Corriere Sera, Orofino: "La Costituzione e le regole del Web 2.0"

Il dibattito sulla rete "La Costituzione e le regole del Web 2.0" La Carta offre già tutte le risposte. Occorre seguire la strada del dialogo con i fornitori di servizi e con gli utenti Marco Orofino Libertà di comunicazione e Costituzione - La “libertà di comunicazione” è disciplinata nella nostra Costituzione in due norme: l’art. 15 e l’art. 21. La prima norma costituzionale – l’art. 15 – riconosce e garantisce a tutti gli individui il diritto di corrispondere liberamente e segretamente, con qualsiasi mezzo disponibile e tecnicamente idoneo a garantire la segretezza della corrispondenza. La seconda norma costituzionale – l’art. 21 – riconosce a “tutti” il diritto di manifestare liberamente il proprio pensiero con la parola, lo scritto e ogni altro mezzo. Nonostante a prima vista possa sembrare che le due norme abbiano il medesimo oggetto in realtà ciò non è vero. Le due norme hanno, infatti, un ambito di applicazione diverso e, soprattutto, un diverso sistema di limiti. Per quanto riguarda l’ambito di applicazione, l’art. 15 tutela la liberta e la segretezza delle comunicazioni interpersonali, solo cioè di quelle comunicazioni che avvengono tra un numero di destinatari determinato e attraverso un mezzo tecnico idoneo a garantire la segretezza della comunicazione. L’art. 21 ha, invece, come oggetto le cosiddette comunicazioni al pubblico, vale a dire le manifestazioni del pensiero rivolte ad un numero indeterminato di soggetti. La distinzione tra i due ambiti di applicazione dipende, dunque, sia dalla volontà soggettiva di chi comunica sia dal mezzo tecnico utilizzato, nel senso che se lo strumento tecnico non è idoneo a garantire la segretezza, la comunicazione rientra sempre nel paradigma dell’art. 21 ed è considerata comunicazione al pubblico. Lessig: "Against transparency"

Circa due mesi fa Lawrence Lessig ha pubblicato su The New Republic un articolo dal titolo: "Against Transparency: The Perils of Openness in government", http://www.tnr.com/article/books-and-arts/against-transparency E' un articolo che ha fatto scalpore, ma a mio avviso quasi esclusivamente a causa del titolo, provocatorio oltre al ragionevole (e quasi sicuramente non attribuibile a Lessig). Lessig, infatti, che, come è noto, ormai si concentra sulla corruzione del processo politico, sottolinea che una specifica iniziativa di trasparenza, ovvero, quella che mira a rendere disponibile tutti i contributi finanziari che ricevono i politici USA, ha, a suo avviso, una grave controindicazione, ovvero, quella di facilitare il consolidarsi di una pervasiva cultura dell'insinuazione. La sua controproposta e' l'introduzione del finanziamento pubblico ai candidati e l'eliminazione di tutti i contributi, tranne quelli di singoli cittadini e comunque sotto i 100 dollari. Per il resto, Lessig invita ad avvicinarsi a Internet laicamente, analizzando oggettivamente sia aspetti positivi sia aspetti negativi, e preoccupandosi di provare a identificare modi per sostenere quanto di positivo viene, in un modo o nell'altro, messo in crisi dall'avvento di Internet, come il giornalismo (che non e' la stessa cosa de "i giornali"). Rodotà: "Le leggi per la Rete"

LA REPUBBLICA LE LEGGI PER LA RETE di STEFANO RODOTÀ L'ITALIA ha scoperto la Rete. Appena ieri era divenuta evidente per tutti la forza di Internet quando proprio da lì era partita l'iniziativa che era riuscita a portare in piazza un milione di persone per il "No B Day". Si materializzava così una dimensione della democrazia inedita per il nostro paese. Pochi giorni dopo quell'immagine appare rovesciata. Internet diventa il luogo che genera odio, secerne umori perversi. E questa sua nuova interpretazione travolge quella precedente: il "No B Day" è presentato come un momento d'incubazione dei virus che avrebbero reso possibile l'aggressione a Berlusconi, Internet come lo strumento in mano a chi incita alla violenza. On November 9, 1923, Hitler's Beer Hall Putsch was crushed in Munich, and on November 9, 1918, Kaiser Wilhelm II abdicated and Germany was declared a republic. The date especially hovers over the history of Germany, but it marks great events in other countries as well: the Meiji Restoration in Japan, November 9, 1867; Bonaparte's coup effectively ending the French Revolution, November 9, 1799; and the first sighting of land by the Pilgrims on the /Mayflower/, November 9, 1620. On November 9, 2009, in the district court for the Southern District of New York, the Authors Guild and the Association of American Publishers were scheduled to file a settlement to resolve their suit against Google for alleged breach of copyright in its program to digitize millions of books from research libraries and to make them available, for a fee, online. Not comparable to the fall of the Berlin Wall, you might say.
