Rispetto della dignità umana Tutti gli esseri umani nascono liberi e uguali in dignità e diritti. La loro dignità e i loro diritti devono essere rispettati e protetti su Internet. 2) Universalità e non discriminazione nel godimento di tutti i diritti a. Principio di universalità e di non discriminazione Tutti i diritti e le libertà enunciati in questa Carta sono universali. Pertanto, ognuno ha il godimento di tutti i diritti e le libertà enunciati nella presente Carta, senza distinzione di alcun tipo, quali etnia, colore, sesso, lingua, religione, opinione politica o di altro genere, nazionalità od origine sociale, proprietà, nascita o altro stato o condizione. b. accesso a Internet per tutti Ogni individuo ha uguale diritto all'accesso a Internet. Se del caso, ciò include il diritto di accesso a banda larga. Poiché Internet è diventato uno strumento indispensabile per molte funzioni correlate alla vita ed è necessario per la fruizione di altri diritti altri come quello all'istruzione, tutti devono avere accesso a Internet a condizioni abbordabili. La libertà di accesso include la libertà di scelta del sistema e l'utilizzo del software. Per facilitarla questo e per mantenere l'interconnettività e l'innovazione, le infrastrutture di comunicazione e i protocolli dovrebbero essere interoperabili. L'accesso a Internet può essere limitato solo per ragioni necessarie, chiaramente motivate e basate sul diritto, come la lotta agli abusi sui minori. Qualsiasi restrizione deve essere strettamente proporzionale alla minaccia specifica e non deve minare il carattere aperto di Internet o la sua capacità di sostenere i diritti umani. c. Garantire l'inclusione digitale Una società e un'economia basate su Internet richiedono che tutti abbiano pari opportunità di partecipazione attiva ed efficace su e attraverso Internet. A tal fine un supporto attivo dovrebbe essere disponibile per gli impianti autogestiti e altri servizi su base comunitaria per garantire l'inclusione digitale universale. L'inclusione digitale presuppone la possibilità di accesso e l'uso effettivo della gamma di media digitali, piattaforme di comunicazione e dispositivi per la gestione e l'elaborazione delle informazioni. Tutti, in particolare i governi e le imprese, dovrebbero intraprendere passi individualmente e attraverso l'assistenza e la cooperazione internazionali verso l'inclusione digitale, cioè la parità di accesso alle tecnologie dell'informazione ed eliminando qualsiasi discriminazione nell'accesso a Internet. Per contribuire a questo fine, i punti di accesso pubblico a Internet devono essere resi disponibili, ad esempio in telecentri, biblioteche, centri comunitari, cliniche e scuole, così come il supporto all'accesso tramite media mobili in modo che tutti possano avere l'accesso dove vivono o lavorano. d. Parità di genere Donne e uomini hanno pari diritto di accesso per imparare, definire, accedere usare e organizzare Internet. Gli sforzi per incrementare l'accesso devono riconoscere e correggere le disparità di genere esistenti. Ci deve essere la piena partecipazione delle donne in tutti i settori legati allo sviluppo di Internet per garantire la parità di genere. e. Gruppi di persone emarginate e con esigenze diverse Interfaccia, contenuti e applicazioni devono essere progettati per garantire l'accessibilità ai gruppi emarginati, alle persone con disabilità e alle persone diversamente capaci di leggere e scrivere. Il principio della progettazione inclusiva e l'uso di tecnologie di supporto devono essere promossi e sostenuti per consentire ai disabili di beneficiare pienamente e su una base di uguaglianza con gli altri. Le persone di ogni età, compresi i giovani e gli anziani, hanno il diritto ad avere attenzione alle loro esigenze specifiche nell'uso di Internet come parte del loro diritto alla dignità, alla partecipazione alla vita sociale e culturale e al godimento degli diritti umani. 3) Libertà e Sicurezza a. Tutela della libertà e della sicurezza Ogni individuo ha diritto alla protezione della propria libertà e sicurezza online. Questo include la protezione contro tutte le forme di molestie online, traffici, cyber-stalking e l'uso improprio della propria identità e dei propri dati digitali. b. Funzionalità e sicurezza di Internet Ogni individuo ha il diritto a connessioni funzionali e sicure per e su Internet. c. Le misure di sicurezza devono rispettare i diritti umani Tutte le misure di sicurezza che riguardano Internet deve essere conformi alle leggi e agli standard internazionali sui diritti umani nonché allo stato di diritto. Dovrebbero essere necessarie e proporzionate allo scopo. 4) Uguaglianza e diversità su Internet a. Uguaglianza di fronte alla legge Tutte le persone sono uguali davanti alla legge e hanno diritto, senza alcuna discriminazione, a un'eguale tutela da parte della legge per quanto riguarda Internet. (Questo vale sia online come offline.) Questo tuttavia non preclude protezioni legali speciali o misure di protezione per persone e gruppi che possono essere strutturalmente discriminati e necessitano misure tali da garantire loro la sostanziale parità con gli altri. b. Neutralità ed equità della rete Internet e i mezzi fisici della navigazione devono essere disponibili a tutti in termini uniformi e non discriminatori. I contenuti di Internet non dovrebbero essere resi prioritari o discriminati per ragioni economiche, sociali, culturali, religiose o politiche. Il controllo dei contenuti su Internet non deve incidere sul diritto di tutte le persone a esprimersi e sull'accesso alle informazioni online. c. Diversità di culture e linguaggi Il valore del servizio pubblico di Internet deve essere protetto, compreso l'accesso alle informazioni di qualità e alternative così come ai diversi contesti culturali. Internet dovrebbe rappresentare la diversità di culture e linguaggi in termini di aspetto e funzionalità. La diversità culturale e linguistica su Internet dovrebbe essere incoraggiata in forma di testo, immagine e suono. L'evoluzione tecnologica e l'innovazione per promuovere la diversità su Internet dovrebbero essere incoraggiate. d. Diritto di utilizzare la propria lingua Tutti gli individui e le comunità hanno il diritto di usare la propria lingua per creare, diffondere e condividere informazioni e conoscenze attraverso Internet. Particolare attenzione dovrebbe essere data alle lingue minoritarie. 