February 19, 2010 *Google Fights for Ophaned Books* By JOAB JACKSON of IDG News Service\New York Bureau, IDG Fending criticisms from multiple parties, Google once again made the case for digitizing millions of orphaned books before the U.S. District Court Southern District Court of New York, in a fairness hearing held Thursday. A total of 27 different parties requested to speak before the court. Five were in favor, including Sony, the National Federation of the Blind and the Center for Democracy and Technology. The rest -- 22 in total -- opposed the settlement, including Amazon, Microsoft, the Open Book Alliance, and the Electronic Privacy Information Center. Those in favor praised the idea of rendering hard-to-find books in electronic form, because they could be accessible to a much larger group of readers, and not be lost to the ages. The objectors, however, voiced strong concerns that the settlement case preempts U.S. copyright law altogether. Others voiced privacy and antitrust concerns. Occorre ridurre la durata dei termini di tutela del copyright. 2. Qualsiasi modifica sulla portata della tutela del copyright (ivi comprese qualsiasi nuova definizione della materia tutelabile o l'espansione di diritti esclusivi) deve tener conto degli effetti sul pubblico dominio. 3. Qualora un'opera debba rientrare pubblico dominio strutturale del proprio Paese d'origine, va riconosciuta come parte del pubblico dominio strutturale in tutti gli altri Paesi del mondo. 4. Ogni tentativo falso o ingannevole di appropriarsi di opere in pubblico dominio va punito a norma di legge. 5. Non è consentito ricorrere ad alcun ulteriore diritto di proprietà intellettuale per ricostituire l'esclusività su opere di pubblico dominio. 6. Occorre implementare un modo pratico ed efficace per rendere disponibili le 'opere orfane' e i lavori già pubblicati ma non più in commercio (ad esempio, le opere fuori catalogo) onde poter essere riutilizzate dalla società. 7. Le istituzioni a tutela del patrimonio culturale dovrebbero assumere un ruolo cruciale per l'efficace catalogazione e tutela delle opere di pubblico dominio. 8. Va eliminato ogni ostaco legale che possa impedire la condivisione volontaria delle proprie opere o la diretta assegnazione a pubblico dominio da parte dell'autore. 9. In generale va reso possibile l'uso personale non commerciale delle opere tutelate dal copyright, e per casi simili vanno esplorate forme alternative di remunerazione per l'autore. Le cose che dice Lanier non sono banali. E' stato già notato che si tratta di una linea di pensiero simile a quella di Keen, ma io sono in profondo disaccordo con entrambi. Che ti pare che solo perchè io e te Mariella siamo fan dell'economia del dono possiamo definirci maoisti digitali come dice LANIER? No, non ci siamo proprio, ovviamente, come in tutti i ragionamenti sono diverse le affermazioni di Jaron che salverei...

Europarl says no to SWIFT

La settimana scorsa Europarl non ha rinnovato il SWIFT agrmt con gli US. Adesso arriva il commento "not so SWIFT" del WSJ. Since its creation after September 11, the Terrorist Finance Tracking Program—known as the Swift program—has been a key antiterror tool. But now this once-top-secret initiative may go out of business, and we can thank the European Parliament. Citing civil liberties and privacy concerns, the Parliament last week rejected an agreement between the Obama Administration and the 27 European Union governments that gave the U.S. access to financial information from Swift, an international banking consortium. U.S. authorities had direct access to the data until the consortium's American servers were moved to Europe at the end of 2009. Even last- minute lobbying from Vice President Joe Biden and Cabinet officers Hillary Clinton and Timothy Geithner were of no avail. Contrary to popular fears of "data mining," European Commissioner Cecilia Malmström said before the vote that the information remains "anonymous" and "only if there is reason to believe that an identified person is a terrorist can the data of that person be seen." She also told Parliament the data could only be used in the antiterror fight and couldn't be stored for more than five years. So far, the program has produced more than 1,500 reports and numerous leads for U.S. and European security services, according to the State Department. In 2003, it helped net Riduan Isamutddin—better known as Hambali—mastermind of the 2002 Bali nightclub bombing that killed 202 people. The European Commission, which also backed the deal, says the program helped thwart the 2006 Heathrow Airport liquid-bomb plot. Swift data also helped prevent a terror attack on Barcelona, according to Spain's Interior Minister, Alfredo Perez-Rubalcaba. So far, the media are treating the vote as a stand on principle. The New York Times, which first exposed the Swift program in 2006, wrote that the vote "underlined the differences between the United States and the European union over how to balance personal privacy guarantees with concerns on national and international security." But the truth is more prosaic and distressing: While pretending to stand on principle, the Parliament was flexing new muscles under last year's Lisbon Treaty—while also indulging anti-American reflex. Previously, the Parliament did not have the power to approve agreements on internal security. The vote underscores how slight a difference President Obama's election has made in trans-Atlantic cooperation. Had this decision come two years ago, it would have been cast as a vote of global no- confidence in the Bush Administration. Instead, it is a reminder that countries and institutions cooperate according to their own purposes, some of which have little to do with the merits. The U.S. and Europe may still salvage a deal, probably through the cumbersome process of negotiating separate treaties with 27 European governments. If the European Parliament thinks that it has made itself more relevant through its obstructionism, its conceit comes at the expense of our collective safety.

