Sollevo una questione a mio avviso centrale per il diritto di internet e che invece è lasciata troppo in secondo piano e quindi risulta poco nota anche a chi è tenuto a conoscerla per operare correttamente nella sua professione (avvocati, notai, giudici...): il valore probatorio di una pagina web. Quanti sono convinti che sia sufficiente fare una stampata o uno screenshot di una pagina per averne una prova solida? Competitive value of data protection: the impact of data protection regulation on online behaviour (International Data Privacy Law, 2013) Abstract The increasing demand from individuals to have their privacy respected or to take decisions about the management of their information assumes a significant role in business activities and it becomes an important element for building public trust in service providers. In this scenario, keeping the focus of data protection only on the individual and his or her decisions is no longer adequate. If legislators consider data protection as a fundamental right, it is necessary to reinforce its protection in order to make it effective and not conditioned by the asymmetries which characterize the relationship between data subject and data controllers. This aim is implemented by the EU proposal by means of three different instruments: data protection impact assessment, privacy by design/by default solutions, and the data minimization principle. The competitive value of data protection can be assured and enhanced only if the user’s self-determination over personal data is guaranteed. The Justice Department is hailing a judge’s finding yesterday that Apple and publishers conspired to fix e-book prices as a victory for consumers, who are paying less since the alleged cabal was thwarted. But readers shouldn’t rest easy. More than anything, Apple’s defeat in court reinforces the key fact of bookselling in the 21st century: Amazon has more power than anyone else to dictate what Americans pay for books.