5) Diritto allo Sviluppo a. Godimento di tutti i diritti su Internet Il diritto allo sviluppo include il pieno godimento di tutti i diritti relativi a Internet e di cui alla presente Carta. Istituzioni di donatori e imprese hanno un obbligo particolare di promuovere questo diritto al meglio delle loro possibilità- massima. b. Sostenibilità Ambientale Ognuno ha la responsabilità di utilizzare Internet in modo ecologicamente sostenibile. Questo riguarda anche lo smaltimento dei rifiuti elettronici, come l'uso di Internet per la protezione dell'ambiente. c. Riduzione della povertà e sviluppo umano Le tecnologie dell'informazione e della comunicazione svolgono un ruolo vitale nel contribuire a realizzare gli obiettivi del millennio delle Nazioni Unite, eliminare la povertà, la fame e le malattie e promuovere la parità di genere e l'autorealizzazione delle donne, in particolare nel mondo in via di sviluppo. Tutte le parti interessate dovrebbero considerare come possono sviluppare e implementare una tecnologia che contribuisca alla lotta alla povertà, alla diffusione dell'istruzione, dello sviluppo umano sostenibile e dell'affermazione di sè. 6) Libertà di opinione e di espressione a. Libertà di opinione su Internet Ogni individuo ha il diritto di esprimere le proprie opinioni su Internet senza interferenze. b. Libertà di espressione online Ogni individuo ha diritto alla libertà di espressione su Internet, che include la libertà di cercare, ricevere e diffondere informazioni e idee di ogni genere, senza riguardo a frontiere attraverso ogni mezzo di sua scelta. La libertà di espressione è un presupposto indispensabile per la realizzazione di altri diritti, libertà e dei beni sociali, compresa la democrazia, l'istruzione e lo sviluppo umano. E' quindi strettamente legata alla necessità di contenuti pluralistici e diversi, e al diritto senza esclusioni di tutte le persone a fare sentire la loro voce nel pubblico dominio. c. Libertà di protesta online Le organizzazioni, le comunità e gli individui hanno diritto di usare Internet per organizzare e svolgere proteste online e offline. d. Regole per le restrizioni Le restrizioni sui contenuti per censura o filtraggio devono essere basate sul diritto e coerenti con le leggi e gli standard internazionali sui diritti umani, nonché lo stato di diritto. Dovrebbero essere necessari e proporzionati allo scopo in questione. e. Libertà dalla censura Internet dovrebbe essere esente da censura e di filtraggio. Fornitori di servizi Internet, motori di ricerca e altri intermediari che sono costretti dai governi ad attuare la censura o il filtraggio dovrebbero informare esaustivamente gli utenti dei criteri di censura in uso e specificare le disposizioni legislative e regolamentari che li richiedano. I criteri per qualsiasi filtro o censura possono essere considerati legittimi se consentiti dalla legge nazionale e dai diritti umani, sviluppati in modo pubblicamente responsabile e trasparente, e verificabili pubblicamente e in modo credibile. Dev'essere previsto un meccanismo di ricorso chiaro, efficiente e semplice da usare in modo che gli utenti possano rivolgersi al fornitore del servizio e al governo se ritengono che il contenuto sia illegale o censurato per errore. f. Diritto all'informazione Ognuno ha il diritto di ricevere e diffondere informazioni e idee attraverso Internet. Tutti hanno diritto di accesso alle informazioni del governo, secondo il diritto internazionale o le leggi approvate democraticamente a livello nazionale. 7) Libertà religiosa e di culto a. Diritto di esprimere e praticare la religione e la fede Ogni individuo ha il diritto di esprimere e praticare la propria fede su Internet. Ciò include lo scambio di informazioni, la comunicazione, l'espressione di opinioni e la formazione di comunità o associazioni religiose. I soggetti pubblici o privati non devono reprimere o perseguitare le persone per la loro religione o convinzioni espresse su internet. b. Limitazioni dei discorsi razzisti libertà dalle parole di odio Le credenze e le opinioni degli altri vanno rispettate. Qualsiasi appello all'odio nazionale, razziale o religioso su Internet che costituisca incitamento alla discriminazione, all'ostilità o alla violenza deve essere vietato dalla legge. 8)Libertà di riunione e associazione a.Partecipazione ad assemblee e associazioni su Internet Agli utenti di strumenti ICT, servizi e piattaforme deve essere consentito formare, partecipare, incontrare o visitare assemblee, gruppi o associazioni per qualsiasi motivo, anche politico e sociale. L'accesso alle assemblee e alle associazioni usando gli ITC non deve essere bloccato o filtrato. b. Libertà di creare comunità online e libertà di protesta online Ognuno è libero di creare o unirsi a comunità online. 9) Diritto alla Privacy a. Diritto alla privacy su Internet Nessun individuo potrà essere sottoposto a interferenze arbitrarie o illegali nella vita privata, nella famiglia, in casa o nella sua corrispondenza su Internet. Ogni individuo ha diritto a essere tutelato dalla legge contro tali interferenze e attacchi. La legislazione nazionale in materia di privacy deve essere basata su una legge quadro internazionale che soddisfi la regola del diritto, il rispetto dei diritti umani fondamentali e il sostegno alle istituzioni democratiche. L'informativa sulla privacy e le impostazioni di tutti i servizi dovrebbero essere facili da trovare e la gestione delle impostazioni per la privacy dovrebbe essere completa e tarata per la migliore usabilità. Il diritto alla riservatezza deve essere protetto da norme di riservatezza e l'integrità dei sistemi IT garantendo protezione nei confronti dell'accesso senza consenso di altri sistemi IT. b. Protezione dell' identità digitale Ogni individuo ha diritto a una identità digitale. L'identità digitale della persona umana, vale a dire l'identificazione personale nei sistemi informativi è inviolabile. Le firme digitali, nomi utente, password, codici PIN e TAN non devono essere utilizzati o modificati da altri senza il consenso del proprietario. c. Personalità virtuale e autodeterminazione dell'informazione La personalità virtuale della persona umana deve essere rispettata. Tuttavia, il diritto a una personalità virtuale non deve essere abusato a danno di altri. Ognuno ha il diritto di determinare la circolazione e l'uso dei propri dati personali. Tale diritto può essere limitato solo nel caso di un prevalente interesse pubblico. d. Libertà dalla diffamazione Nessuno e nessuna comunità devono essere sottoposti ad attacchi illegali al proprio / proprio onore e reputazione su Internet. Ogni individuo ha diritto a essere tutelato dalla legge contro tali interferenze o attacchi. e. Diritto di anonimato e di utilizzare la crittografia Ogni individuo ha il diritto di comunicare anonimamente su Internet e di utilizzare la tecnologia di crittografia. per garantire una comunicazione sicura, privata e anonima. f. Libertà dalla sorveglianza Ognuno deve essere libero di comunicare senza sorveglianza arbitraria o intercettazioni, o sotto la minaccia di sorveglianza o di intercettazione. Ciò include l'uso di tecnologie quali l'ispezione approfondita dei pacchetti, il monitoraggio del comportamento e l'esercizio del controllo sugli individui, ad esempio attraverso il cyber-stalking. Ogni accordo in materia di accesso ai servizi online che include l'accettazione di tale sorveglianza deve indicare chiaramente la natura della sorveglianza. 