*Why do US and EU trade negotiators hate the Berne Copyright Limitations and Exceptions?* Submitted by James Love on 20. February 2013 - 0:48 For the past year, a treaty on copyright exceptions for persons who are blind or have other disabilities has been hung up on demands by the European Union to insert provocative language on the so called "three step test" in copyright into the treaty. The Trans Pacific Partnership Agreement is in the middle of a similar dispute, with the US pushing language that would place the three step test on top of all copyright limitations and exceptions, including those set out a particular cases in the Berne Convention. One US State Department employee referred to the three step test as the fundamental basis for copyright. What is the three step test in copyright? Well, there are several. There is a three step in the Berne Convention, created in 1967 to provide for general exceptions to the reproduction rights of authors in areas where the Berne did not have a separate (a particular) standard for the exception. The three step test was modified to focus on right holders in the TRIPS, and modified again in the WCT to acknowledge the importance of the Berne Exceptions, in the WPPT for the rights that it provided, and now in countless new treaties and trade agreements, with some surprisingly variances, many of which are reported here:http://keionline.org/node/1568. Verso la fine dell' eccitante campagna elettorale, contro ogni confidenza, salta fuori qualcosa che ci riguarda, in linguaggio verificabile, falsificabile : un po' di ciccia attaccata all' osso anche per i gatti randagi d' informatica e telematica. E compromettente per la "parte" che enuncia. -- Monti oggi [a Catania ... qualcuno forse si ricordera' di Pistorio ... SGS ...STM ...] picchia giu' http://www.sceltacivica.it/allegati/agendadigitalesc.pdf Bersani stasera [si saranno mica messi d' accordo ?] in due TV [la7 e Porta a Porta] picchia giu' -a giornalisti "economici" che ovviamente non gli avevano chiesto *niente* in proposito- che assume banda larga come impegno prioritario di "governo della crisi" [dopo anni di cincischiamento che ci hanno sbattuto nelle statistiche dietro la Romania]. He had just had to decide whether to pull out of Italy, given the weak economy and the prospect of a future euro crisis. The C.E.O. had his economists project out a series of downside scenarios and calculate what they would mean for his company. But, in the end, he made his decision on the basis of values. His bank had been in Italy for decades. He didn’t want Italians to think of the company as a fair-weather friend. He didn’t want people inside the company thinking they would cut and run when times got hard. He decided to stay in Italy and ride out any potential crisis, even with the short-term costs. He wasn’t oblivious to data in making this decision, but ultimately, he was guided by a different way of thinking. And, of course, he was right to be. Commerce depends on trust. Trust is reciprocity coated by emotion. People and companies that behave well in tough times earn affection and self-respect that is extremely valuable, even if it is hard to capture in data. I tell this story because it hints at the strengths and limitations of data analysis. The big novelty of this historic moment is that our lives are now mediated through data-collecting computers. In this world, data can be used to make sense of mind-bogglingly complex situations. Data can help compensate for our overconfidence in our own intuitions and can help reduce the extent to which our desires distort our perceptions. Per il 174 bis un ipod da 8Gb se contiene circa 1100 canzoni abusivamente duplicate vale circa 113.000 € di sanzioni amministrative in aggiunta alle eventuali sanzioni penali. Trovatemi un bene protetto con maggior vigore dalla legge italiana (ivi compresi i peggiori delitti del C.P. o le peggiori sanzioni proporzionali delle normative antitrust o bancarie) e poi ne riparliamo. 6,4 milioni di euro come sanzione amministrativa (e tecnicamente ci sta tutta) dà il segno di una follia legislativa applicata solo a fini mediatici e non son affatto convinto sia utile alla causa dei titolari dei diritti. <http://mgpf.it/2013/02/19/uk-google-deve-provvedere-alla-rimozione-dei-cont…> La Corte d’appello di Londra ha stabilito il provider ha a disposizione 5 settimane per la rimozione del contenuto in seguito alla richiesta di cancellazione di commenti diffamatori. Superato questo “limite” vi sono i presupposti per avviare una causa per diffamazione. Il ricorso in appello era stato presentato in seguito ad una querela per diffamazione a Google a causa della mancata rimozione di alcuni commenti pubblicati nel 2011 su un blog ospitato dalla piattaforma Blogger gestita dal motore di ricerca, edi il giudice di primo grado aveva stabilito che non fosse possibile sostenere il reato di diffamazione perché Google non poteva essere considerato come l’editore dei blog ospitati sulla sua piattaforma. Commencement speakers have assured generations of college graduates that the real value is less in /what/ they've learned than in /how/ they've learned to think. This talk will present a personal case study in learning to think through code. Along the way, it will argue that coding belongs not just on the periphery of the liberal arts, but at the center of a new canon. About Diana Diana is an MBA candidate at Harvard Business School. While at Harvard College, Diana Kimball studied history; after graduation, she moved to California to design software. Upon returning to campus two years later, she decided to begin learning how to /build/ software in earnest. Since that moment, she has written countless surprisingly useful scripts, survived the college's introductory computer science course, and launched two full-fledged web applications. As a co-creator of ROFLCon, Diana's interest in internet culture runs deep. Most recently, this interest has expressed itself in her programming pursuits and in her efforts to apply an open-source ethos to mentoring.
