Zagrebelski hits the news in France

Gustavo Zagrebelsky (and Stefano Rodotà) have been present in the mainstream press in France twice in the last days. The first instance is no surprise. Mediapart (an on-line general news site) has reproduced the Franco Cordero / Stefano Rodotà / Gustavo Zagrebelsky call to support the Repubblica in face of the one million trial damages requested by Berlusconi. The PM has also announced he would sue similarly French newspapers (for instance the Nouvel Obs'). Franck Louvrier the adviser for Internet, communication and press of Sarkozy published an op-ed in Le Monde where he was stressing the importance of Internet for democracy (with Twitter/Iran examples), highlighted the threat of manipulations using the Internet and developed an incredible rhetorical amalgama, where he identified false testimony (such as the Chinese army for forum posters for the government) with counterfeiting, and the latter with unauthorized copying. He then presented HADOPI laws as the forefront of the defense of democracy. I drafted an op-ed in response with Jérémie Zimmermann which Le Monde published on 29 August (ommitting my name as author). I include the text of the published op-ed, since Le Monde charges for access to op-eds after a few days. The conclusion paragraph is based on the Lezione di Gustavo Zagrebelsky. Best, -- Philippe Aigrain ----------------------------- Internet et rhétorique Les lois Hadopi ne sont pas garantes de la démocratie Dans Le Monde daté du 22 août, Franck Louvrier, conseiller du président de la République, nous livre ses pensées sur les relations entre Internet et la démocratie. Comme de nombreux autres commentateurs, il salue l'importance d'outils et de services comme Twitter pour permettre l'expression démocratique massive des individus. Il souligne avec pertinence le danger d'une manipulation de ce nouvel espace public par des usurpateurs qui le pollueraient en diffusant des contenus se présentant comme l'expression de citoyens, alors qu'ils émanent de gouvernements autoritaires. Nous voilà réjouis de cette reconnaissance au plus haut niveau de l'Etat des bénéfices d'Internet pour la démocratie. C'est alors que se révèle le véritable objet de la tribune de M. Louvrier : présenter les lois Hadopi comme une protection de l'espace public démocratique. On s'attendait à plus de modestie après la décision du Conseil constitutionnel du 10 juin, censurant une part importante de la première de ces lois, justement parce qu'elle portait atteinte à la présomption d'innocence et à l'exercice concret des droits fondamentaux d'expression et de communication qui sont la condition de la démocratie. On aurait aimé trouver une justification détaillée des nouvelles atteintes à ces droits qu'instaurerait la seconde loi Hadopi, dont ce même Conseil constitutionnel sera bientôt saisi. Qu'on nous explique, par exemple, ce qui peut justifier l'extension inouïe des procédures judiciaires expéditives par le biais des ordonnances pénales prévue par Hadopi 2. Que M. Louvrier défende les lois Hadopi dont il a été le maître d'oeuvre, prodiguant ses instructions à la ministre alors en charge, ne nous surprend pas. Mais la méthode utilisée pour cette défense doit nous faire réfléchir. Car au détour de deux phrases, voici un étrange parallèle établi entre la défense de l'espace public démocratique et la répression du partage sans but lucratif sur Internet : « Ce qui menace Twitter, c'est moins la censure que la contrefaçon, la copie, en somme, le faux. » Et voilà soudain les partageurs de fichiers, ceux-là qui sont la substance même de Twitter et de dizaines d'autres outils similaires, assimilés aux milliers de soutiers recrutés par des régimes autoritaires, comme la Chine, pour polluer l'expression publique des citoyens. Le sens des mots Voilà les sanctions automatiques prononcées par des juges, dont la fonction est réduite à néant, croulant