Suggestioni da Joy Marino, David Orban

by giorgio.giunchi＠cctld.it

by Guido Noto La Diega

http://useu.usmission.gov/st-09282015.html Safe Harbor Protects Privacy and Provides Trust in Data Flows that Underpin Transatlantic TradeStatement | Brussels, Belgium | September, 28 2015 The United States Government and the European Commission have been engaged in a very productive and substantial dialogue to improve and strengthen the Safe Harbor Framework. The framework has been critically important to the protection of individual privacy and the conduct of commerce on both sides of the Atlantic; it has served and continues to serve as a model around the world for the protection of individual privacy and flow of data across national borders. We are optimistic that our discussions will conclude soon with a positive outcome for both sides. The future of the Safe Harbor Framework, however, has now been called into question by the Advocate General's recent opinion in Maximillian Schrems v. Data Protection Commissioner. We fully respect the European Union's legal process; however, we believe that it is essential to comment in this instance because the Advocate General's opinion rests on numerous inaccurate assertions about intelligence practices of the United States. The Advocate General's opinion notes that it was required to accept the facts as found by the Irish High Court. There was, however, no actual fact-finding in this case; instead, the Irish High Court concluded, on the basis of exhibits to plaintiff's affidavits that the accuracy of his allegations regarding U.S. intelligence practices "is not in dispute." But that is simply not the case, as the public record made clear at the time, and as has been made even clearer in the subsequent two years. The United States does not and has not engaged in indiscriminate surveillance of anyone, including ordinary European citizens. The PRISM program that the Advocate General's opinion discusses is in fact targeted against particular valid foreign intelligence targets, is duly authorized by law, and strictly complies with a number of publicly disclosed controls and limitations. Moreover, the Advocate General's opinion fails to take into account that -- particularly in the last two years - President Obama has taken unprecedented steps to enhance transparency and public accountability regarding U.S. intelligence practices, and to strengthen policies to ensure that all persons are treated with dignity and respect, regardless of their nationality or place of residence. The Advocate General's opinion also errs in inviting the European Court of Justice to conclude that the current Safe Harbor Framework is inadequate because the United States and the European Commission are positively engaged in an effort to strengthen it. On the contrary, the Framework was conceived as a living document, and this is not the first time that the two sides have engaged to improve its operation. On both sides, there has been a strong desire to make sure that we improve the Framework, and these efforts should be encouraged. Moreover, the underlying issue here also goes far beyond the Safe Harbor Framework. The Advocate General's reasoning would undercut the ability of other countries, businesses and citizens to rely upon negotiated arrangements with the European Commission. Given the important privacy and trade benefits that Safe Harbor provides to EU and US citizens and businesses, we will continue to work closely with the European Commission to improve the Safe Harbor Framework. We hope that the final judgment of the European Court of Justice takes note of these efforts, inaccuracies in and far-reaching consequences of the Advocate General's opinion, as well as the significant harm to the protection of individual rights and the free flow of information that would occur if it were to follow the Advocate General's opinion. -- *Guido* Dr. Guido Noto La Diega <http://www.law.qmul.ac.uk/staff/notoladiega.html>, Postdoctoral Research Assistant in Cloud Computing Law <http://www.cloudlegal.ccls.qmul.ac.uk/project/researchers/index.html> - Queen Mary Universityof London <http://www.mccrc.eu/Pages/Research-Team.aspx> President of Ital-IoT <http://italiot.altervista.org/about-us/> - Centre of Multidisciplinary Research on the Internet of Things Avvocato <http://www.studioperrino.it/intro/index.asp> (Commercial and IP/IT Lawyer) Cultore della materia in Civil Law and Intellectual Property <http://www.unipa.it/persone/docenti/n/guido.notoladiega> - University of Palermo 67-69 Lincoln's Inn Fields London WC2A 3JB g.notoladiega(a)qmul.ac.uk +44(0)2078823386 @gui_notoladiega https://it.linkedin.com/pub/guido-noto-la-diega-ph-d/6/614/669 This e-mail and any attachment hereto are strictly confidential and are exclusively intended for the person above identified. Berkman Center Webcast live oggi ore 18 - The Mozilla Delphi Cybersecurity Study: Towards a User Centric Cybersecurity Policy Agenda

