Resoconto audizione di Nexa in Agcom 25.10.2011

Cari tutti,**** vi scrivo per darvi alcune brevi informazioni riguardo l’audizione di Nexa, tenutasi avantieri in Agcom, ove eravamo presenti il Prof. Ricolfi ed io.*** * **** In apertura, la dott.ssa Cappello di Agcom ci ha illustrato lo stato dell’iter della seconda consultazione pubblica, informandoci che proprio nella giornata del 25 u.s. si sarebbero concluse le ultime audizioni (circa 50 in tutto) e che la Comunità europea, a cui è stato notificato lo schema di regolamento, non ha ancora comunicato alcuna osservazione al riguardo, seppure è in prossima scadenza il termine previsto di 90 giorni.**** **** Il Prof. Ricolfi ha aperto la discussione, ribadendo la forte perplessità di Nexa circa l’esistenza di una fonte legislativa che conferisca all’Autorità il potere regolamentare in materia di diritto d’autore digitale.**** Tale tematica non è stata però oggetto di dibattito da parte della dott.ssa Cappello, la quale ha confermato l’orientamento dell’Agcom a rinvenire nella triangolazione di norme, a noi note, un legittimo potere.**** La soluzione della questione, se del caso, sarà oggetto di un futuro orientamento giurisprudenziale.**** **** A seguire, ho preso la parola io, esaminando le precise proposte di modifica dell’articolato del regolamento: le definizioni, il contraddittorio, le eccezioni e limitazioni, la composizione dei tavoli tecnici e, in particolare, quello dedicato allo studio delle licenze collettive estese e così via.**** **** La discussione è stata molto stimolante per entrambi le rappresentanze.**** Il Prof. Ricolfi ha offerto all’Agcom spunti per rimediare ad alcuni difetti dell’ultima versione dell’emanando regolamento, anche in relazione alle libere utilizzazioni ed all'individuazione dei corretti parametri al fine di individuare la nazionalità dei siti indirizzati.**** **** Su richiesta degli amici di sitononraggiungibile, abbiamo sollecitato anche noi l’opportunità di istituire un tavolo di studio sul danno da pirateria (ad uso personale).**** **** Come di consueto, siamo in attesa di ricevere il verbale dell’audizione, che avremo modo di integrare e correggere.**** **** Resto a vostra disposizione per ogni ulteriore chiarimento.**** **** Deborah De Angelis**** ** ** **

Anche se in lista il discorso si è arenato in questi periodo, insieme all'Associazione Partito Pirata, abbiamo messo giù una prima bozza di manifesto e punti programmatici, che comunque sarà da meglio definire ed articolare in modo aperto in Rete, e tenuto al corrente Agorà Digitale. http://www.piratpartiet.it/mediawiki/index.php?title=PROGRAMMA_ELETTORALE Faccio presente che al congresso di Radicali Italiani, che si tiene a Chianciano Terme dal 29 ottobre al 1 novembre, è in programma una commissione in due sessioni (h. 21-24 del 29 e h. 09-12 del 30) in cui sarà si discuterà anche di questa cosa per cercare di capire come meglio organizzarci e su quale eventuale tipo di supporto si potrebbe avere da Radicali Italiani. Quindi se in lista qualcuno è interessato direi che sarebbe bene esserci in questa occasione. Non mancheremo comunque di tenervi in seguito informati e comunque sarà occasioni di aggiornarci all'IGF di Trento. PS Oggi Athos mi ha fatto notare questo sito http://www.pirateparty.it/avvisandomi che lui non potrà essere a Chianciano in quanto il 29 andrà a seguire questo incontro http://www.pirateparty.it/?p=222 per capire meglio chi sono costoro. Released Neubot 0.4.4

