To stay on top of important articles like these, sign up to receive the latest updates from TomDispatch.com./ [The following is slightly adapted from chapters two and three of Grégoire Chamayou’s new book, A Theory of the Drone, with special thanks to his publisher, the New Press.] Initially, the English word “drone” meant both an insect and a sound. It was not until the outbreak of World War II that it began to take on another meaning. At that time, American artillery apprentices used the expression “target drones” to designate the small remotely controlled planes at which they aimed in training. The metaphor did not refer solely to the size of those machines or the brm-brm of their motors. Drones are male bees, without stingers, and eventually the other bees kill them. Classical tradition regarded them as emblems of all that is nongenuine and dispensable. That was precisely what a target drone was: just a dummy, made to be shot down. However, it was a long time before drones were to be seen cruising above battlefields. To be sure, the idea dates back quite a while: there were the Curtiss-Sperry aerial torpedo and the Kettering Bug at the end of World War I, and then the Nazi V-1s and V-2s unleashed on London in 1944. But those old flying torpedoes may be considered more as the ancestors of cruise missiles than as those of present-day drones. The essential difference lies in the fact that while the former can be used only once, the latter are reusable. The drone is not a projectile, but a projectile-carrying machine. It was during the Vietnam War that the U.S. Air Force, to counteract the Soviet surface-to-air missiles that had inflicted heavy casualties on it, invested in reconnaissance drones nicknamed “Lightning Bugs,” produced by Ryan Aeronautical. Some say we are entering a "golden age of surveillance," enabling perfect enforcement of laws. But Frank Pasquale's book "The Black Box Society" argues that, at least in areas like privacy, antitrust, and financial regulation, big data can also enable obfuscation, stonewalling, and even fraud. About Frank Frank Pasquale’s research addresses the challenges posed to information law by rapidly changing technology, particularly in the health care, internet, and finance industries. He is a member of the NSF-funded Council for Big Data, Ethics, and Society, and an Affiliate Fellow of Yale Law School’s Information Society Project. He frequently presents on the ethical, legal, and social implications of information technology for attorneys, physicians, and other health professionals. His book /The Black Box Society: The Secret Algorithms that Control Money and Information/ (Harvard University Press, 2015) develops a social theory of reputation, search, and finance. Pasquale has been a Visiting Fellow at Princeton’s Center for Information Technology, and a Visiting Professor at Yale Law School and Cardozo Law School. He was a Marshall Scholar at Oxford University. He has testified before the Judiciary Committee of the House of Representatives, appearing with the General Counsels of Google, Microsoft, and Yahoo. He has also presented before a Department of Health & Human Services/Federal Trade Commission Roundtable and panels of the National Academy of Sciences. He served on an American Academy of Arts and Sciences working group on the future of mobile health (mHealth) regulation. He has received a commission from Triple Canopy to write and present on the political economy of automation. Pasquale serves on the Advisory Boards of the Data Competition Institute, Patient Privacy Rights and the Electronic Privacy Information Center. He is is on the editorial boards of the Journal of Legal Education and the Oxford Handbooks Online in Law. He has served on the executive board of the Health Law Section of the American Association of Law Schools (AALS), and has served as chair of the AALS section on Privacy and Defamation. He has been quoted in the /Financial Times, New York Times, Economist, CNN/, and many other media outlets. About Jonathan Jonathan Zittrain is the George Bemis Professor of Law at Harvard Law School and the Harvard Kennedy School of Government, Professor of Computer Science at the Harvard School of Engineering and Applied Sciences, Vice Dean for Library and Information Resources at the Harvard Law School Library, and co-founder of the Berkman Center for Internet & Society. His research interests include battles for control of digital property and content, cryptography, electronic privacy, the roles of intermediaries within Internet architecture, human computing, and the useful and unobtrusive deployment of technology in education. He performed the first large-scale tests of Internet filtering in China and Saudi Arabia, and as part of the OpenNet Initiative co-edited a series of studies of Internet filtering by national governments: /Access Denied: The Practice and Policy of Global Internet Filtering; Access Controlled: The Shaping of Power, Rights, and Rule in Cyberspace; and Access Contested: Security, Identity, and Resistance in Asian Cyberspace/. Corte di Giustizia UE e libertà d'espressione: Linking a siti di terzi che violano il diritto d'autore.

