Se un tweet diventa la prova per una condanna

Marina STATI UNITI IL CASO DI UNO SCRITTORE ATTIVO AD OCCUPY WALL STREET APRE UN DIBATTITO SULLA LEGGE, SOCIAL NETWORK E DIRITTO ALLA PRIVACY Se un tweet diventa la prova per una condanna Un giudice: come un urlo alla finestra La società si oppone: messaggi privati IDEE & OPINIONI se il Cinguettio di Twitter va in Tribunale la Responsabilità non è del Social Network Dichiaro volentieri la mia simpatia, umana e politica, per i ragazzi di Occupy Wall Street, nonché il dubbio (del tutto personale e «a pelle») che il reato per cui procede un giudice americano, che vuole accedere ai cinguettii del manifestante Malcolm Harris, possa risultare, in ultima analisi - in barba alla stessa Costituzione Usa - «di opinione» e/o «di manifestazione». Ciò non mi esime tuttavia dal riconoscere, sul piano del diritto positivo, che il magistrato penale ha certamente il potere di ordinare a un social network, così come a un provider, così come a qualsiasi ente in legittimo possesso di dati identificativi di un indagato, di trasmettere tali dati, appunto, all' autorità giudiziaria richiedente. Se una ragazza sia bersagliata da telefonate oscene e denunci il fatto, non può forse il pubblico ministero chiedere alla società telefonica di trasmettergli il numero e quindi i dati del titolare della scheda del cellulare da cui sono partite le telefonate? Anzi, può anche disporre il sequestro di tali dati. Né entra in gioco, nel caso dei social network, il diritto di riservatezza sulle fonti dell' informazione, goduto da giornali e altri media. I social network non sono organi di informazione. Sono «bacheche» in cui i privati «postano» i loro messaggi ad altri privati. Se tali messaggi integrino ovvero rivelino la commissione dei reati, tali privati ne risponderanno personalmente: essi soli, non (salvo i casi di comprovata complicità) i social network o i provider. Nell' esempio fatto sopra, la società telefonica non è certo responsabile per le telefonate oscene dello stalker. Non credo quindi, in conclusione, che vi sia spazio credibile per un rifiuto di Twitter di comunicare al magistrato i dati dell' indagato. La cosidetta «facoltà di non rispondere» riguarda chi è sottoposto a indagini, non il social network. Naturalmente ciò non esclude che l' indagato (e anche il social network) possano a loro volta denunciare il magistrato per abuso d' ufficio, ove dimostrino che quel magistrato in realtà persegua/perseguiti manifestazioni di opinione e/o di manifestazione, la libertà delle quali è costituzionalmente garantita. Niente di privato, tutto pubblico. Quindi utilizzabile in tribunale se l' urlo - il tweet - può essere una prova (a maggior ragione se costituisse un reato). Controversa affermazione. Infatti, il giudice della seconda corte criminale di Manhattan che l' ha fatta, Matthew Sciarrino, ha dato il la a una gran discussione: si tratta di mettere ciò che si scrive su Twitter sullo stesso piano di un manifesto pubblico o di un articolo di giornale, secondo una logica tradizionale, oppure si tratta di essere «moderni» e considerare i social network qualcosa di privato, come una email? Il caso ha origine il 1° ottobre 2011, quando una manifestazione organizzata da Occupy Wall Street bloccò il ponte di Brooklyn: 700 persone furono arrestate. Tra queste Malcom Harris, scrittore di 23 anni, che fu accusato di «condotta turbolenta». Harris si difende dicendo che, in realtà, fu la polizia a spingere i manifestanti sulla carreggiata. L' accusa sostiene invece che le modalità della manifestazione furono preparate in precedenza dal movimento Occupy e per questo ha chiesto a Twitter di produrre in tribunale i messaggi postati da Harris nei giorni precedenti (e successivi), ormai scomparsi dal social media. La società si è opposta sostenendo che le persone che twittano hanno la ragionevole aspettativa di avere la privacy protetta secondo il quarto emendamento della Costituzione, proprio come chi scrive una email. Il giudice Sciarrino ha respinto l' argomentazione: ha ammesso che le interpretazioni legali sulla privacy online sono in evoluzione ma ha negato che chi scrive un tweet possa avere «ragionevoli aspettative» di privatezza. «La Costituzione ti dà il diritto di postare - ha scritto nella sentenza - ma, come numerose persone hanno imparato, i tuoi post pubblici hanno comunque conseguenze. Quello che dai al pubblico appartiene al pubblico. Quello che tieni per te stesso appartiene a te stesso». Risultato, Twitter deve consegnare al tribunale i messaggi scritti da Harris tra il 15 settembre e il 30 dicembre 2011, in particolare (ma non solo) quelli gestiti come @destructuremal. La questione sottolinea un problema serio nell' adeguamento della legge alle nuove tecnologie, area ancora piuttosto grigia. Secondo il professor Orin Kerr, che insegna Legge alla George Washington University, il parere del giudice Sciarrino è giustificato. «È l' equivalente di chiedere a un testimone cosa una persona ha detto - sostiene -. È un semplice spostamento, dal domandare a un testimone a domandare a Twitter: la nuova versione di un vecchio problema». Questo per lo schieramento tradizionalista. L' avvocato di Harris, al contrario, ha definito l' opinione del giudice «non molto Ventunesimo Secolo e con radici nella vecchia legge». Twitter, per parte sua, non si sente affatto un testimone: ha sostenuto di non avere diritto di utilizzare i tweet scritti dagli utenti e quindi di non avere l' obbligo di consegnarli agli inquirenti. L' avvocato del social network, Ben Lee, ha detto nel corso delle udienze che i termini di utilizzo di Twitter «rendono assolutamente chiaro che gli utenti sono proprietari dei loro contenuti» e che la società vuole difendere questo diritto. Nella discussione è entrata anche la American Civil Liberties Union. Dice che, per ottenere informazioni dai social network, le autorità inquirenti devono sempre chiedere un mandato al giudice e che la persona indagata deve avere la possibilità di opporsi in tribunale alla richiesta. Sull' altro versante, gli inquirenti sono soddisfatti: potere accedere ai dati di Twitter, di Facebook e simili significa avere a disposizione uno strumento investigativo potente, capace di ricostruire eventi e di individuare luoghi e tempi. La conferenza 'It’s All About Rights, Right? A Worldwide Copyright Picture in the digital age’ - ‘E’ una solo una questione di diritti, giusto? Grazie alle moderne tecniche di analisi delle reti complesse, infatti, siamo in grado oggi di sfruttare al massimo l'enorme mole di dati che proviene da questi strumenti, che forniscono i loro servizi in base alle informazioni che gli utenti, in modo del tutto spontaneo, contribuiscono a creare. Tra le informazioni che gli utenti condividono pubblicamente o anche solo all'interno della rete delle proprie amicizie, ci sono spesso le *coordinate geografiche relative alla posizione dell'utente*. Questo pone enormi opportunità di cui non si può non tenere conto, una tra tutte la possibilità per il cittadino di *partecipare "dal basso" in maniera attiva alla vita della propria comunità di appartenenza*, fornendo consigli agli amministratori locali, segnalando disfunzionalità dei servizi pubblici, individuando eventi nelle proprie circostanze che possono essere d'interesse per le persone nelle vicinanze. Ovviamente, questo crea anche problemi di *privacy* e d'identificazione da parte di altre persone non autorizzate, spesso in modo del tutto inconsapevole per l'utente stesso, dato che si riesce a risalire e forse a prevedere la posizione di una persona in base ai movimenti degli appartenenti della sua rete di amicizie. Durante il seminario il prof. Ruffo discuterà di alcuni risultati dell'attività scientifica del proprio gruppo di ricerca (ARCS - Applied Research on Computational Complex System <http://arcs.di.unito.it>) che hanno permesso di capire alcuni aspetti fondamentali sulla percezione che gli utenti ricevono riguardo all'uso dei social media. Inoltre, verranno presentate alcune domande di ricerca la cui soluzione, probabilmente, sarà critica nei prossimi anni. *Biografia*: *Giancarlo Ruffo* è professore associato di Informatica presso l'Università degli Studi di Torino dal 2006 e "Adjunct Professor" presso la "School of Informatics and Computing" dell'Indiana University dal 2011.
