UK IP Report Recommends Creating New Copyright Exceptions, Warns Against Over Regulation Wednesday May 18, 2011 The much-anticipated UK Independent Review of IP and Growth <http://www.ipo.gov.uk/ipreview>, typically referred to as the Hargreaves report, was released this morning. The report focuses on how intellectual property laws can stifle innovation and urges the UK government to enact reforms that remove legal barriers to economic growth (James Boyle, who served as expert advisor to the review, gives his take here <http://www.thepublicdomain.org/2011/05/18/the-hargreaves-review-is-publishe…>). For example, it notes: Because IPRs grant a form of monopoly, an overly rigid and inflexible IP framework can act as a barrier to innovation. When a firm has acquired exclusive rights over its innovative technology or content, other firms will be able to learn from that technology or see the content, but may be unable to use them for further innovation unless licensing can be agreed. IPRs can constrain third parties wishing to access or innovate on top of this protected knowledge or content, with potentially serious economic and social costs. The report also notes that a considerable amount of IP policy is often not based on economic evidence, citing as examples the EU database directive and the extension of the term of copyright. In fact, Sarkozy has stated for months his intention to use his presidency of the G8 to impose his concept of a “civilized Internet”. This notion, borrowed from the Chinese government, is in line with Sarkozy's record on Internet policy [1]. Last year on the international stage, Sarkozy also tried to impose the idea of nation-state control over the network's architecture, playing down the importance of the Internet for freedom of communication and democracy worldwide [2]. Recent events worldwide suggest that such an approach is gaining momentum internationally. The Internet black-out in Egypt, the US government's reaction to WikiLeaks [3], the ACTA agreement that will be signed during the G8, the adoption of website blocking mechanisms and talks about a “Virtual Schengen border” [4] in Europe, or plans for “Internet Kill Switches” are some of the numerous examples of governments trying to take over the Internet and its governance [5]. Citizens must react by holding their governments accountable and ensure that the Internet remains our most precious tool for improving societies. “In spite of a harmless-sounding rhetoric, the 'eG8 forum' is a smokescreen to cover the increased control of governments over the Internet. Creative action in defence of a free Internet against G8 plans

La Quadrature du Net has initiated an action with the Free Culture Forum, Boing-Boing, the Chaos Computer Club, Free Art & Technology (F.A.T), SAMUP (French Union of Musicians and Dancers), Telecomix and others. See : http://g8internet.com that calls everyone to produce creative / expressive pieces in all media to defend the free Internet and oppose plans to impose control, surveillance, kill switches, the Great European Firewall, ACTA, non-judiciary approaches to IPR enforcement (all at the menu of the G8 and its smokescreen predecessor the e-G8Internet) It is still time for organizations to join the list of initiators of the call, and everyone has until Next Tuesday to answer it creatively and disseminate it widely.
