, a debate developed, first in 2011 in specialized international circles of library digitizing policy, then through coverage by the on-line media ActuaLitté (http://www.actualitte.com/) and by myself, in particular on the specifics of agreements regarding public domain material. On 15 January 2013, just during the wave of emotion surrounding the death of Aaron Swartz, the Ministry of culture, the Commissariat à l'investissement and BNF announced the signature of two agreements regarding respectively ancient books (incunables and books until 1700) with ProQuest and 78 and 33rpm sound recordings of patrimonial value (only part being public domain) with Believe. These agreements create 10 years of commercial exclusive rights for the private party, the library being authorized to distribute on-line only 5% of the works, and to give access to the rest when digitized only in its premises (during the 10 years). Similar agreements exist in other countries, in particular in the UK, but it should be noted that, according to information published by the signatories, the rights of the public and libraries are tramped upon by the French (unpublished) agreements to a significantly greater degree than in the Google Books agreements, even though the new policy is supposed to represent an alternative. I have published an analysis on 16 January http://paigrain.debatpublic.net/?p=6333 (in French) stressing that the agreements constitute a privatization of the public domain, are in contradiction with the Europeana Charter (the President of BNF also chairs Europeana) and with the recommandations of the European Commission Comité des Sages, and of course with COMMUNIA Public Domain Manifesto and recommandations. I also analyzed how the public private partnerships are likely to be economically more costly for the government than procurement for digitizing under the library own terms, and called to their immediate publication, their cancellation. I stressed that there were likely to result in French-speaking public domain material being mostly available from societal projects (Internet Archive, Gutenberg, WikiSource, UbuWeb and P2P file sharing) or from the US DPLA. I also stressed that it was every citizen's right and duty to share widely the works digitized under these agreements or by others that would enter in one's possession (by legal means) as to prevent the privatization of the public domain. And that if technology or legal artifacts were used to prevent entry in possession of these files by their users, they should be legally and politically challenged. Giuseppe Vaciago For Their Eyes Only: The Changing Face of Online Spying - Morgan Marquis Boire 01/02/2013– Ore 14.30 - Aula Magna del Politecnico di Milano Nel corso della “Primavera Araba” si è assistito all’utilizzo da parte di cittadini privati dei loro diritti civili, economici e politici, di strumenti come i Social Media e smartphones per vincere il monopolio statale dell’informazione e mobilitare una protesta di massa. Mentre i governi hanno impiegato poco tempo nel prendere familiarità con i diversi meccanismi di repressione contro i manifestanti, questi ultimi hanno inizialmente avuto alcune difficoltà nel controllare il nuovo “dissenso digitale”. I mezzi tradizionali di censura, filtraggio ed intercettazioni sono divenuti sempre meno efficaci contro una comunità digitale più consapevole riguardo al tema della sicurezza online. I regimi, preoccupati per questa crescente consapevolezza, si sono rivolti a quell’industria di strumenti per la sorveglianza di Internet da 5 miliari di dollari all’anno ancora ampiamente non regolamentata. Inizialmente ottenuti attraverso il mercato nero e le agenzie di intelligence, ora i più recenti computer spyware sono venduti in occasione di eventi commerciali a prezzi accessibili per qualsiasi dittatore. Attivisti e giornalisti si sono presto trovati ad essere target di e-mail in grado di fornire informazioni esclusive e scandalose. Marquis-Boire e il suo team, analizzando alcuni messaggi a loro inoltrati da utenti insospettiti, hanno trovato spyware distribuiti dalla Gamma International e Hacking Team, conosciuti protagonisti nell’industria di prodotti per la sorveglianza. Così hanno analizzato i loro prodotti, alla ricerca di indirizzi internet e società di comodo in tutto il mondo. Non appena però hanno pubblicato i loro risultati i server sono scomparsi e gli spyware sono stati riscritti e modificati. Questo talk ha lo scopo di proseguire nello sforzo di tracciare la mappa delle relazioni tra le compagnie distributrici di software di sorveglianza e i governi. Morgan Marquis-Boire lavora come Security Engineer presso Google; è specializzato nelle aree dell’Incident Response, Forensics e Malware Analysis. È security researcher e Technical Advisor per il Citizen Lab, la Munk School of Global Affairs e l’Università di Toronto (per ulteriori informazioni:https://citizenlab.org/author/mmboire/. Confermo, con ulteriori illustrazioni concrete: 1. La biblioteca e specificamente il bibliotecario vengono visti in senso generale come veicoli di accesso dinamico alla cultura, non solo in termini di magazzino o trasporto meccanico dei libri. La NYPL offre corsi quotidiani che guardano verso il futuro digitale della cultura bibliotecaria. Uso del computer, anche totalmente di base, ricerche online, le sfide della digitalizzazione non solo di libri ma artefatti culturali in generale. http://www.nypl.org/events/public-programs 3. Ci sono investimenti ingenti per biblioteche e in particolare toglie il fiato il progetto di ampliamento della sede centrale della NYPL verso Bryant Park, con un video illustrativo a volo d'uccello: http://www.youtube.com/watch?v=069BmopRbQg 4. Interessante, sull'argomento della fine della crescita (zero growth platteau) suggerisco anche Tyler Cowen "The Great Stagnation" http://en.wikipedia.org/wiki/The_Great_Stagnation Un pamphlet (ma con dati rigorosi) che sostiene più o meno gli stessi argomenti. C'è anche un capitolo dedicato a Internet dove si afferma che la rivoluzione di Internet e dell'era digitale ha migliorato la qualità della vita di molti consumatori, ma i campioni di questa economia non generano tanto lavoro quanto i campioni dell'era industriale/manifatturiera.
