Certo, per questo ho parlato di un'imprecisione: dire che l'HADOPI "in Francia dopo il terzo avviso toglie l'accesso a Internet ai cittadini che scaricano contenuti senza pagare il copyrigh" mi sembra fuorviante perché da l'impressione che la Haute autorité abbia il potere di privare automaticamente "i cittadini" di accesso, cosa che non rispecchia la realtà. Buongiorno Luca, credo che Anna Masera si riferisse evidentemente ad HADOPI-2. L'eventuale decisione di disconnessione viene presa da un giudice tramite un processo espresso in cui il sospettato non ha diritto alla difesa piena (non avendo diritto alla rappresentanza legale). Il sospettato può comunque ricorrere contro una decisione presso un tribunale ordinario. Credo che Philippe Aigrain in questa lista possa fornire ogni singolo e minuto dettaglio su HADOPI-2, e il centro NEXA ha fatto un'ottima traduzione di un gran bell'articolo de La Quadrature du Net all'indomani della decisione del Consiglio Costituzionale di ritenere OK HADOPI-2. Unsurprisingly, the Commission calls for preventing copyright infringements on the Internet “at the source”, by forcing Internet companies such as hosters and access providers to obey the entertainment industries. In practice, turning these actors into a copyright police comes down to establishing a censorship regime, paving the way for dangerous breaches of fundamental rights. *** For years, policy-makers have been implementing repressive schemes to fight not-for-profit exchanges of copyrighted works by individuals over the Internet. Ever since they lost control over the distribution channels of cultural works, the biggest entertainment majors have relentlessly explained that the whole creative economy is going bankrupt. But an evidence-based approach to the filesharing phenomenon shows that the negative impact of so-called piracy is a myth: those who exchange cultural works on the Internet are fans, not free-riders. Even the study commissioned by the infamous HADOPI – the agency in charge of implementing the three-strike scheme in France – showed that people who share cultural works online declare spending more on cultural goods than consumers who do not [1]. Similarly, live performances are booming and ticket sales for movie theatres are at all-time highs [2]. Sharers are actually the creative sector's best customers. “The sharing of culture between individuals is a positive force for the creative economy, cultural diversity and access to culture. Even though facilitating the commercial distribution of creative works on the Internet is positive, it can not be done at the expense of criminalizing a practice which has obvious benefits, if one dares consider the evidence.” says Philippe Aigrain, co-founder of La Quadrature du Net. Although the Commission explains that the IPRED directive will be revised to step up the repression of online infringements, it is hard to see a principle-basis. It is all the more worrying that, as announced by Internal Market Commissioner Michel Barnier, what the Commission envisions is extra-judicial enforcement of copyright at the core of the Internet's architecture. Following Nicolas Sarkozy's realization that measures weighing on Internet users are political and technical failures [3], the Commission is trying to compel Internet actors to police their services and networks [4], as we explain in our response to the consultation of the anti-sharing IPRED directive. This would turn Internet companies into a private copyright police and justice, violating the right to a fair trial, freedom of expression and privacy [5]. “Like the United States with the PROTECT IP Act, the goal of EU authorities is to use technical means to block communications and restrict users' access in the name of enforcing an obsolete vision of copyright. Such a scheme would lead to the establishment of a censorship infrastructure by online actors, technically similar to those currently used in authoritarian states. In the process, freedom of communication, privacy as well as the right to a fair trial would inevitably be undermined.”, says Jérémie Zimmermann, spokesperson of La Quadrature du Net. “This shift towards an increased role of Internet platforms in preventing the sharing of cultural works online is alarming. It comes down to transforming the very architecture of the Internet for the sole benefit of a few corporate players. Their harmful influence on policy-making is keeping us away from a crucial reflection on how to fund the creative economy of the 21st century.”, concludes Zimmermann. * Références * 1. Noi commoners, divulgatori e praticanti delle teorie della cooperazione - orientate alla creazione di beni comuni informazionali usando le CC o le Gpl e similiari - siamo vecchi. Siamo gli ultimi guardiani del copyright. Ai giovani che ho incontrato e che ho visto battagliare tra pc e consolle non