sous la masse des procédures préparées par des agents privés et une machinerie administrative bancale, qualifiées de « sens de notre vie en commun dans une démocratie ». Le philosophe politique italien Gustavo Zagrebelsky a prononcé, en avril, lors de la Biennale de la démocratie à Turin, une « leçon sur la démocratie ». Il y souligne que les dangers qui menacent la démocratie, bien visibles en Italie, émanent de son propre développement. Au premier rang de ces dangers, il place le développement de rhétoriques qui entendent frapper la pensée de stupeur en portant atteinte au sens même des mots. C'est exactement ce qui nous choque dans la tribune de M. Louvrier. Qu'il défende la loi Hadopi 2 et ses suites point par point sur leur réalité, mais qu'il laisse en paix le sens des mots, dont a besoin la démocratie. Jérémie Zimmermann

Ciao Stefano, Grazie per le tue osservazioni (sempre interessanti e pragmatiche). Come dicevo io penso che l'istruttoria dell'Antitrust sia la benvenuta perchè potrà sgombrare il campo da tutta una serie di dubbi e leggende metropolitane su Google News. Google News è un aggregatore di notizie, non un portale. L'obiettivo è fornire agli utenti quante più fonti di informazione possibile e mandare traffico agli editori onlne. Sui modelli di business potremmo parlare per ore, ma credo che il mercato e la collaborazione fra tutti gli attori dell'ecosistema potranno aiutare nella selezione dei migliori. Per il resto abbiamo cercato, cerchiamo e cercheremo il dialogo con tutti per risolvere i problemi (dove possibile) e dare la nostra versione dei fatti (qualora il contrasto non sia sanabile). August 29, 2009 Editorial Access and the Internet http://www.nytimes.com/2009/08/29/opinion/29sat3.html On the Internet today, a Web site run by a solo blogger can load as quickly as any corporate home page. Internet service providers, including leading cable and phone companies, want to be able to change that so they can give priority to businesses that pay, or make deals with, them. A good bill that would guarantee so-called net neutrality has been introduced in the House. Congress should pass it, and the Obama administration should use its considerable power to make net neutrality the law. If Internet service providers are allowed to choose among content, it would be bad for everyone but the service providers. Businesses could slow down or block their competitors’ Web content. A cable company whose leaders disapprove of a particular political or social cause could block sites supporting that cause. Concerns about open networks are not limited to access to Web sites, and they are not hypothetical. In 2007, Verizon Wireless rejected Naral Pro-Choice America’s request to send text messages over its network, a decision Verizon reversed after an outpouring of criticism. Recently, Apple was criticized for rejecting an iPhone application, Google Voice, an Internet-based service that would permit users to make low-cost calls without using AT&T, which has an exclusive arrangement for the iPhone in this country. (Apple said it is still considering the application.) The Federal Communications Commission is investigating. Representatives Edward Markey, Democrat of Massachusetts, and Anna Eshoo, Democrat of California, have introduced a bill to prohibit Internet service providers from blocking or discriminating against content that travels through their pipelines. It is likely to face fierce opposition from telecommunications and cable companies. The best chance for guaranteeing net neutrality may lie with the Obama administration. Under the leadership of Chairman Julius Genachowski, the F.C.C. could adopt rules that would have the force of law. President Obama, a truly Internet-savvy president, declared in May that he is “firmly committed to net neutrality so we can keep the Internet as it should be — open and free.” We hope he keeps that promise.