10) Diritto alla protezione dei dati a. Protezione dei dati personali I dati personali devono essere protetti. Corrette politiche di informazione dovrebbero essere previste dalla legge nazionale per vincolare le imprese e i governi che raccolgono e trattano dati personali e garantire i diritti degli individui i cui dati personali vengono raccolti. b. Obblighi di chi raccoglie i dati La raccolta, l'utilizzo, la divulgazione e la conservazione dei dati personali devono essere conformi a una politica trasparente di privacy. Chiunque richieda dati personali dovrebbe chiedere ai soggetti interessati un consenso informato per quanto riguarda contenuti, scopi, luogo di archiviazione, durata e meccanismi per l'accesso, recupero e rettifica dei propri dati personali. Tutti devono poter essere liberi e in grado di esercitare un controllo sui dati personali raccolti su di loro e sul loro utilizzo. Ogni individuo ha il diritto di accedere, recuperare e cancellare i dati personali raccolti su di lui. c. Standard minimi per l'uso di dati personali Le organizzazioni pubbliche o private che richiedono informazioni personali devono raccogliere solo i dati minimi necessari e per il minimo periodo di tempo necessario. I dati devono essere cancellati quando non sono più necessari per gli scopi per cui sono stati raccolti. I collettori di dati hanno l'obbligo di ottenere il consenso attivo e di comunicare agli interessati quando le loro informazioni sono state trasmessi a terzi, usati in modo improprio, persi o rubati. Sicurezza dei dati Adeguate misure di sicurezza devono essere adottate per la protezione dei dati personali conservati in archivi automatizzati di dati contro la distruzione accidentale o non autorizzata o la perdita accidentale, nonché contro l'accesso non autorizzato, l'alterazione o la diffusione. d. Controllo da parte di autorità indipendenti preposte alla protezione dei dati La protezione dei dati dovrebbe essere controllata da autorità indipendenti per la protezione dei dati, che operano in modo trasparente e senza vantaggio commerciale o influenza politica. 11) Diritto allo studio a. Diritto allo studio su e attraverso Internet Ogni individuo ha il diritto di essere educato su Internet e di usare Internet per l'istruzione. Ogni individuo ha il diritto di utilizzare Internet per accedere alle conoscenze, all'informazione e alla ricerca. I fornitori di strumenti, servizi e contenuti su Internet non dovrebbero vietare persone di utilizzare Internet per l'apprendimento condiviso e la creazione di contenuti. Gli ambienti virtuali di apprendimento e altri tipi di multimedia, le piattaforme per l'apprendimento e l'insegnamento dovrebbero tener conto delle variazioni locali e regionali, in termini di pedagogia e conoscenza delle tradizioni. Pubblicazioni, ricerche, libri di testo, materiale didattico e altri tipi di materiali per l'apprendimento dovrebbero essere pubblicati preferibilmente come risorse educative aperte (Open Educational Resources) con il diritto di utilizzarle liberamente, copiarle, riutilizzarle, adattarle, tradurle e ridistribuirle. Gli editori e gli autori non dovrebbero stipulare obblighi contrattuali che impediscono la pubblicazione di lavori scientifici e di altro tipo su Internet. b. Formazione su Internet e diritti umani L'istruzione su Internet dovrebbe includere azioni di sensibilizzazione e rispetto dei diritti umani (online e offline). c. Istruzione e formazione per l'alfabetizzazione digitale L'alfabetizzazione digitale dovrebbe essere un elemento chiave della formazione. Conoscenze e competenze permettono alle persone di usare e sfruttare Internet per soddisfare le loro esigenze. I governi locali e nazionali, gli enti internazionali e le organizzazioni comunitaria e il settore privato dovrebbero sostenere e promuovere gratis o a basso costo possibilità di formazione, metodologie e relativi materiali per l'uso di Internet per lo sviluppo sociale. 12) Accesso all'apprendimento e diritti di proprietà intellettuale a. Diritto di partecipare alla vita culturale della Comunità Ogni individuo ha il diritto di utilizzare Internet per partecipare liberamente alla vita culturale della comunità, di godere delle arti e di condividere i suoi progressi scientifici e vantaggi. Questo include il diritto di accesso all'apprendimento e alle informazioni su Internet, indipendentemente dalle frontiere. Nessuna restrizione deve essere posta sulla espressione culturale e sulle attività online. Tutti dovrebbero poter creare e accedere alle informazioni nella loro madrelingua. b. Libertà dalle restrizioni dell'accesso all'apprendimento a causa di licenze e diritti d'autore Ogni individuo ha diritto alla protezione degli interessi morali e materiali derivanti da ogni produzione scientifica, letteraria e artistica su Internet, di cui sia autore. Gli autori dovrebbe essere retribuiti e veder riconosciuto il loro lavoro in modo che non ne limitino l'innovazione o l'accesso al pubblico, la conoscenza e le risorse educative. In ogni caso le licenze e i diritti d'autore dei contenuti dovrebbero consentire alla conoscenza di essere creata, condivisa, utilizzata e sviluppata. gli autori e gli utenti dovrebbero utilizzare modelli di licenza come Creative Commons. Le eccezioni all'"uso corretto" accettate a livello internazionale e le limitazioni al diritto d'autore dovrebbero essere sempre utilizzate, incluse le copie per uso personale e scolastico, la conversione di formato, il prestito bibliotecario, le recensioni, le critiche, la satira, la ricerca e la statistica. Le tecniche del Digital Rights Management (DRM) non devono impedire le eccezioni all' "uso corretto". c. Conoscenza comune e pubblico dominio La ricerca finanziata con fondi pubblici e il lavoro intellettuale e culturale dovrebbero essere resi disponibili liberamente al pubblico. d. Software gratuito / Open Source e Open Standard Gli standard aperti e i formati aperti dovrebbero essere disponibili ovunque sia possibile. Il software gratuito e Open Source (FOSS) dovrebbe essere usato, promosso e realizzato nelle istituzioni pubbliche ed educative e nei servizi. Quando non esiste una soluzione gratuita o open standard, il governo o la corrispondente istituzione pubblica devono favorire lo sviluppo del software necessario. 