gliene importa un fico secco del copyright e in molti casi non gli importa neppure di essere pensati come autori o di proporsi come tali. Fanno cose bellissime e non si curano minimamente se è lecito o meno campionare suoni e immagini, non gli importa sapere se saranno retribuiti e vivono alla giornata, magari distruggendo il giorno dopo quello che hanno creato...non cercano credits e irridono ogni forma di proprietà e di controllo... Questo è l'appello al G8 che abbiamo contribuito a promuovere come IRP-Internet Rights and Principles Coalition Fatene buon uso ;-) Fiorello Civil Society Statement to the e-G8 and G8 The signatories of this statement are representatives of civil society from around the world working towards the promotion of Internet freedom, digital rights, and open communication. We understand that the French Presidency of the G8 is holding a G8 internet meeting -- the "eG8 Forum" -- immediately before the G8 Summit in Deauville, with a view to shaping the agenda of the G8 Summit regarding key global internet policy issues. This meeting is significant in that this is the first year that the internet’s role in society and the economy is explicitly on the G8 agenda. As key world leaders, your policies have a major influence on internet policy globally. Regrettably, certain policies being implemented in the most developed economies are undermining the open and neutral internet -- the very qualities that represent the essence of its democratic and economic potential. We believe that G8 Member States should use the e-G8 meeting as an opportunity to publicly commit to expanding internet access for all, combating digital censorship and surveillance, limiting online intermediary liability, and upholding principles of net neutrality. Internet Access for All We are particularly concerned about the increasing trend of nations cutting off citizens’ access to the Internet and mobile networks in times of crisis, as Egypt, Libya, Iran, China, Nepal, and Burma have all done. In many if not all of these countries, we see how important access to the Internet is as a gateway to a plethora of others civil, political, and fundamental human rights. Many G8 countries are actively pursuing policies that would similarly seek to restrict and control access; these policies legitimize actions of repressive regimes and threaten the core of the internet economy. As many nations endeavor to improve basic and universal access, the increase of restrictive policies in both the developed and developing world is a regressive and deeply worrying trend. Freedom from Online Censorship & Surveillance Simultaneously, repressive regimes are harnessing the internet’s power for their own purposes, often with the help of multinational corporations based in G8 countries. We urge you to end the sale of these technologies both at home and abroad, and put an end to these gross invasions of user privacy and security. Online Intermediary Liability and Intellectual PropertyTo defend freedom of speech online it is critical that we resist mounting pressure from the entertainment industry and other sectors to impose greater intermediary liability on online service providers for the actions of their users through instruments like HADOPI and ACTA. In this regard, we urge you to follow the example of the Brazilian government’s Principles for the Governance and Use of the Internet, specifically #7 which reads: “All action taken against illicit activity on the network must be aimed at those directly responsible for such activities, and not at the means of access and transport, always upholding the fundamental principles of freedom, privacy and the respect for human rights.” 1 Net Neutrality We further call on you to commit your nations to protecting net neutrality -- the principle that all web traffic should be treated on an equitable basis no matter where it originated or the type of data being transmitted. These are some of the key Internet governance issues which we feel merit and require the attention of the G8. We also draw your attention to two comprehensive declarations of principles we believe should guide nation states in Internet governance: ● The 10 Internet Rights and Principles developed under the aegis of the Internet Rights and Principles Coalition 2 . ● Assembly Declaration of the right of Communication, written at the World Social Forum 2011. 3 We would also like to highlight our concerns regarding the planning of the e-G8. We join our voices to the Internet Governance Caucus 4 which expresses our collective concern about the lack of representation of civil society at the e-G8 and G8 meetings this year. Contrary to current best practices in policymaking, the invite list has been limited primarily to representatives of government and corporate leaders, who already enjoy disproportionately large influence over Internet regulation.
