Pluralism and Competition in the Regulation of New Media Organised by Florence School of Regulation (RSCAS) & Mediadem Project (Law Department) Florence, 10-12 November 2011 European University Institute Refettorio - Badia Fiesolana Via de’ Roccettini, 9 San Domenico di Fiesole The workshop on “Pluralism and competition in the regulation of new media” aims at exploring five key themes and their relationship: - the role of competition law in new media markets; - the concept of pluralism and its protection in the new media; - the changing business structures that are emerging as a result of digital convergence and the impact this has on competition and regulation; - the nature and role of private regulation as an alternative or a complement to public regulation in order to develop independent media; - the consistency of the regulatory framework and the governance of the sector with the new media market. Grazie Anna. Sembra infatti che "the security level of this trojan leaves the infected systems in is comparable to it setting all passwords to '1234''"….non male... Come avevo avuto modo di accennare durante l'ultima incontro di Nexa e' un tema che trovo estremamente delicato e sul quale è necessaria una riflessione. Non penso, infatti, che la realta' tedesca sia cosi' lontana da quella che avremo in Italia quando finalmente capiranno che il VoIP non e' solo un suono onomatopeico. Giuseppe Vaciago

togliere retroattivamente dal pubbico dominio

Cari tutti, qualche giorno fa alla Corte Suprema degli Stati Uniti e' stato discusso il caso Golan v. Holder (http://en.wikipedia.org/wiki/Golan_v._Holder) Audio dell'oral argument: http://www.supremecourt.gov/oral_arguments/argument_audio_detail.aspx?argum… Op-ed NY Times: http://www.nytimes.com/2011/10/05/opinion/keep-works-in-the-public-domain-p… E' un caso importante per il pubblico dominio negli USA. Il punto fondamentale e' la costituzionalità (o meno) di togliere opere dal pubblico dominio con leggi che retroattivamente ne modifichino lo status. A quanto pare, infatti, non era mai successo prima negli USA. Ora, in Europa e' successo piu' e piu' volte, l'ultima volta con la sciagurata Direttiva sull'estensione dei termini di protezione per fonogrammi, etc. Da non-giurista e' qualcosa che mi sembra profondamente ingiusto, un vero vulnus a diritti fondamentali. Mi chiedo e vi chiedo: non e' che abbiamo finora trascurato dei profili giuridici che forse ci potrebbero aiutare a contrastare questo tipo di "barbarie" legislativa anche in Europa? Care e cari, scrivo alla lista per porvi una domanda. Avete informazioni sul "Bundestrojaner"? Il trojan che il governo tedesco avrebbe utilizzato per scopi di sorveglianza. In rete ho trovato che questa applicazione sarebbe stata scoperta dal "Chos Computer Club" (CCC); che il Ministro degli Interne tedesco ne avrebbe confermato l'esistenza e che nelle intenzioni dovrebbe essere usato solo sotto determinate condizioni, non meglio indicate. Il "Chos Computer Club" avrebbe affermato che, fra l'altro,questo programma sarebbe anche mal progettato e poco sicuro, rendendo i computer infettati facili prede di utenti non autorizzati. Now social scientists are trying to mine the vast resources of the Internet — Web searches and Twitter messages, Facebook and blog posts, the digital location trails generated by billions of cellphones — to do the same thing. The most optimistic researchers believe that these storehouses of “big data” will for the first time reveal sociological laws of human behavior — enabling them to predict political crises, revolutions and other forms of social and economic instability, just as physicists and chemists can predict natural phenomena. “This is a significant step forward,” said Thomas Malone, the director of the Center for Collective Intelligence at the Massachusetts Institute of Technology. “We have vastly more detailed and richer kinds of data available as well as predictive algorithms to use, and that makes possible a kind of prediction that would have never been possible before.” The government is showing interest in the idea.
