The most obvious lesson is that it represents the first really sustained confrontation between the established order and the culture of the internet. There have been skirmishes before, but this is the real thing. And as the backlash unfolds -- first with deniable attacks on internet service providers hosting WikiLeaks <http://www.guardian.co.uk/media/2010/dec/01/wikileaks-website-cables-server…>, later with companies like Amazon and eBay and PayPal <http://www.bbc.co.uk/news/world-us-canada-11917891> suddenly "discovering" that their terms and conditions preclude them from offering services to WikiLeaks, and then with the US government attempting to intimidate Columbia students posting updates about WikiLeaks on Facebook -- the intolerance of the old order is emerging from the rosy mist in which it has hitherto been obscured. The response has been vicious, co-ordinated and potentially comprehensive, and it contains hard lessons for everyone who cares about democracy and about the future of the net. There is a delicious irony in the fact that it is now the so-called liberal democracies that are clamouring to shut WikiLeaks down. A gennaio, poi, ci azzarderemo a tentare un pronostico per il 2011, cercando di identificare le priorita' Internet per l'anno nuovo. The IT environment of the open source OpenOffice.org migration involves more than 10 000 workstations in the Finnish Ministry of Justice and its administrative sector. Methodologically, the research is a longitudinal innovation adoption study covering the 7-year time span from 2003 to 2010. The study applies and tests the organizational innovation adoption process model originally developed by Everett Rogers. In addition to the theory-testing approach, the study includes artifact-building and artifact-evaluation activities of design research. The research view of the study introduces a participatory researcher's implementation perspective where the researcher as a staff member of the organization has been in charge of the adoption of the innovation in the organization. The findings of the study provide contributions both to IS research and practice. The events of the study give reason to suggest that the characteristics of the open source software with low-cost licenses call for improvements in the organizational innovation adoption stage model. The findings suggest that the predefined order of stages in the innovation process and sharp distinctions between stages should not be expected in organizational innovation adoption. As a new model and method, the study provides a complementary framework for the instrumentation and documentation of the open source innovation process in the organizational context. The study confirms several results from previous research and practice, especially the importance of top management support, systematic open source skill building and the presence of innovation champions in the adoption of open source solutions. For IS practice, the study shows that the transition to an open source office suite is feasible in a large-scale context and that substantial benefits can be achieved as the result of the transition. For the user organizations of open source software, lower cost has been the most commonly cited benefit and one of the main reasons for adopting open source. Other often cited considerations include strategic goals like the facilitation of more sovereign IT governance and the reduction of vendor dependence through open source solutions and open standards. The study addresses several practically important issues involved in the adoption of open source, e.g., the analysis of software functionality and interoperability, cost evaluations, installation and configuration issues, local language support issues, additional tools to support the migration, user training and support, technical support, and software usage measurements. The evaluation of costs in the study indicates that the migration to the open source office suite platform will benefit the target organization of the study with impressive cost savings when compared to the deployment of a comparative proprietary office suite platform. The study applies numerous best practice approaches which together with the rich insight provided by the research should benefit other organizations considering open source office suite adoptions both from the perspectives of management and implementation.

Manning, a former army intelligence analyst in Iraq, faces up to 52 years in prison. He is currently being held in solitary confinement at a military base in Quantico, Virginia, where he is not allowed to see his parents or other outside visitors. Assange, the organizing brain of Wikileaks, enjoys a higher degree of freedom living as a hunted man in England under the close surveillance of domestic and foreign intelligence agencies -- but probably not for long. Not since President Richard Nixon directed his minions to go after Pentagon Papers leaker Daniel Ellsberg and New York Times reporter Neil Sheehan - "a vicious antiwar type," an enraged Nixon called him on the Watergate tapes -- has a working journalist and his source been subjected to the kind of official intimidation and threats that have been directed at Assange and Manning by high-ranking members of the Obama Administration. Re: [nexa] Google, Making Copyright Work Better Online

Scusate l’intervento a gamba tesa e fuori tempo massimo, ma l’argomento mi sta a cuore. Importare modelli da altri ordinamenti giuridici, come sanno i comparatisti, è sempre un esercizio complicato. L’ordinamento statunitense ha la sua storia e la sua coerenza interna, ma è il portato di una cultura che non è la nostra. Da figlio della cultura giuridica europea (ma ho studiato anche negli Stati Uniti, e ne apprezzo – pur con alcune riserve – il modello) personalmente mi preoccupano le spinte verso la “privatizzazione” del diritto. In un altro *thread*, quello legato alla proposta del Prof. Rodotà e alle critiche (che personalmente trovo incomprensibili) che gli sono state rivolte, Fiorello Cortiana ha richiamato la funzione di garanzia collettiva delle regole giuridiche. Il meccanismo del Notice-and-Take-Down, oltre ad essere un corpo estraneo in un ordinamento che è fondato sulla centralità della legge e dei suoi interpreti esclusivi (i giudici, per espresso dettato costituzionale), è il trionfo della presunta efficienza sulla giustizia, lo scardinamento della funzione di garanzia del diritto. Mi fa sinceramente sorridere (ma è un sorriso amaro), l’idea di un * copyright* che *work better*, “funziona meglio”. Una Mac può “funzionare meglio” di un PC (o viceversa, a seconda dei punti di vista). Non una norma o, in questo caso, un sistema giuridico, che deve anche e soprattutto “esprimere valori” e non soltanto “funzionare”, “produrre risultati”. D’altra parte, l’idea del *copyright* che funziona meglio è uno degli inevitabili corollari della tendenza a ritenere che il diritto d’autore sia esclusivamente *ius privatorum*, un affare tra privati. Va da sé che, in quanto attore privato, Google è (relativamente) padrona di fare ciò che ritiene. Tuttavia, eliminare l’intermediazione degli interpreti (i giudici) nel delicato equilibrio di interessi proprio del diritto d’autore, lasciandolo al confronto tra due soli portatori di interessi, *inaudita altera parte*, mi sembra davvero una prospettiva “contro”. Contro la nostra cultura giuridica, contro il senso profondo della nostra costituzione, contro le leggi vigenti nel nostro ordinamento giuridico. Leggi a cui – vivaddio! – qualunque diverso e contrastante “punto di riferimento” non sembra ancora poter togliere vigenza. Un cordiale saluto a tutti.