13) Diritti dei minori e protezione dell'infanzia a. Diritto di beneficiare di Internet I minori dovrebbero poter beneficiare di Internet in base alla loro età. I minori dovrebbero avere la possibilità di utilizzare Internet per esercitare i loro diritti civili, politici, economici, culturali e sociali. Questi comprendono i diritti alla salute, all'istruzione, alla privacy, l'accesso alle informazioni, la libertà di espressione e libertà di associazione. I minori che sono in grado di formarsi le loro opinioni hanno il diritto di esprimersi su tutte le questioni di organizzazione di Internet che li riguardano, e al loro parere dovrebbe essere dato il dovuto peso in base alla loro età e maturità. b. Libertà dallo sfruttamento e dall'abuso delle immagini di minori I minori hanno il diritto di crescere e svilupparsi in un ambiente sicuro, libero dallo sfruttamento sessuale o di altro tipo. Occorre adottare misure per impedire l'uso di Internet per violare i diritti dei minori, anche attraverso il traffico e l'abuso di immagini di minori. In ogni caso tali misure dovrebbero salvaguardare i diritti dei bambini e non limitare eccessivamente o inutilmente o mettere in pericolo il libero flusso di informazioni online. c. Miglior interesse del minore In tutte le questioni che riguardano i minori e Internet, il miglior interesse del minore dev'essere la considerazione primaria. 14) Diritto al lavoro a. Il rispetto dei diritti dei lavoratori I diritti dei lavoratori devono essere rispettati nella società dell'informazione. Un presupposto necessario per la realizzazione di tali diritti per i lavoratori dipendenti è il diritto di utilizzare Internet per formare sindacati, compreso il diritto di promuovere i propri interessi e unirsi in organi di rappresentanza.liberamente eletti b. Internet sul luogo di lavoro I lavoratori e i dipendenti dovrebbero avere accesso a Internet sul luogo di lavoro, se possibile Qualsiasi restrizione nell'uso di Internet sul posto di lavoro dovrebbe essere esplicitamente indicata nelle politiche di organizzazione del personale. I termini e le condizioni per la sorveglianza del collegamento a Internet dei dipendenti devono essere chiaramente indicate nelle norme che regolano il lavoro e includono il rispetto del diritto alla protezione dei dati. 15) La partecipazione agli affari pubblici e la governance di Internet a. Diritto di partecipare al governo elettronico Ogni individuo ha diritto di partecipare al governo elettronico se disponibile. b. Diritto alla parità di accesso ai servizi elettronici Ogni individuo ha diritto alla parità di accesso ai servizi elettronici nel suo Paese. c. Democrazia digitale La democrazia digitale e il voto online dovrebbero essere promossi ogni volta che esprimono il potenziale di consentire una democrazia più partecipativa, dove le decisioni politiche vengono discusse e prese da un numero più ampio di persone, a patto che possa essere garantita la sicurezza. d. Diritto di partecipare alla governance di Internet Ogni individuo ha diritto di partecipare alla governance di Internet. e. Principi di trasparenza, informazione e partecipazione Tutti gli operatori devono seguire i principi di trasparenza, informazione e partecipazione nelle procedure riguardanti la governance di Internet. 16) Protezione dei consumatori Tutti, in particolare le imprese e i governi, dovrebbero rispettare, proteggere e adempiere ai principi di tutela dei consumatori su Internet. Il commercio elettronico dovrebbe essere disciplinato dai governi in modo da garantire ai consumatori lo stesso livello di protezione di cui godono in transazioni non elettroniche. 17) Diritto alla Salute e Servizi Sociali Online Ogni individuo ha il diritto di accedere ai servizi sanitari e sociali nonché alla documentazione sanitaria elettronica su Internet. 18) Diritto al ricorso giurisdizionale e al processo equo a. Diritto al ricorso Ogni individuo ha diritto ad un ricorso giurisdizionale contro le accuse mossegli da un'autorità pubblica o da un privato per quanto riguarda materie connesse a Internet. b. Diritto a un processo equo Nella determinazione di ogni accusa penale o diritti civili o obblighi che riguardano Internet, ognuno ha diritto a un processo equo e pubblico, entro un termine ragionevole, di fronte a un tribunale indipendente e imparziale istituito dalla legge. c. Presunzione di innocenza Ogni individuo accusato di un reato penale o di diritto civile riguardante Internet è presunto innocente fino a prova contraria a norma di legge. d. Diritto al giusto processo Ogni individuo ha diritto al giusto processo da parte delle autorità pubbliche o private che si occupano di ricorsi giudiziari o di possibili violazioni della normativa in materia di Internet. Tutte le azioni intraprese contro le attività illecite su Internet devono essere rivolte a quanti sono direttamente responsabili di tali attività. e. Nessuna pena senza una legge Nessuno può essere condannato per qualsiasi reato su Internet a causa di qualsiasi atto o omissione che non costituisse reato secondo il diritto nazionale o internazionale nel momento in cui è stato commesso. Non potrà del pari essere inflitta pena superiore a quella applicabile al momento della commissione del reato. f. Diritto a non essere giudicato o punito due volte Nessuno può essere giudicato o condannato per un reato di Internet per il quale è già stato assolto o condannato. 19) Un ordine sociale e internazionale adeguato per Internet a. Il diritto ad un ordine sociale e internazionale Ogni individuo ha diritto ad un ordine sociale e internazionale di Internet nel quale i diritti e le libertà enunciati in questa Dichiarazione possano essere pienamente realizzati. b. Multilinguismo e pluralismo su Internet Internet inteso come ordine sociale e internazionale dovrebbe sancire i principi del multilinguismo, del pluralismo e forme eterogenee di vita culturale tanto nella forma come nella sostanza. c. Governance di Internet per i diritti umani Internet e il sistema di comunicazione dovrebbero essere disciplinati in modo da garantire la tutela e lo sviluppo dei diritti umani nella massima misura possibile. d. Partecipazione effettiva alla governance di Internet Gli interessi di tutte le persone danneggiate da una politica o da una decisione dovrebbero essere rappresentati nel processi di governance, che dovrebbero consentire a tutti di partecipare al suo sviluppo. Il rispetto per i diritti degli altri Tutti coloro che