Ciao a Tutti, Come avrete letto sulla stampa, la FIEG ha chiesto all'AGCM di aprire un'istruttoria nei confronti di Google in relazione al nostro servizio Google News. Siamo contenti che ci sia offerta la possibilità di fare chiarezza sul funzionamento di Google News, infatti crediamo che il nostro aggregatore di notizie online rappresenti un'importante strumento di informazione per gli utenti ed un'interessante opportunità di business per gli editori. Questo è il post che è stato pubblicato sul nostro European Public Policy Blog<http://googlepolicyeurope.blogspot.com/2009/08/about-google-news-in-italy.h…>, nel quale si chiarisce il meccanismo di esclusione di una notizia da Google News. Un argomento che oggi ha riscosso una grande attenzione e su cui pensiamo si sia creato un fraintendimento con la FIEG. Chi fornisce notizie, analogamente a qualsiasi altro editore online, ha il pieno controllo sul fatto di rendere visibili i propri contenuti attraverso i servizi di Google. Quindi, se un editore non vuole essere trovato su Google.com o su Google.it o su un altro motore di ricerca, può evitare l'indicizzazione automatica utilizzando uno standard universalmente accettato, chiamato robot.txt. Gli editori hanno anche una serie di altre modalità per controllare come i loro contenuti appaiono (o non appaiono). Una di queste opzioni è per esempio quella di continuare a comparire nei risultati di ricerca di Google senza comparire su Google News. Google Books adds Creative Commons license options Eric Steuer, August 13th, 2009 http://creativecommons.org/weblog/entry/16823 Some very exciting news for authors, publishers, and readers: Today, Google launched a program to enable rightsholders to make their Creative Commons-licensed books available for the public to download, use, remix, and share via Google Books. The new initiative makes it easy for participants in Google Books’ Partner Program to mark their books with one of the six Creative Commons licenses (or the CC0 waiver). This gives authors and publishers a simple way to articulate the permissions they have granted to the public through a CC license, while giving people a clear indication of the legal rights they have to CC-licensed works found through Google Books. The Inside Google Books post announcing the initiative talks a bit about what this all means: We’ve marked books that rightsholders have made available under a CC license with a matching logo on the book’s left hand navigation bar. People can download these books in their entirety and pass them along: to friends, classmates, teachers, and so on. And if the rightsholder has chosen to allow people to modify their work, readers can even create a mashup–say, translating the book into Esperanto, donning a black beret, and performing the whole thing to music on YouTube. The project launched with a terrific starter collection of CC-licensed books that includes: 55 Ways to Have Fun with Google by Philipp Lenssen; Blown to Bits by Harold Abelson, Ken Ledeen, Harry R. Lewis; Bound by Law? by Keith Aoki, James Boyle, Jennifer Jenkins; Code: Version 2 by Lawrence Lessig; Democratizing Innovation by Eric von Hippel; Federal Budget Deficits: America’s great consumption binge by Paul Courant; The Future of the Internet — And How to Stop It by Jonathan Zittrain; Little Brother by Cory Doctorow; and A World’s Fair for the Global Village by Carl Malamud. Carried out in spring 2009 by the University Of Hertfordshire, the online survey was completed by more than 1,800 young people throughout the UK. *Key findings:* . Music remains the most valued form of entertainment . 87% said that copying between devices is important to them . 86% of respondents have copied a CD for a friend; 75% have sent music by email, Bluetooth, Skype or MSN; 57% have copied a friend's entire music collection; 39% have downloaded music from an online storage site; and 38% have ripped a TV, radio or internet stream. . The computer is the main entertainment hub -- 68% of respondents use it every day to listen to music . Ownership of music is hugely important -- both online and offline . Popularity of P2P remains unchanged since 2008 -- 61% said they download music using P2P networks or torrent trackers. Of this group, 83% are doing so on a weekly or daily basis . There is real interest for new licensed services. 85% of P2P downloaders said they would be interested in paying for an unlimited all-you-can-eat MP3 download service . Young people have an inherent sense of what copyright is, but choose to ignore it -- the vast majority of respondents knew that sharing copyrighted content is not legal, yet continue to do so

Much of the discussion has centered on copyright law's ability to suppress transformative, creative reuses of copyrighted works and on copyright's fair use doctrine as a mechanism to protect such transformative uses. This Essay argues that the increasing centrality of transformativeness to fair use has made it easier for copyright owners to control all instances of ordinary copying. Yet pure copying also serves valuable First Amendment purposes, both for audiences and, less obviously, for speakers, for whom copying often serves interests in self-expression, persuasion, and participation.
