Leggo al punto 13 della bozza del decreto sviluppo (http://download.repubblica.it/pdf/2011/dl_sviluppo_24102011.pdf?ref=HREA-1) : Dopo l��art. 6, comma 2 della legge 31 luglio 2005, n. 155 (decreto Pisanu, n.d.r.), �� aggiunto il seguente comma: "2bis. Anche in deroga a quanto previsto dal comma 2, gli utenti che attivano schede elettroniche (S.I.M.) abilitate al solo traffico telematico ovvero che utilizzano postazioni pubbliche non vigilate per comunicazioni telematiche o punti di accesso ad Internet utilizzando tecnologia senza fili possono essere identificati e registrati anche in via indiretta, attraverso sistemi di riconoscimento via SMS e carte di pagamento nominative. Con decreto del Ministro dell'interno di concerto con il Ministro dello Sviluppo Economico, sentito il Garante per la protezione dei dati personali, possono essere previste misure di maggior dettaglio e ulteriori procedure semplificate anche negli altri casi previsti dal comma 2.�� Motivazione: Con la recente abrogazione di alcune delle previsioni dell�� art. 7 del c.d. decreto Pisanu (D.L. 27 luglio 2005, n. 144, convertito nella legge n. 155/2005) sono venuti meno una serie di obblighi posti in capo ai gestori di punti di accesso internet e di hot spot wifi. Ci�� ha rappresentato senza dubbio una facilitazione per l��utilizzo di internet, a beneficio della collettivit��. D��altra parte, tale innovazione ha generato, da un lato, una rilevante asimmetria regolamentare a sfavore dei gestori che, utilizzando una diversa tecnologia (e segnatamente quella mobile) sono tutt��ora obbligati a identificare ed acquisire informazioni dell��utenza prima di attivare il servizio, a fronte di elevati oneri economici necessari per la registrazione e l��archiviazione di tali informazioni; dall��altro, tale asimmetria si riverbera anche in termini di sicurezza e prevenzione dei reati, poich�� chi oggi utilizza postazioni pubbliche non vigilate o punti di accesso ad Internet tramite wi �\fi potrebbe farlo senza essere identificato, e dunque in completo anonimato. Dopo le accuse di essere ladri ora anche quella di equiparazione ai BlackBloc... Mi è sembrato doveroso, per non scadere nel volgare, postare questo in replica: Il paragone del sig. Purgatori equivale a dire che chi evade le tasse segue la filosofia BlackBlok spaccando le vetrine dell'erario per impossessarsi dei soldi dello Stato e che ci sono tra costoro autori/artisti ed imprese anche dell'industria della cultura. Credo che prima o poi mi toccherà autodenuciarmi per aver scaricato un un MP3 in modo da poter poi querelare queste persone.
