Il gestore di una rete sociale in linea non può essere costretto a predisporre un sistema di filtraggio generale, riguardante tutti i suoi utenti, per prevenire l’utilizzo illecito di opere musicali e audiovisive Un simile obbligo non rispetterebbe il divieto di imporre a detto gestore un obbligo generale di sorveglianza, né l’esigenza di garantire il giusto equilibrio tra la tutela del diritto d’autore, da un lato, e la libertà d’impresa, il diritto alla protezione dei dati personali e la libertà di ricevere o comunicare informazioni, dall’altro (Sentenza nella causa C‑360/10, Belgische Vereniging van Auteurs, Componisten en Uitgevers (SABAM) / Netlog NV)
