bene bene, adesso che sappiamo che era solo "a limited test" e che la funzione "is not currently implemented for most users" siamo tutti più sereni. In più gli utenti erano anche informati e consenzienti, quindi quando un domani il test sarà magari su ampia scala e tutti saranno consenzienti potranno elevare il test a standard. Il problema è che informare ed avere il consenso non basta, non in contesti con questa sproporzione di forza, di dominio di mercato e, soprattutto, di detenzione di un assai notevole potere informativo. Il consenso (ammesso che sia libero ed informato) di una moltitudine di singoli non può più bastare nell'era dei Big Data, occorrono limitazioni e controlli dei poteri di analisi; nella storia siamo stati molto attenti a porre dei vincoli e nel creare organismi di controllo volti a vigilare sul potere informativo dei soggetti pubblici (viste diverse tristi esperienze), ma bisogna esserlo altrettanto con quelli privati, specie tenuto conto che i confini fra i due non sono affatto insormontabili. ... già, e sono in buona compagnia:http://goo.gl/rSGbv Ne parlammo più di un anno fa a Nexa ed all'epoca mi chiesi cosa sarebbe successo se qualche operatore avesse optato per “be evil” (http://goo.gl/h4wnp) alla fine le previsioni si sono avverate! La risposta di alcuni fu che il mercato avrebbe punito chi abusava dei propri poteri, mi pare però che il mercato in alcuni casi non sappia ed in altri non sia in grado di valutare (basta vedere quanti usano Fecebook nonostante le privacy policies al centro di diverse indagini). Quando sono in discussione i diritti della persona non è detto che rimettere tutto all'arbitrio dei singoli (e conseguentemente alle logiche di mercato) sia la soluzione migliore. Per decidere occorre trasparenza, consapevolezza, libertà di scelta ed in ogni caso un ordinamento giuridico deve garantire la tutela della persona nei suoi diritti fondamentali, anche limitandone la negoziabilità. Per tali ragioni la posizione europea sulla data protection risulta scomoda e va sostenuta contro l'ampia azione di lobbying US (http://goo.gl/bZjXE, http://goo.gl/Tu904) che purtroppo vede coinvolti anche accademici d'oltreoceano.