usano Internet hanno doveri e responsabilità oltre che diritti. Principle of Universality and Non-Discrimination All rights and freedoms contained in this Charter are universal. Accordingly, everyone is entitled to all the rights and freedoms set forth in this Charter, without distinction of any kind, such as ethnicity, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status or condition. b. Access to the Internet for All Everyone has the equal right to access to the Internet. Where appropriate, this includes the right to broadband access. As the Internet has become an indispensable tool for many life-related functions and is necessary for the enjoyment of other rights like the right to education, all people must have access to the Internet at affordable conditions. Ensuring Digital Inclusion An Internet based society and economy requires that all have an equal opportunity for active and effective participation in and through the Internet. To this end active support should be available for self-managed and other community-based facilities and services to ensure universal digital inclusion. Digital inclusion requires the opportunity for access to, and effective use of the range of digital media, communication platforms and devices for information management and processing. Everyone, in particular governments and business, should undertake steps individually and through international assistance and cooperation towards digital inclusion, i.e. equal access to information technology and eliminating any discrimination in access to the Internet. To contribute towards this end, public Internet access points must be made available, such as at telecentres, libraries, community centers, clinics and schools as well as support to access via mobile media so that all people can have access where they live or work. d. Efforts to increase access must recognise and redress existing gender inequalities. Protection of Liberty and Security Everyone has the right to the protection of their liberty and security online. This includes protection against all forms of online harassment, trafficking, cyber-stalking and misuse of one's digital identity and data. b. Functionality and security of the Internet Everyone has the right to enjoy functional and secure connections to and on the Internet. c. Security Measures shall respect Human Rights Any security measures which affect the Internet shall be consistent with international human rightslaws and standards as well as the rule of law. They should be necessary for, and proportionate to, the relevant purpose. 4) Equality and Diversity on the Internet a. Equality before the Law All people are equal before the law and are entitled without any discrimination to equal protection of the law in matters regarding the Internet. (This applies online as well as offline.) This however does not preempt any special legal protections or measures at protective discrimination for people and groups who may be structurally discriminated and require such measures to ensure their substantive equality with others. b. Net Neutrality and Net Equality The Internet and physical means of traffic on it shall be available to all on uniform, non-discriminatory terms. Internet content should not be prioritised or discriminated against for economic, social, cultural, religious or political reasons. Control of Internet content must not affect the equal right of all people to express themselves and access information online. c. Diversity of Cultures and Languages The public service value of the Internet should be protected, including access to quality and diverse information as well as different cultural content. The Internet should represent a diversity of cultures and languages in terms of appearance and functionality. Cultural and linguistic diversity on the Internet should be encouraged in form of text, as image and sound. Technological evolution and innovation to promote diversity on the Internet should be encouraged. d. Right to use one's own Language All individuals and communities have the right to use their own language to create, disseminate, and share information and knowledge through the Internet. Special attention should be given to minority languages. 5) Right to Development a. Enjoyment of all Rights on the Internet The right to development includes the full enjoyment of all rights related to the Internet and set out in this Charter. Donor institutions and businesses have a particular obligation to promote this right to their maximum capacity. b. Environmental Sustainability Everyone has a responsibility to use the Internet in a sustainable and ecologically viable way. This relates also to the disposal of e-waste as to the use of the Internet for the protection of the environment. c. Poverty Reduction and Human Development Information and communication technologies have a vital role to play in helping to achieve the U.N. millennium goals of eradicating poverty, hunger, and diseases and promoting gender equality and empowerment of women, particularly in the developing world. All stakeholders should consider how they can develop and implement technology that contributes to the eradication of poverty, to enabling education and to sustainable human development and empowerment. 6) Freedom of Opinion and Expression a. Freedom of Opinion on the Internet Everyone has the right to express one's opinions on the Internet without interference. b. Freedom of Expression Online Everyone has the right to freedom of expression on the Internet, which includes the freedom to seek, receive and impart information and ideas of all kinds, and regardless of frontiers through any media of his or her choice Freedom of expression is an essential pre-condition for the realisation of other rights, freedoms and social goods, including democracy, education and human development. It is therefore closely linked to the need for plural and diverse content, and the equal entitlement of all people to make their voices heard in the public domain. c. Freedom of Online Protest Organisations, communities and individuals have the right to use the Internet to organize and engage in online and offline protest. d. Standards for Restrictions Restrictions on content by censorship or filtering must be based on law and be consistent with international human rights laws and standards as well as the rule of law. They should be necessary for and proportionate to the relevant purpose. e. Freedom from Censorship The Internet should be free from censorship and filtering. Internet service providers, search engines and other intermediaries that are forced by governments to implement censorship or filtering should fully inform users of the censorship criteria being used, and specify the relevant laws and regulations requiring it. Criteria for any filtering or censorship can only be considered legitimate if it is permissible under national and human rights law, developed in a publicly accountable and transparent manner, and is publicly auditable and accountable. A clear, efficient and user-friendly appeals mechanism must be provided so that users can appeal to the service provider and the government if they feel that content is illegally or accidentally restricted. f. Right to Information Everyone has the right to receive and impart information and ideas through the Internet. Everybody has the right of access to government information, according to international law or laws passed democratically at the national level. 