The discussion on whether this should be distributed on the list is surrealist. The document is clearly an important position statement, and debating is substance should be the main focus of exchanges on the list. Let's first note that the pirates or the Greens are not the only people who believe that non-commercial sharing of all digital works should be recoognized as a legitimate practice. This is my strongly stated position (see http://paigrain.debatpublic.net/?p=1991&lang=en) and it is endorced by significant coalitions of artists, consumers and Internet freedoms groups (see http://creationpublicinternet.fr/blog/index.php?post/2011/06/28/The-proposa…) and included in the core programme of the socialist party in France, though one of the primary candidates (Hollande) has distanced himself from this position. Actually, the debate within the Greens were not even on this, but rather on the financing mechanisms that are necessary in addition to the recognition of sharing. It is on this point that one of the Pirate Party MEPs (Engstrom) has played a key role. The results are summarized here: §19- Non commercial sharing between individuals should be allowed, for instance by widening thescope of the existing private copying exception. If and when it can be proved that the production of cultural goods is compromised by non-commercial sharing, a content flat rate or another mechanismfor broadband users may be envisaged. Such a mechanism must not invade the privacy of internet users. The distribution of revenues should favour poor and starting creators. I have mixed views on this paragraph. I welcome the inconditional recognition of non-commercial sharing. I have strong doubts on the consequences of making it through an extension of the private copying exception. I understand that this is chosen because it appears to be possible without reopening the list of exceptions of 2001/29/CE, but in reality if seems to me much less practicable that approaches such as a return to a strong exhaustion of rights/first sale doctrine, or other schemes to delineate the scope of copyright as not applying to the non-commercial digital sphere practices of individuals. This will be no doubt debated, and in terms of implementation, it would be non-sense to exclude a path. History has shown that most important things often come thorogh strange doors. More seriously, what I truly object to I the statement that flat-rate mechanisms would be justified only if harm is done to the production of cultural goods. A statutory resource pooling can be established because it produces good, not only because it corrrects harm. I understand that Engstrom has been predominantly exposed to versions of flatrate proposals that were compensatory in nature (to harm resulting from sharing for the entertainment industry). But he did not listen much when people have tried to explain that statutory resource pooling is a key instrument for sustaining the non-market commons. Finally the references to the fact that user privacy should not be invded and the distribution of revenues should favour poor and staring creators are most welcome, though of course, it is the how that is the real challenge. Two additional comments : - I am infuriated that either TorrentFreak or the Green used Scribd that is text streaming requiring a Facebook account for download for a public policy text. How can they do a snesible cultural policy if they use such tools ? - It is very surprising that anyone would oppose the Creative Commons approach to the legal recognition of sharing and would state that the first is "legal" and the second not (through association with pirates). Ciao Giuseppe, grazie molte dei chiarimenti. Se mi concedi una super-sintesi, la frase chiave del tuo messaggio mi sembra essere: "mi sembra esagerata l'enfasi che si è posta in questa lista sulle proposte di questo Partito" messaggio poi ripetuto in: "ennesima finestra dedicata in questa lista alle idee del suddetto partito". Solo che questa e' una lista pubblica in cui chiunque, a partire dal sottoscritto, segnala ciò che vuole (senza necessariamente fare l'endorsement di cio' che posta, ovviamente), purche' sia pertinente al tema "internet & società". Se a te dispiacciono messaggi che riguardano il partito pirata, a mio avviso uno dei fenomeni politici internet-based e internet-related in assoluto piu' importanti di questi ultimi anni (piaccia o non piaccia il loro messaggio politico), lo capisco; anche a me non interessano certi argomenti. Ma basta che non leggi tali messaggi. O criticane aspramente il contenuto, come hai appena fatto con la perizia che ti contraddistingue. Ma di messaggi sull'argomento non puoi sperare che ne passino pochi o tanti: ne passano quanti ne passano. Tu posta pure le proposte di altri "think tank o entità politiche in grado di proporre riforme sensate e evolutive del diritto d'autore": fara' moltissimo piacere ad altri in lista, a partire da me. Io stesso, quando ne trovo, segnalo cose analoghe, dall'Hargreaves Report a moltissimi altri link (check the archive). Riguardo a proposte piu' o meno "realistiche", a parte il fatto che trovo molto limitante discutere solo di opzioni "realistiche", il mio co-direttore