Last week, a cross-party mission from the French Parliament issued a courageous report denouncing the anti-competitive and dangerous behaviour of operators. The document relied on a sound definition of Net neutrality to propose pro-active regulation [3]. Neelie Kroes' report does the opposite by turning this founding principle into a mere competition issue, stating that there is no problem and that any bad behaviour will be solved by the market anyway. "This very disappointing report contrasts with Commissioner Neelie Kroes' multiple statements regarding the importance of preserving Net neutrality in order to protect EU citizens' fundamental freedoms. Quite shockingly, the Commission thinks that Net neutrality is compatible with traffic differentiation on the public Internet. This clearly favors telecoms operators who want to boost their profit margins by discriminating users' communications," declares Félix Tréguer, in charge of policy and legal affairs at La Quadrature du Net. According to Neelie Kroes' report, “bad press” for operators and users “voting with their feet” by switching operators can solve any infringement of Net neutrality. But this simplistic spin does not stand the test of reality. In practice, millions of users can only chose one operator to connect to the Internet, either because of geographical or commercial constraints. “Mrs Kroes hides behind false free-market arguments to do nothing at all, pretending that competition and consumer law can successfully address the issue. In most Member States, mobile phone operators agree on engaging in the very same discriminations in their so-called 'mobile Internet' offers. These operators simply do not offer access to the universal platform of communications we call 'the Internet'. By turning a blind eye on these practices, the Commission covers anti-competitive behaviours that hinder innovation and violate users' freedom of communication,” concludes Jérémie Zimmermann, spokesperson for the citizen organization. Buongiorno a tutti, Premettendo che non sono un esperto di diritto costituzionale statunitense, tuttavia mi sembra che l’affermazione di Mr. Ron Kirk, secondo la quale “As noted above, ACTA does not constrain Congress’ authority to change U.S. law” sia un po’ azzardata e senza dubbio incompleta. Infatti, se non mi ricordo male secondo la clausola di superiorità della U.S. Constitution (art. VI) “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.” Ergo, un trattato (e.g. l’ACTA) é considerato come “supreme Law of the Land” nel momento in cui entra in vigore e, sempre a partire da questo momento, deroga la legge precedente (principio della lex posterior) e quella che riporti delle disposizioni meno dettagliate (principio della lex specialis). Essendo l’ACTA più recente e non perfettamente coerente con la U.S. Law (http://keionline.org/node/970) mi sembra spontaneo pensare che determini una modifica. IMHO, il nodo della questione sta nel fatto che, per essere considerato “supreme Law of the Land”, il trattato non dev’essere semplicemente firmato ma necessita la ratifica (i.e. deve ricevere il parere ed il consenso dei due terzi del Senato e la ratifica del Presidente). Chiaramente, il procedimento di ratifica puo’ essere lungo e farragionoso poiché bisogna cristallizzare il consenso di 2/3 del Senato e del Presidente attorno allo stesso trattato. Tuttavia, pur non essendo un esperto di lobbying, mi sento di poter sospettare che diversi portatori di interesse potrebbero “incoraggiare” una ratifica eccezionalmente rapida. Ecco una nuova conferma ufficiale (nel documento si cita anche il TPP, l'"ACTA on steroids"): US Congress is not bound by ACTA, according to White House answers to Senate Finance on ACTA and TPP negotiations [...] Question 7 If the Administration signs ACTA, doing so will not prevent the U.S. from changing its law, including in a number of specific areas like injunctive relief, damages for patent infringement, access to orphaned copyrighted works, and statutory damages, correct? Answer: The ACTA was drafted to reflect both the general principles and specific provisions of U.S. law in the areas the agreement covers. That said, the agreement does not constrain Congress’ authority to change U.S. law. Question 8 Does the Administration believe that the Congress and the courts are not bound by ACTA? The beginning of the end for three strikes? April 19th, 2011 It has been a bad week for the supporters of three strikes <http://en.wikipedia.org/wiki/Graduated_response> copyright policies in Europe. Although at some point last year the panorama looked good for them with the enactment of the Digital Economy Act, it seems like recent legal developments will make it considerably harder for a comprehensive disconnection programme to take off. Yesterday the Patents County Court in England and Wales delivered a damning ruling <http://www.guardian.co.uk/technology/2011/apr/19/acs-law-solicitor-fileshar…> against ACS:Law, those of Anonymous fame <http://www.technollama.co.uk/acslaw-when-bad-things-happen-to-bad-people>. Andrew Crossley, the principal actor in ACS:Law, had found a nice little business niche by becoming the representative of Media CAT Ltd, a UK firm claiming to represent various porn films. ACS:Law would try to find people who were downloading those films at any given time through torrent sites, and then would issue the alleged infringers with harassing letters asking them to settle out of court. In many cases, people would pay up to £700 GBP just to have the allegations go away, even if untrue. In the case of Media CAT Ltd v Adams & Ors <http://www.bailii.org/ew/cases/EWPCC/2011/10.html> [2011] EWPCC 10, Media CAT accused several people of infringing pornographic material. This probably would have been dismissed in a normal fashion at an early stage, but the added publicity from the Anonymous stunt last year meant that ACS:Law was under added scrutiny. Instead of dismissing the case in February 2011, Judge Birss QC continued proceedings, asking Media CAT to demonstrate that it was a copyright society and that it truly represented their copyright interest of the offended parties in the UK. In an earlier ruling <http://www.bailii.org/ew/cases/EWPCC/2011/6.html>, Judge Birss opined that Media CAT had no standing to bring the proceedings, and even considered issuing an order against Media CAT sending out more harassing letters, but instead asked them to attempt to join the copyright orders to continue proceedings. In other words, Judge Birss found out that the entire business model of ACS:Law rested on fictitious ground, and asked them to put up or face the consequences.
