Corte Costituzionale - open source - 122-10

Cari tutti, vi allego questa "fresca" sentenza della Corte costituzionale che in materia di open source dichiara illegittime alcune disposizioni contenute nella L. Reg. Piemonte n. 9 del 2009 (Norme in materia di pluralismo informatico, sull'adozione e la diffusione del software libero e sulla portabilità dei documenti informatici nella pubblica amministrazione), che violano alcune disposizioni penali e la disciplina del diritto di autore. Proxy fuorilegge?

Carissimi, abbiamo appena pubblicato un articolo che rappresenta una forte presa di posizione contro il sequestro di un proxy italiano, accusato di consentire l'accesso a The Pirate Bay, accompagnato da una perquisizione domiciliare e sequestro di TUTTO il materiale informatico ai danni dello studente 21enne che gestiva tale proxy. http://blog.tntvillage.scambioetico.org/?p=5799 In realtà non si tratta di una semplice e sterile presa di posizione, ma di un atto di vera e propria disobbedienza civile, che sentiamo doveroso per non piegarci alla logica della censura e dell'intimidazione. Vi invitiamo caldamente a prendere visione dell'articolo ma soprattutto a diventare parte attiva di un processo con il quale è indispensabile a nostro avviso combattere l'attuale clima censorio che pare si stia trasformando in un'operazione finalizzata a diffondere un senso di incertezza se non di vera e propria paura. Come scrive Luigi Di Liberto nell'articolo: "Cosa possiamo fare? Quello che si deve fare lo abbiamo, come Stefano Severi fece a suo tempo, qui alcuni giorni fa già fatto, mettendo un link che passando attraverso un proxy porta direttamente alla Baia dei Pirati, rinnovandolo platealmente in questo articolo. Auspichiamo che la cosa venga ripresa da tutti coloro che hanno un sito e si sentono indignati da questo sequestro e perquisizione, l’indignazione senza azione diventa la carta igienica delle buone coscienze in un contenitore vuoto a perdere." Questo sarebbe il modo per dimostrare concretamente solidarietà a questo ragazzo che probabilmente in queste ore si sente solo e con grandi preoccupazioni. Ci auguriamo quindi che ognuno di voi realizzi un piccolo ma significativo, concreto atto: inserire un link diretto ad un proxy nella propria home page e/o creare un vero e proprio proxy per bypassare la censura: riteniamo doveroso non far passare il grave fatto sotto silenzio. Policy makers, businesses debate role of Washington in cloud computing Behind *Facebook*, *Gmail* and the *Bing* search engine is a multibillion-dollar shift in technology that users don't see and Washington doesn't quite know how to handle. That trend is called cloud computing: the hosting of data on remote servers that can be tapped from any computer connected to the Web. And the policy implications of cloud computing was the subject of debate last night at a roundtable dinner discussion at the Aspen Institute, hosted by *Microsoft*. Microsoft has emerged as a proponent of some rules of the road for the largely Wild West that cloud computing companies such as Google, Yahoo and Amazon operate. Yes, that's right -- the company wants more rules. Microsoft has called on Congress to update the Electronic Communications Privacy Act to clearly apply to protections on the Web. The IHT A crusade to save digital material March 18, 2010 | By PATRICIA COHEN Among the archival material from Salman Rushdie on display at Emory University, in Atlanta, are inked book covers, handwritten journals and four Apple computers (one ruined by a spilled Coke). The 18 gigabytes of data they contain seemed to promise future biographers and literary scholars a digital wonderland: comprehensive, organized and searchable files, quickly accessible with a few clicks. But like most Rushdian paradises, this digital idyll has its set of problems. As research libraries and archives are discovering, ''born-digital'' materials - those initially created in electronic form - are much more complicated and costly to preserve than anticipated. Electronically produced drafts, correspondence and editorial comments, sweated over by contemporary poets, novelists and nonfiction authors, are ultimately just a series of digits - 0's and 1's - written on floppy disks, CDs and hard drives, all of which degrade much faster than old-fashioned acid-free paper. Even if those storage media do survive, the relentless march of technology can mean that the older equipment and software that can make sense of all those 0's and 1's simply don't exist anymore. Imagine having a record but no record player. All of which means that archivists are finding themselves trying to fend off digital extinction at the same time that they are puzzling through questions about what to save, how to save it and how to make that material accessible. By MARIE BÉNILDE Journalists are now in the same situation as steel workers in the 1970s: They are destined to disappear, but they don't know it. That was the assessment of a banker from BNP-Paribas at the French national press federation's conference in Strasbourg in 2006. His words caused a sensation, but the statistics support him: Having lost more than 2,300 jobs last year, the French press is going through a crisis similar to America's. Every national daily in France, apart from the sports daily, L'Equipe, has lost money. In the United States, only 300,000 people now work in newspapers, compared to 415,000 a decade ago. According to the management consultants Bain and Company, the Internet increased its share of global profits in the creative industries from 4 to 22 percent in the last 10 years, at the expense of the press, which saw its profits fall from 40 percent to 14 percent. The public has also become disillusioned with the content supplied by a journalistic elite that has lost credibility. I ragazzi di oggi, quelli compresi fra i 6 e i 17 anni, leggono molto più della media nazionale: 57 per cento contro 45, ed è un dato cresciuto quasi costantemente dal 2000 ad oggi, con buona pace di chi li dipinge ignoranti e vittime del piccolo schermo. È quanto emerge dall' ultima ricerca condotta dalla Nielsen per conto dell' Associazione Italiana Editori (Aie) su un campione di circa ottomila individui. Ricerca che verrà illustrata domani mattina all' Auditorium di Roma, nell' ambito della manifestazione "Libri Come". Il tutto alla presenza dello scrittore Federico Moccia e del giornalista di Radio Tre Giorgio Zanchini. «Abbiamo calcolato che, durante una giornata tipo, chi ha fra i 6 e i 17 anni attinge informazioni da 23 dispositivi diversi», spiega Cristina Mussinelli, consulente della Aie per il settore digitale e coordinatrice della ricerca.
