Una responsabilità che forse abbiamo trascurato

Fino ad ora ci siamo chiesti chi risponde delle decisioni prese da un sistema di AI, ma non della responsabilità per aver progettato uno spazio di possibilità nel quale certe decisioni erano concepibili. Se un modello può spiegare come aggirare una norma o proporre soluzioni gravemente pericolose, il problema nasce quando genera quella risposta oppure quando è stato costruito un sistema nel quale quella risposta era una possibilità? Ho provato a sviluppare questa riflessione in questo breve articolo: https://www.pensieridensi.it/articoli/2026/07/quando_la_responsabilita_nasc… Sapete se qualcuno ci ha ragionato già sopra? Trovo moltissimo che affronta chi è responsabile del danno prodotto da un sistema di AI e come bisogna progettare sistemi che producano meno danni. Ma non qualcuno che abbia spostato l’oggetto della responsabilità. Quindi: di cosa è responsabile il responsabile. E io mi chiedo se il soggetto responsabile non sia responsabile non soltanto delle decisioni effettivamente prodotte, ma anche della configurazione dello spazio delle decisioni che il sistema era, è, sarebbe stato, in grado di generare. Three Models of AI Regulation  Ignacio Cofone, University of Oxford Online Meeting on MS Teams<https://teams.microsoft.com/meet/389551308543117?p=dKSPSwX9fBDUSWhfjX> Format: 35 min talk + 25 min Q&A AI systems allocate credit, price insurance, screen job applicants, triage patients, and inform bail decisions by generating probabilistic inferences at population scale. The resulting harms are group-based, non-material, and produced by long chains of actors, so they slip past legal categories built for individual and tangible injury. Three regulatory traditions have crystallised in response. The individual rights model, exemplified by the GDPR, gives data subjects rights to access, explanation, and objection. The risk-tiered model, exemplified by the EU AI Act, classifies systems before deployment by projected risk. The public infrastructure model, exemplified by algorithmic registries and mandatory audits, treats AI as a governed utility. Each rests on a different theory of the relationship between AI systems and the people they affect, and each carries a blind spot that survives any amount of enforcement. Two of those blind spots reproduce across all three models. Cumulative harm, where thousands of individually unactionable outputs aggregate into systemic injury, escapes every framework. So does the inference lifecycle, which each model leaves ungoverned because all three regulate the data trail and leave the production of inferences unaffected. Ignacio Cofone is Professor of Law and Regulation of AI at the University of Oxford, jointly appointed between the Faculty of Law and the Institute for Ethics in AI. His research examines how AI produces inference-based harms that escape existing legalcategories, across privacy, data protection, and algorithmic accountability. He is the author of The Privacy Fallacy (Cambridge University Press, 2023) and has advised governments in Canada, the United States, and Europe on AI and privacy regulation. Mi associo alla difesa di Hinton segnalando questa Distinguished Lecture al MIT in cui spiega con maggior chiarezza la sua posizione. Trovo interessante e su cui riflettere la sua proposta finale, che dovremmo investire nell’allenare i modelli ad essere come madri che si prendono cura dei figli, anziché puntare solo a renderli più capaci. LLM do understand language much similarly like we do. He explains this in detail explaining in intuitive ways what are word embeddings and how they are a better alternative to the symbolic interpretation of the meaning of words. He also claims they are conscious in the sense that they can refer to their “subjective experience”, i.e. to the way they can conceive of reality or imaginary facts. He claims they do sometimes make mistakes, but does not call those hallucinations but rather as confabulations, as in psychology. People don’t have precise memory, but reconstruct recollections, which tend to fade with time, hence we might believe in recollections that we are just making up. He explains the benefits of digital models that can be replicated or their knowledge transfered to others through distillation, a capacity that is very inefficient and limited in humans. He believes machines will become smarter than us and possibly will evolve a language of their own to express concepts that our mind cannot grasp. But he has an unusual answer to the existential threat to humanity. While he is skeptical that governments or international collaboration will agree on blocking AI or cartain abuses, mostly because sadly they are the first to exploit those abuses. But there is hope. He makes the analogy of 5 year old children and their mothers. A child is less smart than an adult and can behave poorly or badly. But a mother cares for him and helps him to grow and achieve his goal with patience. We should train AI not just to be smarter, but to be caring like a mother. We cannot control them by fixing their algorithms because they are not algoritms but we can control how we train them. Su giornali e testate online (anche