In a speech to students at Hampton University on May 9th, Mr Obama did not just name-check some big brands; he also joined a long tradition of grumbling about new technologies and new forms of media. Socrates's bugbear was the spread of the biggest-ever innovation in communications---writing. He feared that relying on written texts, rather than the oral tradition, would "create forgetfulness in the learners' souls...they will trust to the external written characters and not remember of themselves." Enos Hitchcock voiced a widespread concern about the latest publishing fad in 1790. "The free access which many young people have to romances, novels and plays has poisoned the mind and corrupted the morals of many a promising youth." (There was a related worry that sofas, introduced at the same time, encouraged young people to drift off into fantasy worlds.) Cinema was denounced as "an evil pure and simple" in 1910; comic books were said to lead children into delinquency in 1954; rock'n'roll was accused of turning the young into "devil worshippers" in 1956; Hillary Clinton attacked video games for "stealing the innocence of our children" in 2005. It’s not a new issue. Back in 2006 the Daily Show did a classic bit with Jon Hodgman<http://www.thedailyshow.com/watch/wed-july-19-2006/net-neutrality-act> that is still good for a chuckle albeit a nervous one when contemplating what it really means. Here is the gist. Right now, internet providers provide access to the internet. Overall access speed has continued to increase with the advent of T1, cable, etc. What telecommunications companies have been unable to do so far is control the speed in which all things travel on the internet — they only control how fast you can get to it. So, if you have a slow connection, your internet is slow. But ALL sites you visit are slow. If you have a fast connection, your internet is fast. But ALL sites you visit are fast. This is why this matters so much: Nonprofits, particularly those who engage in political activity, stand to lose their ability to use the internet effectively for advocacy. Not only is it an issue of speed alone, but corporate interests would have the ability to effectively censor those associations who took positions on issues they disagreed with. Verizon ran into trouble in 2007 when it tried to prevent NARAL from sending text messages <http://www.nytimes.com/2007/09/27/business/27cnd-verizon.html> to their own members on women’s reproductive rights. What if that behavior became institutionalized? If the nonprofit community passively accepts the demise of net neutrality, they will potentially suffer untenable consequences. Smaller associations probably can’t print 10,000 yard signs, but they can get involved in online communication efforts. But not if they can’t get to the sites they need to get to. On April 6, the DC Circuit Court of Appeals ruled in favor of Comcast and against the Federal Communications Commission. The FCC only has a few options to act: - Do nothing. - Wait for Congress to act. - Reclassify broadband services so they fall squarely within the regulatory structure. Although Chairman Genachowski has expressed support for net neutrality contradictory news reports have been swirling this week. Earlier in the week news reports seemed to indicate the FCC was abandoning net neutrality. The uproar from activists was vociferous and as recently as yesterday, May 5, 2010 the Wall Street Journal reported the FCC will, indeed, push forward with reclassification<http://online.wsj.com/article/SB10001424052748703961104575226583645448758.h…>. In spite of that good news, the battle isn’t over yet and the situation remains fluid. What can you do as a nonprofit trade and professional association? Cari Nexiani, A mio avviso larticolo mette bene in mostra (v. § 3.7, p. 13) il punto chiave della faccenda, vale a dire della (ir)-responsabilità dei fornitori di servizi nel Web 2.0. Come a mia volta sottolineato nellarticolo già discusso a Nexa settimane fa (http://nexa.polito.it/sites/nexa.polito.it/files/Pagallo2009-Sul_Principio_…) in order to establish whether the liability of a referencing service provider may be limited under Article 14 of Directive 2000/31, it is necessary to examine whether the role played by that service provider is neutral, in the sense that its conduct is merely technical, automatic and passive, pointing to a lack of knowledge or control of the data which it stores" (secondo il § 114 della recente pronuncia della CGE, 23 marzo 2010, C-236 a 238/08, che risolve per molti versi alcuni dei punti sollevati l'altra settimana da altre sentenze europee su e-Bay). Rimangono però, nellarticolo, alcuni ulteriori punti da sviluppare. Primo su tutti, la giurisdizione (§ 3.1 e 4.2): rispetto al contributo bisognerebbe aggiungere che (purtroppo) il WP29, sin dal 2002, avanza la tesi di una giurisdizione pan-europea, ribadita anche di recente. Forse è il caso di sottolineare al riguardo le tesi alternative del GEPD Peter Hustinx. Sembra peraltro ardua la strada suggerita al § 3.5 circa an inevitabile mistake regarding Italian law alla luce di C. Cost. 364/1988: almeno, non penso che il giudice dappello potrà mai commuoversi dinnanzi allignorantia excusat del caso. Sul piano filosofico-giuridico, al quale gli autori dellottimo parere e il sottoscritto apparteniamo, cè da riprendere con forza il richiamo del § 3.8 sulla libertà di espressione, peraltro già al centro del contributo di unaltra eccellente filosofa del diritto, Hillary Clinton, allinizio di questanno. Avendo a mente anche altri fronti uno per tutti: la galassia del P2P, il cui traffico ha superato in molte parti quello del Web sin dalla fine del 2008 questo è uno degli aspetti più critici per il futuro italiano di internet. Guido, credo che occorra ragionare con serenità sulla portata concreta di un atto che non è neppure lontanamente paragonabile nei contenuti a quello che in altri paesi occidentali è previsto in forza di una legge dello stato. Peraltro, andrebbe spiegato ai non giuristi (perchè altrimenti la gente si fa strane idee) che se un "web service provider" non firma quel codice quel codice a lui non si applica. Perchè è un codice di autoregolamentazione, cioè, a prescindere da chi materialmente abbia redatto il contratto, sono quelli che lo firmano a decidere di aderirvi o meno. Se nessuno firma, amen.