7) Freedom of Religion and Belief a. Right to Express and Practice Religion and Belief Everyone has the right to express and practice their faith on the Internet. This includes exchange of information, communication, expression of opinions and formation of religious communities or associations. Public or private actors must not repress or persecute people for their religion or beliefs expressed on the Internet. b. Limitations on Racist Speech and freedom from hate speech The beliefs and opinions of others should be respected. Any advocacy of national, racial or religious hatred on the Internet that constitutes incitement to discrimination, hostility or violence should be prohibited by law. 8) Freedom of Assembly and Association a. Participation in Assembly and Association on the Internet The users of ICT tools, services and platforms must be allowed to form, join, meet or visit an assembly, group or association for any reason, including political and social. Access to assemblies and associations using ICTs must not be blocked or filtered. b. Freedom to set up Online Communities and freedom of online protest Everyone has the freedom to establish or join online communities. 9) Right to Privacy a. Right to Privacy on the Internet No one shall be subjected to arbitrary or unlawful interference with their privacy, family, home or correspondence on the Internet. Everyone has the right to the protection of the law against such interference or attacks. National legislation on privacy should be based upon international privacy frameworks that comply with the rule of law, respect fundamental human rights, and support democratic institutions. Privacy policy and settings of all services should be easy to find, and the management of privacy settings should be comprehensive and optimised for usability. The right to privacy must be protected by standards of confidentiality and integrity of IT-Systems, providing protection against others accessing IT-Systems without consent. b. Protection of Digital Identity Everyone has a right to a digital identity. The digital identity of the human person, i.e. the personal identification in information systems is inviolable. Digital signatures, user names, passwords, PIN and TAN codes must not be used or changed by others without the consent of the owner. c. Virtual Personality and Informational Self-Determination The virtual personality of human persons needs to be respected. However, the right to a virtual personality must not be misused to the detriment of others. Everybody has the right to determine the circulation and the use of his own personal data. This right might be restricted only in the case of prevalent public interest. d. Freedom from Defamation No one and no community shall be subjected to unlawful attacks on their/its honour and reputation on the Internet. Everyone has the right to the protection of the law against such interference or attacks. e. Right to Anonymity and to Use Encryption Every individual has the right to communicate anonymously on the Internet and to use encryption technology. to ensure secure, private and anonymous communication. f. Freedom from Surveillance Everyone must be free to communicate without arbitrary surveillance or interception, or the threat of surveillance or interception. This includes the use of technologies such as deep packet inspection, behavioural tracking and exercising control over individuals, for example through cyber-stalking. Any agreement regarding access to online services that includes acceptance of such surveillance shall clearly state the nature of the surveillance. 10) Right to Data Protection a. Protection of Personal Data Personal data must be protected. Fair information practices should be enacted into national law to place obligations on companies and governments who collect and process personal data, and give rights to those individuals whose personal data is collected. b. Obligations of Data Collectors Collection, use, disclosure and retention of personal data must comply with a transparent privacy policy. Whoever requires personal data from persons, should request the individual's informed consent regarding the content, purposes, storage location, duration and mechanisms for access, retrieval and correction of their personal data. Everyone must be free and able to exercise control over the personal data collected about them and its usage. Everyone has a right to access, retrieve and delete the personal data collected about them. c. Minimum Standards on Use of Personal Data Public or private organisations that require personal information from individuals must collect only the minimal data necessary and for the minimal period of time needed. Data must be deleted when it is no longer necessary for the purposes for which it was collected. Data collectors have an obligation to seek active consent and to notify people when their information has been forwarded to third parties, abused, lost, or stolen. Data Security Appropriate security measures shall be taken for the protection of personal data stored in automated data files against accidental or unauthorised destruction or accidental loss as well as against unauthorised access, alteration or dissemination. d. Monitoring by Independent Data Protection Authorities Data protection should be monitored by independent data protection authorities, which work transparently and without commercial advantage or political influence. 