R: Carta dei Diritti della Rete: eppur si muove...in Brasile

A conclusione del lavori dell'IGF-Internet Governance Forum promosso dall'ONU Nel 2007 a Rio, Markus Kummer, Coordinatore esecutivo del Segretariato ONU per l'IGF-Internet Governance Forum, riconoscendo i timori di Vint Cerf disse «La legge del Mare ha richiesto circa 20 anni per negoziare il trattato. In Internet abbiamo bisogno di qualcosa di più urgente. Forse l'iniziativa dell'Internet Bill of Rights ci porterà più avanti». Il giorno precedente era stata firmata una dichiarazione congiunta dei governi brasiliano e italiano che indicava proprio nell'Internet Bill of Rights, la Carta dei Diritti per Internet, lo strumento per garantire libertà e diritti nel più grande spazio pubblico mai conosciuto. Poco dopo quella firma Gilberto Gil è tornato alla musica, il Brasile ha un nuovo Ministro alla Cultura ma non ha perso tempo e si è mosso con coerenza. Il Comitato per la Gestione di Internet, www.cgi.br. composto da membri di governo, imprese, terzo settore e dalla comunità accademica e basato su multilateralismo e trasparenza, ha approvato i principi guida per le sue decisioni e raccomandazioni, principi che vengono ora utilizzati nel processo aperto, coordinato dal Ministero della Giustizia, per approvare una serie di direttive e regolamenti per Internet. Questi i dieci principi fondamentali per Internet in Brasile: 1- L'uso di Internet deve essere guidato dai principi di libertà di espressione, privacy individuale e rispetto dei diritti umani; 2- La Governance di Internet deve essere trasparente, multilaterale e democratica, per preservare e promuovere il suo carattere di creazione collettiva; 3- L'accesso a Internet deve essere universale affinché sia uno strumento per lo sviluppo umano e l'inclusione sociale; 4- La diversità culturale deve essere rispettata,preservata e stimolata, senza l'imposizione di credenze, costumi e valori; 5- La Governance di Internet deve promuovere sviluppo e diffusione delle nuove tecnologie e dei modelli di accesso e uso; 6- Va garantita la neutralità delle Rete, senza filtraggi politici, commerciali, culturali e religiosi o qualsiasi altra forma di discriminazione o trattamento preferenziale;7- La responsabilità delle attività illecite è personale e non di chi offre i servizi di connessione e le piattaforme di comunicazione. Le azioni contro le attività illecite devono rispettare i principi fondamentali di libertà, della privacy, nel rispetto dei diritti umani;8- L'adozione di misure tecniche coerenti con gli standard internazionali per la stabilità della rete, la sicurezza e la funzionalità utilizzando le migliori pratiche; 9- Internet deve essere basata su standard aperti che facilitano l'interoperabilità per permettere a tutti di partecipare al suo sviluppo; 10- Gli ambienti giuridici e di regolamentazione devono preservare le dinamiche di Internet come uno spazio per la collaborazione. La stessa Commissione sulle Libertà Civili e la Giustizia del Parlamento Europeo aveva già esortato un anno fa tutti gli stakeholders della Rete all'impegno nel processo in corso per la carta dei Diritti di Internet: qualcuno se ne è accorto a Roma, dove il processo ebbe inizio? The Internet Steering Committee in Brazil - CGI.br, in its 3rd ordinary meeting of 2009 held in NIC.br headquarters in the city of São Paulo, has approved the following Resolution: CGI.br/Res/2009/03/P - PRINCIPLES FOR THE GOVERNANCE AND USE OF THE INTERNET IN BRAZIL Considering the need of support and orientation for its actions and decisions according to fundamental principles, the CGI.br decides to approve the following Principles for the Internet in Brazil: 1. Freedom, privacy and human rights The use of the Internet must be driven by the principles of freedom of expression, individual privacy and the respect for human rights, recognizing them as essential to the preservation of a fair and democratic society. 2. Democratic and collaborative governance Internet governance must be exercised in a transparent, multilateral and democratic manner, with the participation of the various sectors of society, thereby preserving and encouraging its character as a collective creation. 3. Universality Internet access must be universal so that it becomes a tool for human and social development, thereby contributing to the formation of an inclusive and nondiscriminatory society for the benefit of all. 4. Diversity Cultural diversity must be respected and preserved and its expression must be stimulated, without the imposition of beliefs, customs or values. 5. Innovation Internet governance must promote the continuous development and widespread dissemination of new technologies and models for access and use. 6. Network neutrality Filtering or traffic privileges must meet ethical and technical criteria only, excluding any political, commercial, religious and cultural factors or any other form of discrimination or preferential treatment. 7. Network unaccountability All action taken against illicit activity on the network must be aimed at those directly responsible for such activities, and not at the means of access and transport, always upholding the fundamental principles of freedom, privacy and the respect for human rights. 8. Functionality, security and stability Network stability, security and overall functionality must be actively preserved through the adoption of technical measures that are consistent with international standards and encourage the adoption of best practices. 9. Standardization and interoperability The Internet must be based on open standards that facilitate interoperability and enable all to participate in its development. 10. Legal and regulatory environments Legal and regulatory environments must preserve the dynamics of the Internet as a space for collaboration.
