Eben Moglen's series of talks "Snowden and the Future" at the Columbia Law School

by David Orban

Esposizione estremamente chiara e appassionata Eben Moglen's series of talks "Snowden and the Future" at the Columbia Law School is a must see for those interested in decoding our societies' interaction with technology, and freedoms. http://snowdenandthefuture.info/ "What has Edward Snowden done to change the course of human history? How does the evolution of surveillance since World War II threaten democracy? What does it mean that information can be both so powerful and so easily spread? In a network embracing all of humanity, how does democracy survive our desire for security? Eben Moglen is the Founder of the Software Freedom Law Center, Columbia law professor and historian. He received the 2003 EFF pioneer award for his role in legalizing software encryption and defending free software. He was clerk to Justice Thurgood Marshall of the US Supreme Court during 1986–87." Two talks are already available as video, audio and text: http://snowdenandthefuture.info/PartI.html http://snowdenandthefuture.info/PartII.html Part 3 is going to be held on Nov 13, and Part 4 on Dec 4. The Data Surveillance State in the US and Europe

by Alessandro Mantelero

per chi fosse interessato The Data Surveillance State in the US and Europe Joel Reidenberg Princeton University - Center for Information Technology Policy; Fordham University School of Law November 2, 2013 Wake Forest Law Review, Forthcoming Abstract: The democracies on both sides of the Atlantic are trying to balance the legitimate needs of the law enforcement and intelligence communities to access online transactional data with the basic rights of citizens to be free from state intrusions on their privacy. From the recent revelations of massive collection of telecommunications data by the US government to the disclosures of the UK tapping transatlantic telecommunications cables, and of the Swedish government’s warrantless wiretap rules, national data surveillance seems to have few boundaries that the law has effectively protected. American law has generally focused on access restraints for government to obtain privately held information, ignored the collection and storage of data, and granted special privileges to national security actors. By contrast, Europe emphasizes rules related to the collection and retention of data and focuses less on due process obstacles for government access, while also giving government easier access for national security. In each system, the elusive linkage between retention and access, the privatization of state surveillance activity, and flawed oversight for national security create extensive transparency of citizen’s data and undermine values of democracy including the presumption of innocence, the state’s monopoly on law enforcement, and the zone of individual freedom. In effect, government data surveillance law in both Europe and the United States has reached a turning point for the future of information privacy online. Three proposals can help to secure privacy that is necessary to preserve democratic values: stricter retention limits must be combined with stronger access controls; government access to personal information must be logged and transparent to citizens; and government officials must be personally liable for over-reaching behavior.

Re: [nexa] Wired: "We’re About to Lose Net Neutrality — And the Internet as We Know It"

by J.C.

Ha attirato molto la mia attenzione questa affermazione: The implications of such a decision would be profound. Web and mobile companies will live or die not on the merits of their technology and design, but on the deals they can strike with AT&T, Verizon, Comcast, and others. This means large phone and cable companies will be able to “shakedown” startups and established companies in every sector, requiring payment for reliable service. Giorgio ======================================================================== Prof. Ing. Berkman Center Webcast live oggi ore 18.30 - The Fight for the Future: How People Defeated Hollywood and Saved the Internet--For Now

by Giuseppe Futia

The Fight for the Future: How People Defeated Hollywood and Saved the Internet--For Now http://cyber.law.harvard.edu/events/luncheon/2013/11/lee * Edward Lee, Professor of Law & Director of the Program in Intellectual Property Law at IIT Chicago-Kent College of Law* Today, 6.30 pm Webcast live: http://cyber.law.harvard.edu/interactive/webcast http://nexa.polito.it/berkman-webcast-live This talk will explain how a grassroots movement involving millions of people was able to defeat money, politicians, Hollywood, and the copyright lobby, all in the name of a "free and open Internet." People used Facebook, Twitter, other social media, blogs, and websites to organize and launch protests against SOPA and ACTA, two controversial copyright proposals in the United States and European Union that many feared would lead to Internet censorship. Participants will learn how the Internet helped people fight for their Internet freedoms--and do the unthinkable in stopping powerful lobbyists and the entertainment industry in their effort to clamp down on online piracy at all costs. About Ed Edward Lee is a Professor of Law and the Director of the internationally recognized Program in Intellectual Property Law at IIT Chicago-Kent College of Law. He graduated summa cum laude from Williams College with a bachelor's degree in philosophy (highest honors) and classics, and cum laude from Harvard Law School. His Boston Review article The Day Wikipedia Went Dark was published on the one year anniversary of the Wikipedia blackout. As a contributor to the Huffington Post, he has written various articles related to the Internet, copyright, and pop culture. As a law professor, he has written extensively about free speech and copyright law, and the history of the freedom of the press. Previously, he worked with Lawrence Lessig at the Stanford Center for Internet and Society, including on Eldred v. Ashcroft and Golan v. Holder, two of the most significant cases involving the First Amendment and copyright law. We’re About to Lose Net Neutrality — And the Internet as We Know It * By Marvin Ammori <http://www.wired.com/opinion/author/mammori/> * 11.04.13 * 9:30 AM Net neutrality is a dead man walking. The execution date isn’t set, but it could be days, or months (at best). And since net neutrality is the principle forbidding huge telecommunications companies from treating users, websites, or apps differently — say, by letting some work better than others over their pipes — the dead man walking isn’t some abstract or far-removed principle just for wonks: It affects the internet as we all know it. Once upon a time, companies like AT&T, Comcast, Verizon, and others declared a war on the internet’s foundational principle: that its networks should be “neutral” and users don’t need anyone’s permission to invent, create, communicate, broadcast, or share online. Walzer: "La talpa Snowden è un eroe. Negli Usa la democrazia è a rischio"

by J.C.

* [...] Continua qui: http://www.repubblica.it/esteri/2013/11/04/news/datagate_michael_walzer_sno… *

WPost: "How we know the NSA had access to internal Google and Yahoo cloud data"

by J.C. DE MARTIN

*How we know the NSA had access to internal Google and Yahoo cloud data** * BY BARTON GELLMAN, ASHKAN SOLTANI, AND ANDREA PETERSON November 4 at 3:03 pm The Washington Post reported last Wednesday that the National Security Agency has been tapping into the private links that connect Google and Yahoo data centers around the world. Today we offer additional background, with new evidence from the source documents and interviews with confidential sources, demonstrating that the NSA accessed data traveling between those centers. The background also helps explain the response of U.S. officials following the publication of the story. The U.S. government declined repeated requests to discuss the story beginning eight days before it was published. Since publication it has made four responses.
