This article contends that copyright law's historical tolerance for such copying as a fair use has served as an important element of both copyright and innovation policy. This is because, to the extent it permits private copying, fair use creates incentives for technology companies to build innovative new products that enable such copying. Far from being an unfair "subsidy" from copyright owners to technology innovators, this aspect of fair use has yielded complementary technologies that enhance the value of copyrighted works. This fair use incentive to technology companies, moreover, is justified in light of a persistent market failure that would otherwise result in underproduction of certain kinds of socially-beneficial innovations. Finally, there are reasons to believe that technology innovators may not in many cases be able to appropriate to themselves the value of the fair uses that their technologies enable, because those uses will not be part of their marginal costs of production. To the extent that the value of these fair uses ends up being captured by the public, rather than technology innovators, this also furthers the purposes of copyright law.] 3. CARTA ETICA DIGITALE 13 ottobre 2009 Art.1 (Opportunità digitale) A chiunque deve essere universalmente garantita l’opportunità di accedere ad Internet per la diffusione del proprio libero pensiero Art.2 (Sviluppo) I Governi favoriscono l'accesso locale ad Internet quale sviluppo democratico della Societa' dell’Informazione. Art.3 (Promozione) Art 3 I Governi sostengono l'utilizzo di Internet sviluppando procedure di governance che assicurino trasparenza, efficacia e tempestività nei rapporti tra Stato e cittadino. Art.4 (Rispetto) Chiunque nell'utilizzo di Internet e' chiamato al rispetto della risorsa tecnologica nell’interesse proprio e della collettività. Art.5 (Verifica) Chiunque nella diffusione di informazioni deve accertare e verificare, prima delle divulgazione delle stesse, la veridicità della fonte. Art.6 (Segreto) Chiunque condivide informazioni in Internet non è tenuto a rivelare la fonte dell’informazione se non su richiesta dell'autorità giudiziaria. Art.7 (Anonimato) Chiunque può ricorrere a sistemi di anonimizzazione etica qualora il Governo del proprio Paese ponga in atto azioni lesive verso i diritti e le libertà fondamentali dell'uomo. Art.8 (Compilazione) Chiunque scrive ed esegue un codice o un algoritmo informatico deve rispettare i diritti personali e patrimoniali altrui. Art.9 (Standard) Chiunque scrive ed esegue un codice o un algoritmo informatico deve porre ogni azione affinchè sia possibile garantire l’interoperabilità dei sistemi. Art.10 (Gratuità) Chiunque produce e diffonde liberamente la propria conoscenza non è tenuto alla corresponsione di alcuna tassa o esser sottoposto a vincoli di controllo.

Emendamento 138: il Parlamento potrebbe arrendersi alle 11

Spero che vogliate telefonare a qualche MEP prima delle 11, è molto importante: domani mattina potrebbe essere il giorno in cui il 138 viene cancellato per sempre. L'ordine ideale è Toia, Pittella, Trautmann, Quadras, Reul, se dovesse avanzare il tempo tutti gli altri. Nell'articolo trovate molti spunti su cosa dire e ovviamente i numeri telefonici, è essenziale che non accettino il testo del Consiglio e pongano così fine alla conciliazione, è necessario più tempo per valutare le motivazioni legali degli avvocati che sono state date ai parlamentari soltanto questa sera! Non è possibile decidere serenamente senza aver tempo di ponderare. Ciao, Paolo