11) Right to Education a. Right to Education on and through the Internet Everyone has the right to be educated about the Internet and to use the Internet for education. Everyone has the right to use the Internet to access knowledge, information and research. Providers of tools, Internet<http://www.apc.org/en/taxonomy/term/258> services and content should not prohibit people from utilising the Internet<http://www.apc.org/en/taxonomy/term/258> for shared learning and content creation. Virtual learning environments and other sorts of multimedia, learning and teaching platforms should take into account local and regional variations in terms of pedagogy and knowledge-traditions. Publications, research, text books, course materials and other kinds of learning materials should preferably be published as Open Educational Resources with the right to freely use, copy, reuse, adapt, translate and redistribute them. Publishers and authors should not enter contractual obligations which prevent the publication of scientific and other works on the Internet. b. Education about the Internet and Human Rights Education on the Internet should include raising awareness and respect for human rights (online and offline). c. Education and Training for Digital Literacy Digital literacy should be a key component of education. Knowledge and skills enable people to use and shape the Internet<http://www.apc.org/en/taxonomy/term/258> to meet their needs. Local and national governments, international and community organizations and private sector entities should support and promote free or low-cost training opportunities, methodologies and materials related to using the Internet<http://www.apc.org/en/taxonomy/term/258> for social development. 12) Access to Knowledge and Intellectual Property Rights a. Right to Participate in the Cultural Life of the Community Everyone has the right to use the Internet to freely participate in the cultural life of the community, to enjoy the arts and to share its scientific advancements and benefits. This includes the right to access knowledge and information on the Internet, regardless of frontiers. No restrictions must be placed on cultural expression and activities online. Everyone should be able to create and access information in their mother tongue. b. Freedom from Restrictions of Access to Knowledge by Licensing and Copyright Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production in the Internet of which he/she is the author. Creators should be remunerated and acknowledged for their work in ways that do not restrict innovation or access to public, educational knowledge and resources. However, licensing and copyright of content should permit knowledge to be created, shared, used and built upon. Creators and users should use licensing models such as Creative Commons. Internationally accepted 'fair use' exceptions and limitations to copyright should always be used, including making copies for personal and classroom use, format conversion, library lending, review, critique, satire, research and sampling. Digital Rights Management (DRM) -techniques must not prevent 'fair use' exceptions. c. Knowledge Commons and the Public Domain Publicly funded research and intellectual and cultural work should be made available freely to the general public. d. Free/Open Source Software and Open Standards Open standards and open formats should be made available wherever possible. Free/libre and Open Source Software (FOSS) should be used, promoted and implemented in public and educational institutions and services. When a free solution or open standards do not exist, the government or the corresponding public institution should promote the development of the software needed. 13) Rights of the Child and Child Protection a. Right to benefit from the Internet Children should be able to benefit from the Internet according to their age. Children should have opportunities to use the Internet to exercise their civil, political, economic, cultural and social rights. These include rights to health, education, privacy, access information, freedom of expression and freedom of association. Children who are capable of forming their own views have the right to express them in all Internet policy matters that affect them, and their views should be given due weight according to their age and maturity. b. Freedom from exploitation and child abuse imagery Children have a right to grow up and develop in a safe environment that is free from sexual or other kinds of exploitation. Measures should be taken to prevent the use of the Internet to violate the rights of children, including through trafficking and child abuse imagery. However, such measures should uphold the rights of the child and should not disproportionately or unnecessarily restrict or endanger the free flow of information online. c. Best Interest of the Child In all matters of concern to children and the Internet, the best interest of the child shall be the primary consideration. 14) Right to Work a. Respect for Workers' Rights Workers' rights must be respected in the information society. A necessary prerequisite for realizing these rights for employees is the right to use the Internet to form trade unions, including the right to promote one's own interests and gather in freely elected organs of representation. b. Internet at the Workplace Workers and employees should have Internet access at their work place, where available. Any restrictions on Internet use in the work place should be explicitly stated in staff or organizational policies. The terms and conditions for surveillance of the Internet use of employees must be clearly stated in work place policies and comply with the right to data protection. 15) Participation in Public Affairs and Internet Governance a. Right to Participate in Electronic Government Everyone has the right to participate in electronic government where available. b. Right to Equal Access to Electronic Services Everyone has the right to equal access to electronic services in his country. c. E-Democracy E-democracy and online voting should be promoted whenever it bears the potential to enable a more participatory democracy where political decisions are debated and taken by more people, provided its security can be assured. d. Right to Participate in Governance of the Internet Everyone has the right to participate in the governance of the Internet. e. Principles of Transparency, Information and Participation All stakeholders should follow the principles of transparency, information and participation in processes concerning Internet governance. 16) Consumer Protection Everyone, in particular business and governments, should respect, protect and fulfill principles of consumer protection on the Internet. E-Commerce should be regulated by governments in a way that ensure consumers the same level of protection as they enjoy in non-electronic transactions. 