Released Neubot 0.4.4 http://www.neubot.org/neubot-0.4.4 Version 0.4.4 is the latest generally-available stable release of Neubot, distributed for Ubuntu >= 10.04, MacOSX >= 10.6,Windows >= XP SP3 and FreeBSD. (Yes, Neubot was recently added to FreeBSD ports collection!) Of course, Neubot 0.4.4 is also available in source format (.tar.gz and .zip). This release contains 127 patches. The diffstat says: 114 files changed, with 3162 lines inserted and 3832 lines deleted. Here are the most relevant changes: o update to privacy policy 1.5. Privacy policy v1.0 allowed Neubot to collect users' Internet address without users' explicit consent, thanks to special provisions that allow researchers to do that. And, while MacOSX installer asked for user permission, other platforms were still exploiting such special provisions by default. The novelty of this release is that special provisions are gone and Neubot does not perform any test until the user provides her explicit and informed consent. Of course Neubot notifies the user when it has not enough permissions to run its tests. For example, under Windows it opens privacy.html in the default web browser and shows an explanatory message. This is somewhat brute force and I look forward to make Windows installer similar to MacOSX one. Similarly, under Ubuntu and Debian it uses libnotify bindings to inform the user that the informed consent is missing. (I initially tried to ask for consent in the installer using debconf, but did not managed to make it work with Ubuntu Software Center. So I fell back to libnotify.) Note that libnotify bindings are not listed in the package dependencies. Which is a problem for Debian machines where libnotify bindings are not installed. (While Ubuntu installs such bindings by default.) I decided not to list libnotify into dependencies because I look forward to spin off a neubot-x11 package that contains all the graphical commands and lists all dependencies. Finally, if none of the above method works or you installed from sources, Neubot will print warnings on the standard error and/or on the system log. We removed special provisions because we want to always show people the policy and we hope that helps to have as much people as possibile give Neubot the permission to share the IP address (and hence the results) with other researchers. The availability of third party studies from independent researchers will benefit both Neubot authors and users. By the way, I've also received some insightful comments on the privacy policy from Eleonora Bassi. And I am working to implement those suggestions to further clarify the privacy policy. But did not managed to include them in 0.4.4. o debian pkg: reenable repository after Ubuntu upgrade. Thanks to Davide Allavena, who reported the bug, I am now aware that Ubuntu disables third party repos during an upgrade. So I've lifted some code from Google Chrome debian package to reenable Neubot repos after an upgrade. Ubuntu users should check whether Neubot repos was disabled during an upgrade and reenable it. Or they can simply manually install this version of Neubot, which includes the fix for the problem. o Ubuntu: removed status icon. I've removed the status icon code. The reason is that desktops are moving towards removing the notification area and replacing it with libnotify-like notifications. o Ubuntu: merged neubot_webkit with the open browser code and renamed it neubot_gui. I realized that it was possibile to fallback to opening the default browser when webkit is not available. So I merged already existing code to do that with the existing webkit code. And changed the name because now the scope of the program has changed too. (BTW this command will be the foundation of the above mentioned neubot-x11 pkg.) o Ubuntu: more debian-compliant package While working on the above-mentioned debconf-enhanced debian installer, I've used pylint to clean up the debian package as much as possible. There are some open issues but overall the quality of the package has increased a lot in this release. (Having a 100% compliant package is a necessary condition to ask Debian folks to add Neubot to the official Debian repositories.) o Windows: do not install package with "root" privileges so we can start it again at the end of the installation. In Neubot 0.4.2 I noticed that the installer was starting Neubot up with "root" privileges and disabled that. In this release I've modified the installer to always run as an ordinary user. Which allows to safely start Neubot at the end of the installation. Please, note that this means the new installer cannot uninstall automatically old Neubot packages because it is not privileged. If you have installed an old version of Neubot, you should uninstall that before installing this new version. (If you don't, the installer will abort and tell you that it cannot proceed until you remove at hand the old version.) Now Neubot is installed into the user profile directory, e.g. for me:: C:\Documents and Settings\simone\Neubot\ An additional reason behind installing Neubot for each user is that I'm going to implement autoupdates. And I don't want to take the security risk of running such autoupdates with high privileges. Given that I'm not a Windows expert and that seems not a trivial task. o more code rationalizations, bug and reliability fixes, unit tests. The release candidates have been tested on Ubuntu 10.10, Windows XP SP3, Windows 7 and MacOSX 10.6.8. Andrea -------- Call for Papers Policy and Internet Special Issue on "Online Collective Action and Policy Change" Guest Editors Andrea Calderaro (PhD, European University Institute) Anastasia Kavada (PhD, University of Westminster) Policy and Internet, the first major peer-reviewed multi-disciplinary journal investigating the impact of the internet on public policy, is inviting submissions for a special issue on 'Online Collective Action and Policy Change', to be published in January 2013 (paper deadline: 31 March 2012). The journal is edited by the Oxford Internet Institute (University of Oxford) for the Policy Studies Organization (PSO). Please find more at: http://www.oii.ox.ac.uk/news/?id=595 The Internet has created a new interface between collective action and policy making: it opens new channels for social coordination and mobilisation, and it offers multiple platforms from where to influence public opinion and policy makers. The recent wave of protests that has swept authoritarian regimes like Tunisia, Egypt, and Libya, but also western liberal democracies like Greece, Spain, and the UK, offers new empirical evidence of the impact that online interactions and information exchange can have on policy making. In addition to these recent instances of contentious politics, advocacy and grassroots groups are increasingly using online technologies to empower local communities and direct change in the policies that most affect them. And issues at the heart of online governance, like Internet regulation, are motivating many collective efforts directed to shaping file-sharing policies, free software, or digital communication rights. This special issue calls for academic papers reporting novel empirical research on how online collective action drives policy change, in any of its ramifications. This includes topics such as: - The coordination of protests and mobilisations using online technologies, and their impact on public opinion and policy making. - The mechanisms through which online collective action grows and diffuses, and how or when they trigger a policy reaction. - The impact of online activity on issue salience, and the responsiveness of policy makers. - The interplay between online collective action and the offline policy cycle, or how policy makers deal with new sources of instability and disruption. This list of topics is not exhaustive, and other questions related to online collective action and its impact on policy making will be considered.
