In recognition of these stresses, the Copyright Principles Project (CPP) was formed to consider whether and what possible improvements could be made to existing U.S. copyright law. Participants brought to the project a range of expertise and experience developed in academia, the copyright industry, and law firms. Over the course of three years and in the spirit of dialogue and good will, the CPP group engaged in vigorous debate and deliberation, mapping the terrain of U.S. copyright law and policy and identifying key issues for consideration. Project findings are presented in this report. The report first articulates principles of a well-functioning copyright law, then analyzes respects in which existing copyright law does or does not comport with these principles. The report then explores twenty-five possible reforms to U.S. copyright law that would bring it into greater conformity with the principles. Among the recommendations: reinvigorate copyright registration; modernize the Copyright Office; limit orphan works liability; and develop reasonable and consistent statutory guidelines for damage awards. Some of the changes can be brought about only by legislative action, while others can be accomplished through common law evolution. Giuseppe, concordo (in vero un pò con tutti, come spesso accade in questa lista) ma la tua e-mail mi sollecita alcune considerazioni: Tu dici, che la risposta francese è qualcosa di meglio rispetto alle modalità di enforcement online che hanno preso piede in alcuni Paesi in cui A) non esiste niente di simile al modello francese, e quindi gli utenti non sono in messi in guardia o resi edotti delle conseguenze del download non autorizzato; Se continuamo a vedere il file sharing come un problema di educazione alla legalità o di conoscenza dei buoni diritti dei detentori del copyright commettiamo un clamoroso errore: chi scarica non lo fa affatto perchè non sa che è illegale, ma per cercare contenuti che non si trovano, o se si trovano hanno costi e vincoli (non solo economici) inaccettabili. Chi condivide -o remixa e condivide- opere altrui lo fa per ragioni che grazie a Dio non sono e non debbono essere- inficiati da vincoli commerciali che possano impedire in toto tali attività. Semmai vanno disciplinati, evitando monopoli commerciali inaccettabili. B) la protezione della privacy degli utenti non è forte abbastanza... e neppure la libertà di espressione ed il diritto di prendere parte liberamente alla vita culturale della comunità, di godere delle arti e di partecipare al progresso scientifico ed ai suoi benefici tanto per rimanere in ambito UN. Sotto lequivoco della data retention si rischia una saldatura tra big brother e big business che nei servizi claud assumerà aspetti davvero orwelliani. E gli utenti saranno nelle mani di ISP lontani e incontrollabili, più inclini ovviamente a compiacere il potere di turno (Procure e Titolari) se ciò non impatterà negativamente con il loro aggio. E vero che la scelta francese ha il pregio di esser chiara, e chiaramente avversabile. In Italia BTJunkie.org è oscurato perchè un P.M. (e dico un P.M.e non un giudice) ha emesso un provvedimento abnorme, sbagliato tanto nel merito (confonde i traker e i server traccia con i motori di ricerca dei file .torrent) quanto nella procedura (lordine di inibizione ai fornitori di accesso da parte del P.M. non esiste in Italia poichè anche a voler ampliare il sequestro con linibizione come per thepiratebay, sempre una misura cautelare è, e dunque è il GIP a dover provvedere!), e non si può far nulla: il provvedimento è contro ignoti; BtJunkie non ha ricevuto nulla, il provvedimento, anche a trovare qualche interessato legittimato ad opporsi, non è ricorribile, se non forse in cassazione ex art 111 Cost. poichè è un provvedimento inesistente nel codice di rito! Certo a fronte di obbrobri come linibitoria a BTJunkie, la proposta AGCOM appare liberale e garantista. ma dobbiamo compiacerci del meno peggio? Ben venga La Rue...per quel che vale! Con ciò non intendo dire che mi piaccia il modello francese, ma solo che c'è al momento di peggio. Ciao a tutti, scrivo per dire che condivido la cautela e l'esigenza di precisione di Andrea. Visto che poi si parla di UN, bisognerebbe tenere in considerazione la posizione della WIPO sul punto, trattandosi di un'agenzia delle UN. Recentemente, parlando con dei rappresentanti dell'industria discografica a livello globale (IFPI), dalle cui posizioni eccessive ho sempre preso le distanze nello svolgere il mio lavoro, mi sono reso conto che il sistema dei three strikes o della risposta graduale (modello francese) è effettivamente qualcosa di meglio rispetto alle modalità di enforcement online che hanno preso piede in alcuni Paesi in cui A) non esiste niente di simile al modello francese, e quindi gli utenti non sono in messi in guardia o resi edotti delle conseguenze del download non autorizzato; B) la protezione della privacy degli utenti non è forte abbastanza e non impedisce lo svelamento della loro identità direttamente ad opera del ISP, su richiesta del titolare del copyright che sia in possesso degli indirizzi IP (in Paesi come questi, migliaia di utenti stanno ricevendo proposte di transazione direttamente dagli studi legali che assistono le case discografiche, e non da un'autorità amministrativa, nell'ambito di un procedimento regolamentato). Con ciò non intendo dire che mi piaccia il modello francese, ma solo che c'è al momento di peggio. Odio dover fare il precisino, ma gli "endorsement" *non* sono delle organizzazioni in oggetto, ma degli "special rapporteur" di ciascuna organizazzione. O mi sbaglio? Per inciso, il motivo per cui insisto su questi aspetti "formali" è che dal punto di vista politico è IMHO strategicamente pericoloso dare l'impressione che ci sia più supporto ad una posizione di quanto sia nella realtà. Per mia esperienza, spesso questo si traduce nel successivo mancato supporto da parte di *organizzazioni* che avrebbero potuto darlo. Ci sono stati alcuni endorsement ufficiali: OAS (Americhe), OSCE (EU) and ACHPR (Africa): http://www.osce.org/fom/78311 Speriamo che altre dichiarazioni di supporto seguano a breve. Magari, perchè no, anche dalla Commissione Europea :-) Penso che questo testo, al di là della critica all'approccio Hadopi, abbia un altissimo valore morale (in particolare dovuto alla figura di Frank La Rue) e politico (riportando il diritto all'accesso alla Rete come centrale nel dibattito). Philippe, that may be true, but is not the point - which for me is that neither the HRC nor the UN General Assembly have adopted the conclusions of the report. Hence, saying that the *UN* is against 3-strikes policies (or similar headlines which I saw flying around) is misleading, at best.