17) Right to Health and Social Services Online Everyone has a right to access health-related and social services as well as their own electronic health records on the Internet. 18) Right to Legal Remedy and Fair Trial a. Right to a Legal Remedy Everyone has the right to an effective legal remedy against any charges brought against him/her by public authority or a private person with regard to matters related to the Internet. b. Right to Fair Trial In the determination of any criminal charge or civil rights or obligations regarding the Internet, everyone shall be entitled to a fair and public trial hearing within a reasonable time by an independent and impartial tribunal established by law. c. Presumption of Innocence Everyone charged with a criminal or civil law offence regarding the Internet shall be presumed innocent until proven guilty according to law. d. Right to Due Process Everyone is entitled to due process by public or private authorities dealing with legal claims or possible violations of the law regarding the Internet. All action taken against illicit activity on the internet must be aimed at those directly responsible for such activities. e. No Punishment without a Law No one shall be held guilty of any criminal offence on the Internet on account of any act or omission which did not constitute a criminal offence under national or international law at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the criminal offence was committed. f. Right not to be tried or punished twice No one shall be liable to be tried or punished again for an Internet offence for which he has already been finally acquitted or convicted. 19) Appropriate Social and International Order for the Internet a. Entitlement to a Social and International Order Everyone is entitled to a social and international order of the Internet in which the rights and freedoms set forth in this Declaration can be fully realised. b. Multilingualism and Pluralism on the Internet The Internet as a social and international order should enshrine principles of multilingualism, pluralism, and heterogeneous forms of cultural life in both form and substance. c. Governance of the Internet for Human Rights The Internet and the communications system should be governed in such a way as to ensure that it upholds and expands human rights to the fullest extent possible. d. Effective Participation in Internet Governance The interests of all those affected by a policy or decision should be represented in the governance processes, which should enable all to participate in its development. Transparency and full and effective participation of all, in particular disadvantaged groups in global, regional and national decision-making should be ensured. 20) Duties and Responsibilities on the Internet a. Respect for the Rights of Others Everybody using the Internet has duties and responsibilities as well as rights. These include respect for the rights of all individuals in the online environment. b. Responsibility of Power Holders Power holders should exercise their power responsibly, refrain from violating human rights and respect, protect and advance them to the fullest extent possible. 21) General Clauses a. Interdependence of all rights in the Charter All rights contained in this Charter are interdependent and mutually reinforcing. b. Limitations for restrictions of rights and principles Any restrictions of rights in this Charter must be necessary, proportionate, defined in law and consistent with international human rights law and standards. Restrictions must not be applied for any other purpose other than those for which they have been described. c. Non-exhaustive nature of the Charter The fact that certain rights and principles have not been included in this Charter or have not been developed in detail does not preclude the existence of such rights and principles. d. Interpretation of Rights and Freedoms of the Charter Nothing in this Charter maybe interpreted to impair any of the rights and freedoms set forth therein.

Telecom e il server smtp

Telecom ha deciso di bloccare sui contratti business il server smtp richiedendo l'autenticazione. Anche se non vuoi i loro servizi aggiuntivi di posta, il protocollo è bloccato. O paghi 1,50 € al mese o la tua posta non la invii. Nei profili commerciali ovviamente nulla si dice. Se vuoi inviare posta sei costretto ad abbonarti a parte, non si sa bene a cosa, solo per ricevere user e pass per autenticarti sui loro server smtp. Il protocollo di posta NON è più compreso in internet, o almeno nella favolosa offerta "Internet 20 mega". Al di là delle implicazioni di chiarezza commerciale, chiedo ai tecnici in lista: è normale? un protocollo che nella mia mente di non tecnico è sempre stato parte fondamentale insieme all' http di ciò che chiamiamo "internet" può esser commercialmente filtrato su server che paghi a parte? Può darsi che io commetta errori e mi senta solo buggerato e fesso, avendo aderito a "impresasemplice": così semplice che per far quello che ho sempre fatto, ovvero inviare la posta dal mio client, ora devo pagare per autenticarmi. Insomma, al di là della assenza di informazioni nelle offerte commerciali, chiedo cosa ne pensa AGICOM o dico una scemenza? Carlo

Codice Azuni sì o Codice Azuni no A Vilnius, in occasione dell'Internet Governance Forum, l'Italia ha proposto una sua via per lavorare a una "Carta dei diritti di Internet". Questa via si chiama Codice Azuni. Wired.it ha seguito direttamente in Lituania la presentazione dell'iniziativa del nostro Governo. Un'iniziativa che secondo molti, Fiorello Cortiana in primis, non tiene conto del lavoro fin qui svolto dall'Italia all'interno dell' Internet Governance Forum e in particolare dal noto giurista Stefano Rodotà. Wired.it ha quindi deciso di aprire sul suo sito (e su tutti i suoi luoghi in Rete: Facebook, Twitter e così via) un dibattito pubblico sul Codice Azuni. Voi cosa ne pensate? These findings are consistent with those of the Oberholzer-Gee / Strumpf report presented at the 2010 Vienna Music Research days and published in the NBER Series. They add some very interesting information on the number of artists (30% growth) and their specific average income (60% average income growth). The latter may not necessarily be valid everywhere (in particular because Norway has seen an important growth in grants and subsidies which is not witnessed on other countries). Unfortunately, there is little information on the distribution of this income among artists. In all countries, live performance is the fastest growing source of income, but in many countries, it is extremely concentrated on some leading tours and connected to a strong increase in the price of tickets.