Marco Ricolfi ha proposto una riforma del copyright (etichettata "copyright 2.0") che richiede nientemeno che la modifica di Berna [1]: anche la sua proposta sarebbe quindi inadatta a venir discussa in questa lista? Infine riguardo a Creative Commons, l'unico collegamento che riesco a immaginare tra l'articolo TorrentFreak e le tue osservazioni e' che io, Juan Carlos, discuto di partito pirata (come di mille altre cose) pur essendo allo stesso tempo legato a CC: e allora? Basta questo a rischiare di confondere CC e PP? Non credo proprio. Se qualcuno facesse tale connessione su basi cosi' fragili, il problema Rebbeccaz suo, non mio (o nostro). Or phrased differently, DRM appears to be an incentive for people to pirate music instead of buying it. Ciao Juan Carlos, cerco di chiarire la mia posizione, come mi chiedi. Premetto di aver scritto l'email ieri sera senza aver letto il position paper dei Verdi, ma avendo semplicemente letto l'articolo di TorrentFreak che hai segnalato. Ho avuto modo di leggere il position paper soltanto stamattina. 1. Non ho mai detto o scritto che il Partito Pirata non possa avere e/o promuovere le sue idee sul diritto d'autore. Dico solo che mi sembra esagerata l'enfasi che si è posta in questa lista sulle proposte di questo Partito, come se fosse l'unica entità politica o "think tank" in grado di proporre riforme sensate e evolutive del diritto d'autore. A un certo punto si è pure proposto di prendere il PP a modello per la formazione di un nuovo movimento politico in Italia. Risposi in quell'occasione che l'idea non mi convinceva per nulla. 2 & 3. Nell'articolo che hai segnalato mi è parso che le posizioni dei Verdi sul diritto d'autore, che l'articolo riporta in modo parziale, siano state strumentalizzate da Christian Engstrom (PP), che ha pure detto che il Partito Pirata e i Verdi propongono le stesse riforme del diritto d'autore (a questo mi riferivo accennando alle giacche "tirate"). Ciao Giuseppe, ti confesso che diversi aspetti del tuo intervento mi lasciano perplesso. E' sicuramente colpa del jet-lag che mi affligge, ma nel dubbio provero' comunque a elencare i punti di perplessita' in ordine di apparizione: 1. perche' il Partito Pirata - come chiunque altro - non puo' avere - e quindi promuovere - le sue idee sul diritto d'autore? O stai dicendo che non ti piace che se ne parli in questa lista? 2. perche' le posizioni dei Verdi sarebbero "sparate"? 3. Dal momento che sono anni che i Verdi si occupano di questi temi (come in precedenza di brevetti software, di sofware libero, ecc.), perche' immagini "giacche tirate"? 4. su questa lista di discute (secondo me seriamente ma non sta a me dirlo) di diritto d'autore: quindi perche' inviti a farlo? O pensi che articoli come quello da me segnalato non siano sufficientemente "seri"? Nel caso, cosa intendi allora tu per "serio"? 5. cosa c'entra Creative Commons? Ho riletto tutto l'articolo di TorrentFreak, per accertarmi che non mi fosse per caso sfuggito un accenno a CC, ma in effetti, no, non e' mai menzionato. 6. non essendo mai menzionato CC, perche' mai i due "movimenti" dovrebbero rischiare di confondersi? The overall theme is a reduction of the copyright monopoly to the benefit of consumers. Among other things the Greens want to legalize file-sharing for personal use, ban DRM entirely and restrict the copyright term to five years. The group currently hold 57 seats, including one Pirate Party seat held by Christian Engstrom. The paper goes directly against the current trend of increasing control over copyright, and calls for a society that secures the interests of the public instead of a few multi-million dollar companies. One of the key proposals is to legalize file-sharing for personal use. "Non commercial sharing between individuals should be allowed, for instance by widening the scope of the existing private copying exception," the Greens write. In addition, restrictive technologies such as DRM should be banned entirely, or at least decriminalized. "It must always be legal to circumvent DRM restrictions, and we should consider introducing a ban in the consumer rights legislation on DRM technologies that restrict legal uses of a work," the paper reads. "There is no point in having our parliaments introduce a balanced and reasonable copyright legislation, if at the same time we allow the big multinational corporations to write their own laws, and enforce them through technical means," it adds. The Greens also want to reduce the copyright term from 70 to 5 years, with an option for copyright holders to extend it to a maximum of 20 years. The Greens call the current situation "absurd" and argue that society will greatly benefit from a more reasonable copyright term. "Today's protection times --- life plus 70 years --- are absurd. No investor would even look at a business case where the time to pay-back was that long," they write. Overall the paper suggests a reduction in the current stranglehold on creativity and a boost for the Internet to allow it to show its full potential. According to the Greens this also means that Net Neutrality should be guaranteed, and that remixes and mashups of copyrighted works for commercial use should be allowed.
