Victory! Illinois Supreme Court Protects Biometric Privacy

https://www.eff.org/deeplinks/2019/01/victory-illinois-supreme-court-protec… Today the Illinois Supreme Court ruled unanimously that when companies collect biometric data like fingerprints or face prints without informed opt-in consent, they can be sued. Users don't need to prove an injury like identity fraud or physical harm—just losing control of one’s biometric privacy is injury enough. In Rosenbach v. Six Flags, a 14 year old brought a challenge against an amusement park for collecting his thumbprint without his informed consent, in violation of Illinois law. The law in question, the Illinois Biometric Information Privacy Act (BIPA), prohibits companies from gathering, using, or sharing biometric information without informed opt-in consent. EFF, along with ACLU, CDT, the Chicago Alliance Against Sexual Exploitation, PIRG, and Lucy Parsons Labs, filed an amicus curiae brief urging the Illinois Supreme Court to adopt a robust interpretation of BIPA. The Illinois Supreme Court agreed with us and soundly rejected the defendants’ argument that BIPA required a person to show an injury beyond loss of statutory privacy rights. The Court rejected the company’s argument that violation of a privacy statute is a mere “technical violation of the law.” In fact, the Court ruled, it inflicts a serious harm that supports a lawsuit. The court recognized that, through BIPA, the legislature had codified an individual’s “right to privacy in and control over their biometric identifiers and biometric information.” The need to codify this right was supported by the legislature’s findings that biometrics may be used to access sensitive information, but unlike other identifiers like social security numbers, biometrics are unique to each individual and can’t be changed. As a result, the Court ruled, quoting the legislature: “once compromised, the individual has no recourse, is at heightened risk for identity theft, and is likely to withdraw from biometric-facilitated transactions.” [...]

Facebook Let Kids Rack Up Charges on Parents' Credit Cards and Did Nothing to Stop It

Newly unsealed court documents show that Facebook was aware that underage children routinely used their parents’ payment information to spend large sums of money on in-game purchases, and the company chose not to fix the problem. For years, it allowed for what it called “friendly fraud” because it feared implementing protections would harm revenue, according to the documents. In 2016, Facebook settled a class-action lawsuit brought by parents of children who were tricked into unwittingly making purchases with real money while playing free video games hosted on the social media platform. Despite its recognition of the problem, internal discussions show that Facebook decided it would be best to fight refund requests and allow the problem to persist. Documents related to the case were placed under seal because Facebook successfully argued that releasing them to the public could harm its business. Reveal, a publication run by the Center for Investigative Reporting, argued that these documents were in the public interest; last week, a judge granted Reveal’s request to release the documents. I know this because, for the past week, I’ve been mingling with corporate executives at the World Economic Forum’s annual meeting in Davos. And I’ve noticed that their answers to questions about automation depend very much on who is listening. In public, many executives wring their hands over the negative consequences that artificial intelligence and automation could have for workers. They take part in panel discussions about building “human-centered A.I.” for the “Fourth Industrial Revolution” — Davos-speak for the corporate adoption of machine learning and other advanced technology — and talk about the need to provide a safety net for people who lose their jobs as a result of automation. But in private settings, including meetings with the leaders of the many consulting and technology firms whose pop-up storefronts line the Davos Promenade, these executives tell a different story: They are racing to automate their own work forces to stay ahead of the competition, with little regard for the impact on workers. Facebook to integrate Instagram, Messenger and WhatsApp | Technology | The Guardian

<https://www.theguardian.com/technology/2019/jan/25/facebook-integrate-insta…> Facebook is reportedly considering a merger of its three messaging platforms – WhatsApp, Instagram and Facebook Messenger – allowing users to send messages between the networks for the first time. The plans are said to come directly from the Facebook chief executive, Mark Zuckerberg, the New York Times has reported, and would involve rewriting the basic software of the three apps to ensure they were interoperable. A WhatsApp user would be able to, for instance, text an Instagram user for the first time without needing to switch applications. That rewrite would also involve enabling end-to-end encryption (E2E) on all three apps, according to the NYT’s Mike Isaac. While all WhatsApp messages use that security feature, which prevents anyone, including Facebook itself, from intercepting the contents of messages, support across Facebook’s wider business is patchy. Facebook Messenger only supports E2E in a special “secure conversations” mode, which is off by default and must be enabled separately for every chat, while Instagram features no encryption at all. While E2E is a valuable security measure for users, it has the side effect of preventing Facebook from scanning messages as part of its advertising business. The technology has also come under attack from law enforcement organisations, since it hinders their ability to intercept suspect communications in real time.