by Giuseppe Futia

The Mozilla Delphi Cybersecurity Study: Towards a User Centric Cybersecurity Policy Agenda https://cyber.law.harvard.edu/events/luncheon/2015/09/Francois *with Camille François, Josephine Wolff, Andy Ellis, and Bruce Schneier* Today, 6.00 pm Webcast live:http://cyber.law.harvard.edu/interactive/webcast http://nexa.polito.it/berkman-webcast-live <http://nexa.polito.it/berkman-webcast-live> Join us on September 29th for a discussion of the "Mozilla Delphi Cybersecurity 1.0. Study: Towards A User Centric Policy Framework," presented by lead researcher Camille François with Berkman community members Josephine Wolff, Andy Ellis, and Bruce Schneier, who participated in the study. Camille worked for several months with the Mozilla Foundation to orchestrate the study and resulting report. The study used a modified version of the Delphi research technique. More than 30 leading cybersecurity experts from a wide variety of backgrounds – including academia, civil liberties, government and military, security, and technology – participated in the study. Using a pseudonymous format to encourage candid feedback and open dialogue on the issues, the study tackles the following questions: what is the role of policy in cybersecurity? How consensual is the definition of cybersecurity? What are the current priorities for cybersecurity policy? Which issues get too little or too much attention? What are measures that a diverse set of cybersecurity actors can agree on as being both feasible and desirable? The study produced a map of priorities, issues, and solutions for cybersecurity that highlights consensus and dissensus in the space. Join us to discuss the lessons learned in this process and the report's findings. About Camille Camille François is a researcher and consultant on cyber policy, with a focus on questions relating to cybersecurity, human rights and state interactions in cyberspace. A Fellow at the Harvard Berkman Center for Internet & Society from 2013-2015, Camille focuses her work on the building of norms for cyber peace and rights-respecting cybersecurity policies, and related questions in the robotics field. She has led initiatives with institutions such as the French Prime Minister Office Task Force on Open Data & Open Government; the Mozilla Foundation; the U.S. Defense Advanced Research Projects Agency (DARPA); as well as Google, the French-American Foundation & the Software Freedom Law Center. She serves as a member of the Freedom Online Coalition international Working Group on An Internet Free and Secure. Camille has also been involved in a wide range of free culture advocacy projects and serves as a Digital Advisor for Libraries Without Borders and on the Scientific Committee of the French Wikimedia Foundation. A Fulbright Fellow, Camille holds a Masters Degree in Human Rights from the French Institute of Political Sciences (Sciences-Po) & a Masters Degree in International Security from the School of International and Public Affairs at Columbia University, where she won first prize at the Atlantic Council Cyber 9/12 National Challenge in Cyber Policy and later held a Visiting Scholarship at the Arnold A. Saltzman Institute of War and Peace Studies. She completed her Bachelor at Sciences-Po Paris, with a year as a visiting student at Princeton University, and received legal education at Paris II - Sorbonne Universités.

Re: [nexa] nelle CC 4.0 ci siamo persi la collection?

by Simone Aliprandi

PS: Il mio ragionamento è molto semplice. Prima nelle 3.0 si diceva proprio "A work that constitutes a Collection will not be considered an Adaptation (as defined below) for the purposes of this License."; e anche "[you are free] to Distribute and Publicly Perform the Work including as incorporated in Collections." Ma se togliamo quelle due precisazioni il diritto resta non licenziato nelle licenze Non Derivative. Un caro saluto. -- Simone Aliprandi - http://www.aliprandi.org | http://www.array.eu