Buona Pasqua! Grazie ad una segnalazione della sempre attenta Eleonora Rosati sappiamo che la Corte di Giustizia tornerà sul tema del linking, questa volta su siti di terzi che contengono violazioni del diritto dautore La Corte Suprema Olandese nel caso Playboy/Sonoma, chiede alla Corte di Giustizia se il collegamento a una fonte che è liberamente accessibile on-line, ma che comunica al pubblico opere dellingegno, senza il consenso del titolare del diritto dautore e al di fuori della pubblicazione effettuata dal titolare, deve essere qualificato come violazione in base al diritto dautore. LAlto consesso vuole sapere se costituisce comunicazione al pubblico ( e quindi, ad esempio essere oggetto di enforcement) il comportamento di colui che linka ad un sito quando questo contiene materiali protetti ed è diverso da quello messo a disposizione dal titolare del diritto dautore. Non solo libertà di espressione (ma anche anoressia)

Dear all, Oggi il quotidiano Libération pubblica un editoriale che ho co-firmato con il mio team, su una questione al crocevia di salute pubblica e libertà di espressione su Internet. "Un amendement qui met en danger les malades" http://www.liberation.fr/societe/2015/04/02/un-amendement-qui-met-en-danger… Qualche elemento di background: Una parte importante del mio lavoro consiste nel produrre ricerche "azionabili" nel quadro di politiche pubbliche. Uno dei più seri cantieri degli ultimi anni ha riguardati le comunità di pazienti online, soprattutto quelli affetti da disturbi alimentari. Si tratta dei famigerati "siti pro-ana" descritti nei media come luoghi in cui pazzi squilibrati trascinano ragazze ingenue sulla via della perdizione alimentare (in realtà, luoghi di parola di malati PER malati) e contro i quali, regolarmente, ineluttabilmente, dei politici in cerca di visibilità propongono leggi draconiane e controproduttive. L'équipe che io ho diretto per 4 anni ha studiato e mappato questi siti. I nostri risultati sono stati pubblicati nelle più importanti riviste internazionali e siamo in contatto con un network di associazioni di professionisti e famiglie in tutta Europa. Un riassunto in inglese http://www.anamia.fr/en/report-young-internet-users-and-eating-disorder-web… vi da un panorama delle scoperte maggiori : la controproduttività della censura (i blog entrano in clandestinità e si moltiplicano), la necessità di riconoscere che questi siti fornisco dei servizi di sostegno lì dove i medici sono impotenti, l'évoluzione spontanea verso dei discorsi moderati (malgrado le provocazioni e le esagerazioni sintomatiche dei disturbi in questione). L'anno scorso, in occasione della discussione dello scellerato "provvedimento Marzano" l'Italia ha rischiato di passare una legge che punisce con pene carcerarie delle persone (ragazze e ragazzi affetti da disturbi gravi) che (per la sentenza 41986/05 della Corte di cassazione, Sezione I penale, 22/11/2005) non possono legalmente stare in prigione. (Leggete l'ottimo Fabio Chiusi che ne parlava qui: http://www.wired.it/attualita/politica/2014/08/07/contro-il-carcere-per-chi…) Quello che né l'Inghilterra (2009), né l'Italia (2014) erano riusciti a fare, la Francia l'ha fatto di notte, di nascosto, e contro le raccomandazioni nostre e delle associazioni legate al nostro progetto: a 00:59 del 1 aprile 2015, un minuto prima di terminare la seduta dell'Assemblée Nationale, i deputati hanno adottato un emendamento alla Loi Santé che crea il "reato di anoressia su internet". La Francia diventa ufficialmente il primo paese in cui rischi di finire in prigione per aver *parlato* del tuo disturbo alimentare su Internet.