parecchio "serie") è pieno di guest post (articoli a pagamento) su AI a sfondo tech-enthusiast, sui social media è pieno di fuffaguru che lodano e imbrodano AI, perché ci troviamo anche qui su NEXA a commentare questo delirio? Di fatto, è pieno di fake news a tema, come il raggiungimento dell'AGI annunciato un giorno si e l'altro pure, oppure la questione dei 5 teoremi di Erdos dimostrati da Chatgpt che in realtà erano già stati dimostrati prima e semplicemente le fonti sono state indicizzate dagli LLM e adesso tutto il circuito promozionale ripete a vanvera questa cosa. I social non andrebbero presi a esempio di divulgazione, così come in generale Youtube e tutto il fantastico mondo di big tech. Tanto durava, nell’inverno del 2023, il controllo umano su un nome destinato a morire./Un ufficiale dell’intelligence israeliana, indicato con la lettera B., lo ha raccontato ai giornalisti di +972 Magazine e di Local Call, che per primi hanno svelato l’esistenza del programma (Abraham 2024)^1 . Il suo compito si riduceva a una verifica sola, che il bersaglio scelto dalla macchina fosse un maschio. /«Investivo venti secondi per ogni bersaglio, e ne facevo decine al giorno. Come essere umano non avevo alcun valore aggiunto, ero solo un timbro di approvazione. Mi faceva risparmiare un sacco di tempo»./ Il controllo del sesso era diventato l’unico filtro perché, secondo gli ufficiali, tra le file militari di Hamas non figurano donne, e dunque un bersaglio femminile segnalava soltanto un errore della macchina. «All’inizio facevamo dei controlli per assicurarci che la macchina non si confondesse», spiega B. «A un certo punto ci siamo affidati al sistema automatico, e ci limitavamo a controllare che il bersaglio fosse un uomo. Non ci vuole molto a capire se una voce è maschile o femminile» (Abraham 2024). Il software si chiama /Lavender/. Analizza i dati raccolti, attraverso una sorveglianza di massa, sui due milioni e trecentomila abitanti di Gaza, e assegna a quasi ciascuno un punteggio da 1 a 100 che misura la probabilità di appartenere all’ala militare di Hamas. Ha imparato a riconoscere i tratti dei miliziani noti per cercarli nella popolazione, dal trovarsi in un gruppo WhatsApp con un militante al cambiare spesso telefono. Nelle prime settimane di guerra ha schedato circa trentasettemila persone come sospette, insieme alle loro case. La definizione di miliziano restava elastica, e uno degli analisti che addestrarono il sistema se ne dichiarò turbato, perché nei dati di addestramento erano finiti anche addetti alla protezione civile, cioè profili di comunicazione civili che la macchina avrebbe poi cercato, e colpito, nella popolazione. Gli ufficiali sapevano che la macchina sbaglia in circa il dieci per cento dei casi, e la trattavano lo stesso, sono parole loro, come se fosse una decisione umana. L’errore più frequente, racconta B., nasceva quando un bersaglio cedeva il proprio telefono a un familiare. «Quella persona verrà bombardata in casa con la sua famiglia. È successo spesso» (Abraham 2024)^1 . Selezionare i nomi era una procedura che gli operatori chiamavano, con una metafora venatoria, /Caccia Larga/: «Metti centinaia di bersagli nel sistema e aspetti di vedere chi puoi uccidere. Copi e incolli dalle liste che il sistema produce». La seconda macchina porta un nome che è la domanda di un bambino, /Where’s Daddy?,/ dov’è papà. Seguiva le persone schedate e avvertiva l’esercito quando rientravano a casa, di notte, mentre le famiglie dormivano. Le abitazioni private erano il luogo preferito per colpirle, perché localizzarle là risultava più semplice. L’ufficiale A. lo ha messo a verbale con una franchezza assoluta: /«Non eravamo interessati a uccidere i miliziani solo quando si trovavano in un edificio militare. Al contrario, li bombardavamo nelle loro case senza esitazione, come prima opzione. *EU Chat Control extension is an insult to democracy* Thomas Fazi On Thursday, the European Parliament “adopted” <https://www.euronews.com/next/2026/07/10/chat-control-10-passed-the-europea…> the extension of Chat Control 1.0. This is the temporary suspension of the EU’s ePrivacy rules that allows tech platforms to mass-scan citizens’ private communications, ostensibly to detect child sexual abuse material. “Adopted” is placed in quotation marks here because the word implies something that conspicuously failed to happen: a majority of MEPs voting in favour. In fact, 314 MEPs voted to reject the text, against 276 in favour. And yet it passed anyway. This was made possible through a procedural sleight of hand worthy of Brussels at its most cynical. The file was rammed through under an “urgency procedure”: European Parliament President Roberta Metsola unilaterally reopened a dossier that MEPs had already rejected in March, and the Council conveniently bounced it back at the start of the summer recess, when securing attendance is hardest. Rejecting it a second time would have required not a simple majority but an absolute one: 360 votes. The law was therefore approved despite a majority of MEPs voting against it. The regulation will now remain in force until April 2028, buying time for negotiations on its even more ambitious successor, Chat Control 2.0.
