Caro Bernardo-- tu parli di rischi reali, ma essendo io uno che non ama scontri ideologici ma solo risultati pratici, ti dico che WL e Assange hanno conseguito dei risultati importantissimi in termini di dibattito pubblico sull'operato dei governi e, come ho scritto, in termini di riflessioni sulla "debolezza" di una Internet sempre più identificata coi walled garden dei social media più noti. Io credo che il tema da discutere riguardi di pià gli effetti del ciclone wikileaks che la sua logica interna che non è ben conosciuta dai molti e che ci può far storcere il naso, ma che comunque, passa in secondo piano rispetto al dibattito innescato. IMHO

* 28° Mercoledì di NEXA* *"Culture di fan e industria dell'intrattenimento: dal fansubbing agli spreadable video" * *Mercoledì 9 febbraio 2011 ore 18 -- 20* (2° mercoledì del mese) Via Boggio 65/a, Torino (primo piano) Ingresso libero Live streaming: http://nexa.polito.it/events Nell'ultimo decennio Internet si è evoluta in una piattaforma multimediale di fruizione e condivisione di contenuti audiovisivi. L'evoluzione tecnologica ha portato alla definizione di nuove dinamiche di interazione tra i pubblici e l'industria dell'intrattenimento. Grazie alla rete, i fan si appropriano, ridistribuiscono e ricreano i contenuti prodotti professionalmente, dando vita a nuovi *spazi* di interazione online, nuovi *canali* di distribuzione dei contenuti audiovisivi, nuovi *generi* mediali ibridi e nuove pratiche di produzione amatoriale, come il /fansubbing/ e i /derivative video/. Il /fansubbing/ è un esempio di /peer production/ che, integrata al /file sharing/ di contenuti audiovisivi nelle reti p2p, si configura come una /use-centric innovation/ in quanto, abbattendo i tempi di distribuzione transnazionale dei contenuti audiovisivi, ha incentivato l'industria cine-televisiva ad adeguarsi alle esigenze spettatoriali dei nativi digitali. Nel contesto italiano la più grande community di /fansubbing/ è _ItaSA <http://www.italiansubs.net/>_: una *comunità di pratica* e di *apprendimento* (di lingue straniere, sviluppo software, grafica) composta da uno staff di 199 /fansubber/ volontari che cooperano per la produzione di sottotitoli di serie Tv americane. Da un lato dunque i fan stimolano l'innovazione delle industrie culturali, dall'altro queste ultime cooptano gli utenti della rete a fini promozionali incentivando il *grassroots marketing* mediato dai servizi Web 2.0. Le caratteristiche degli spazi digitali, ovvero la persistenza, la replicabilità, la scalabilità e la ricercabilità, consentono infatti la diffusione *virale* dei contenuti digitali. Tuttavia i fan non si limitano a condividere, ma rielaborano i contenuti in funzione dei propri bisogni espressivi e sociali. Le dinamiche di *spreadability* sono stimolate dalle case di produzione cine-televisive e dalle etichette discografiche attraverso la produzione di contenuti promozionali facilmente appropriabili dai fan. Gli utenti della rete, condividendo *video derivati* nei siti di social network e di /content sharing/ come YouTube, contribuiscono così alla promozione del contenuto (o brand) mediale, e, al contempo, danno vita a nuove forme di comunicazione multimediale. Di questi temi discuterà *Agnese Vellar*, ricercatrice di social media presso l'Università di Torino, confrontandosi con i ricercatori e i fellows del Centro NEXA e con tutti coloro i quali vorranno intervenire nel dibattito. *Biografia*: *Agnese Vellar*, dottore di ricerca in Scienze della Comunicazione, è attualmente assegnista presso il Dipartimento di Scienze Sociali dell'Università di Torino. Si occupa del ruolo dei media di massa e dei social media nella costruzione delle identità individuali e collettive. In particolare è interessata allo studio delle culture partecipative da un punto di vista transnazionale e ai processi di cooperazione mediati dalla rete. Ha collaborato con il /Technology, Research and Trends Department /di Telecom Italia conducendo ricerche qualitative sui pubblici televisivi nel Web 2.0 e progettando interfacce per la Tv interattiva. This became clear at the Ad hoc meeting ? Anti-Counterfeiting Trade Agreement (ACTA), a DG Trade meeting to inform and consult civil society about ACTA. Mr Pedro Velasco Martins, Deputy Head of Unit, Public Procurement and Intellectual Property Directorate-General for Trade, represented the Commission. Mr Velasco Martins stated that ACTA will not change the current EU legislation, EU law provides higher enforcement levels than ACTA. The current EU legislation, the acquis, is scrupulously respected. He regarded fundamental rights as a non issue. The Signatories of the Opinion of European Academics on the Anti-Counterfeiting Trade Agreement disagree: ?Contrary to the European Commission?s repeated statements and the European Parliament?s resolution of 24 November 2010, certain ACTA provisions are not entirely compatible with EU law and will directly or indirectly require additional action on the EU level.? Confronted with the Opinion, Mr Velasco Martins said they will study it later. At first sight, it didn?t look convincing to him. He ridiculed the issues raised in the document with remarks like: Certainly, the professors should know better. The game the Commission plays became clear when Mr Velasco Martins said: ?ACTA may be approved even if it goes beyond the acquis.? The Commission will just deny ACTA goes beyond the acquis, the current legislation, and hopes to get it adopted. And then, ACTA will bind the EU. The Commission is very happy with the criminal measures. Note that, according to our analysis, ACTA?s criminal measures criminalise ordinary companies and individuals. The EU can only harmonise criminal measures if approximation of criminal laws and regulations of its Member States proves essential to ensure the effective implementation of a Union policy. The same is true for harmonisation by way of trade agreement. Vrijschrift asked for proof the criminal measures are essential. Mr Velasco Martins seemed not to understand it makes a difference whether ACTA?s criminal measures bind the member states or the member states and the EU. This made his earlier statement that ACTA will not bind the EU less convincing. He didn?t know the construction used for the TRIPS agreement (criminal measures only signed by the member states), nor the European Court ruling regarding TRIPS. David Hammerstein mentioned that the US does not regard ACTA as a treaty, that ACTA will bind the EU, not the US. Mr Velasco Martins said that under the Geneva Convention (that is what I wrote down) ACTA is a treaty and the US is bound by it. He probably meant the Vienna Convention (and possibly also said that). Note that the US did not ratify the Vienna Convention on the law of Treaties. Hammerstein?s remarks still stand. Mr Velasco Martins did not agree that it is a strategical mistake to accept more obligations than other parties. ACTA was negotiated as a mixed agreement. Now the negotiations are concluded, the competence will be settled soon. It may have to be ratified as a mixed agreement, meaning the member states have to ratify as well, giving the national parliament power over ACTA. Mr Velasco Martins also said China could have entered the negotiations at the preparatory stage.
