There are so many things each day, that it is almost impossible to stay in touch with the avalanche of fact, analysis and proposals. Quite fascinating times when suddenly there is such switch in the balance of ideas. The day before yesterday and yesterday, I was in two debates with heads of collective management societies in France (the one dealing with institutional video and multimedia publishing and the one dealing with film / audiovisual / theatre) and in each there was a true revolt of a significant number of artists (film- makers in these cases) against the reiteration of dogmatic oppositions by the managers of status quo. Let's hope policy follows or the disappointment / disaffection will be terrible. For the timebeing, our Culture Minister seems to be heading at full speed for a new censorship in Constitutional Court : she proposes a new law to reintroduce the censored sanctions. Banning from the Internet would be introduced as a third possible sanction for IP infringement in addition to prison and fines. The HADOPI would transmit to the correctional courts the case of repeated "infringers" and these courts would use judiciary ordonnances to sanction without audience and hearing the case. Everything in the law (penal code) and the case law says that ordonnances can not be used for such matters. The CEDH would condemn such usage with probability 1. Philippe Le jeudi 18 juin 2009, J.C. La Quadrature: "Lettre ouverte aux pro-HADOPI"

http://www.laquadrature.net/fr/lettre-ouverte-aux-pro-hadopi Suite à la décision du Conseil Constitutionnel neutralisant la loi HADOPI <http://www.laquadrature.net/fr/hadopi-le-conseil-constitutionnel-censure-la…>, les co-fondateurs de La Quadrature du Net ont envoyé une lettre ouverte aux députés qui l'ont votée : ---------------------- Madame la députée, Monsieur le député, Le coeur du dispositif de « riposte graduée » instauré par la loi « Création et Internet », dite « HADOPI », que vous avez votée le 12 mai dernier était, selon le Conseil constitutionnel dans sa décision datée du 10 juin 2009, contraire aux principes de séparation des pouvoirs et de présomption d'innocence, mais également restrictive des libertés d'expression et d'information et du droit à un procès équitable. Nous vous avions alerté à de multiples reprises sur ces points au cours des mois qui ont précédé son examen. Vous étiez naturellement libre de ne pas suivre notre avis pour vous forger le vôtre. Mais au-delà de nos propres inquiétudes, ce sont des centaines, sinon des milliers de citoyens, dont nombre de vos électeurs, qui vous ont également alerté sur ces aspects extrêmement préoccupants pour le bon équilibre de notre démocratie. Nous savons que de nombreux députés qui ont approuvé le projet de loi avaient de profonds doutes sur la compatibilité du dispositif proposé avec les droits fondamentaux. Mais les instructions de « silence dans les rangs » relayées par divers responsables ont eu temporairement raison de ces doutes. Il est très inquiétant pour l'avenir des libertés individuelles en France qu'il ait pu en être ainsi malgré les critiques émises par tant d'institutions, d'analystes et de citoyens contre le projet, et malgré l'importance des enjeux dont témoigne la sévérité de la décision du Conseil constitutionnel. Ainsi, pour le Conseil constitutionnel, *« Considérant qu'aux termes de l'article 11 de la Déclaration des droits de l'homme et du citoyen de 1789 : " La libre communication des pensées et des opinions est un des droits les plus précieux de l'homme : tout citoyen peut donc parler, écrire, imprimer librement, sauf à répondre de l'abus de cette liberté dans les cas déterminés par la loi " ; qu'en l'état actuel des moyens de communication et eu égard au développement généralisé des services de communication au public en ligne ainsi qu'à l'importance prise par ces services pour la participation à la vie démocratique et l'expression des idées et des opinions, ce droit implique la liberté d'accéder à ces services »*. C'est cet attachement aux valeurs fondamentales de notre démocratie et à son bon fonctionnement que nous avons été des milliers à vous rappeler. Nous avons sans cesse souligné que la régulation d'Internet, ce formidable moteur de croissance économique et sociale, pouvait emprunter d'autres voies, respectueuses des libertés autant que soucieuses des conditions d'existence de la création. Les libertés individuelles des citoyens connectés en réseau seront de nouveau, prochainement, menacées. Nous espérons sincèrement que les logiques de parti et les pressions de lobbies ayant un intérêt à restreindre les libertés fondamentales pèseront à l'avenir moins que la mission de protection de nos concitoyens qu'implique votre mandat électif.
