ITALIA CAMPIONE DEL MONDO. DI CALCIO? NO, DI BLOCCO ALL'ACCESSO AD #INTERNET. E LA CINA COPIA L'AGCOM.
by Fulvio Sarzana Oct. 1, 2015

Oct. 1, 2015

Blocking Orders due to Copyright Reasons violate Art. 16 of the Charter of Fundamental Rights of the European Union, as well as Art. 11, on freedom of expression and information.
by Fulvio Sarzana Sept. 30, 2015

Sept. 30, 2015

Judgment of the OLG Cologne on network blocking (18 July 2014, 6 U 192/11) The decision of the Appellate Court of Cologne represents the first further development of principles laid down by the CJEU in UPC Telekabel Wien GmbH v. Constantin Film Verleih GmbH. The close assessment of various EU Directives is of particular interest. The close assessment of the various European Directives as well as the well considered balancing of fundamental rights is particularly remarkable. This judgment might pave the way for limiting an over emphasis on copyright to the detriment of the freedom of information and the economic freedom of copyright providers. The Claimants, leading music publishers, requested that the Defendant, a telecommunication service and access provider, block access to certain internet services which allow file sharing, alleging multiple violations of their copyrights. The Defendant denied any liability at which point the Claimants initiated an action to seek a blocking order. The Court Stated that: While the Defendant could be qualified as an intermediary in the sense of Art. 8(3) of Directive 2001/29/EC this would be limited by Art. 15(1) of Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market, which provided that Member States should not impose a duty on ISPs to actively examine information which is transmitted through their services and to search for illegal acts Moreover, any such measure would be incompatible with Art. 3 of Directive 2004/48/EC which stipulates that any measures to protect copyrights has to be fair and just. The attempt to harmonise the economic freedom of access providers according to Art. 16 of the Charter of Fundamental Rights of the European Union as well as Art. 11 of the Charter, namely the freedom of information with copyright, which is protected under Article 17 of the Charter, had to also be based on the fact that the copyright did not constitute a complete right. In addition, the Member States had to ensure that in case of conflicting fundamental rights a balance is struck and the principle of proportionality met. To request that the Defendant block access violated this principle, particularly as it would be difficult to effectively avoid copyright violations by way of introducing such blocking measures. In addition, it would not be possible to differentiate between illegal and completely legal data, and as such the freedom of information would be endangered by too general a set of measures. - See more at: http://www.lidis.it/en/blocking-orders-due-to-copyright-reasons-violate-art- 16-of-the-charter-of-fundamental-rights-of-the-european-union-as-well-as-art -11-on-freedom-of-expression-and-information.htm/#sthash.gMSjtTV0.dpuf --- Questa e-mail è stata controllata per individuare virus con Avast antivirus. https://www.avast.com/antivirus

-------- Forwarded Message -------- Subject: Call for Papers | Big data: Big power shifts? | Internet Policy Review | Deadline: Abstracts until 20 October Resent-Date: Wed, 30 Sep 2015 12:21:04 +0200 Resent-From: d004620(a)polito.it Date: Wed, 30 Sep 2015 12:21:02 +0200 From: Alexander von Humboldt Institute for Internet and Society <newsletter(a)hiig.de> To: Juan Carlos de Martin <demartin(a)polito.it> Big Data: Big Power Shifts? C A L L F O R P A P E R S The Alexander von Humboldt Institute for Internet and Society cordially invites you to submit your research projects for the Internet Policy Reviews' special issue on /Big data: big power shifts?/ supported by the Vodafone Institute for Society and Communications. Submit Your Abstract <http://policyreview.info/node/374> TOPIC & RELEVANCE Big data has been a major issue in internet-related public debate for several years now and it is yet unclear what impact big data has on societies, politics and markets. We conceive big data as constituted by three components: the automatic generation of very large and diverse data sets which are mainly the result of the digitisation of modern societies, their processing by algorithms and their use for decision-making and regulation, in the private or public sector. This includes purposes such as profiling, monitoring, predictive analysis and risk calculation. Mayer-Schönberger & Cukier claim that big data is a “revolution that will transform how we live, work, and think” (2014). But whereas revolutions imply a profound shift in power relations, there is little scientific evidence about whether and, if so, how big data affects power relations. We understand power as the production, in and through social relations, of effects that shape the capacities of actors to determine their fate. Power opens up or closes off options to act for parties involved and it is multi-dimensional: it is influence over others, empowerment, the capacity to act and to self-discipline. SCOPE OF THE SPECIAL ISSUE The aim of the special issue in the Internet Policy Review is to explore the extent to which big data shapes society by influencing power relations and, in return, how the development of big data-related phenomena is itself shaped by power relations. We welcome proposals that address power relations linked to big data phenomena in various fields, as long as they bear a relevance to European societies and highlight policy implications or make a reference to regulatory debates. Papers can have both a more conceptual or a more empirical focus. This call for papers is open to researchers from the fields of policy studies, sociology, law, philosophy, data, information and technology studies, economics and management and related fields. Emerging scholars are particularly encouraged to submit a proposal. FOCUS OF THE PAPERS As stated above, scientific knowledge about which power relations shape the big data society is still scarce. Yet much has been said about the many promising and worrying aspects of a society built on predictive analysis, machine learning and algorithmic regulation, and various implicit and explicit hypotheses about the power effects of big data have emerged in the academic and public debate. * Empowerment of users/citizens/patients: Will big data empower users, citizens and patients through applications and services (tailored services, e-participation, e-health)? * Power shifts and conflicts over power between actors: o Does big data alter the power relation between states and citizens (‘surveillance society’, ‘governing the poor’, manipulation of voters by individualised election campaigns)? o Do personalised marketing and the monitoring of staff affect the power relations between companies and users or employees? o Do new power relations between companies, political candidates/parties or states arise due to unequal access to big data applications? o Does big data influence the relative importance of scientific disciplines or professions (data analysts versus lawyers and economists)? * Different modes of decision-making and knowledge production: Are current norms and practices threatened by ‘algorithmic regulation’ and the ‘end of theory’? * Power relations shaping big data: How do power relations shape the development of big data and the precise big data related practices, modes of production and application fields? * Narratives: How are big data related power relations addressed, problematized or, on the contrary, masked? * Regulation of big data: What regulations are relevant for big data related power relations? What alternative regulations are proposed? BEST PAPER AWARD In addition to the special issue the authors selected for the best paper award will be invited to speak at the closing lecture of the Alexander von Humboldt Institute for Internet and Society-lecture series Big data: big power shifts? The lecture is set to be held in Berlin in April 2016 in cooperation with the Vodafone Institute for Society and Communications. caso Schrems e safe harbor: gli States fanno pressing sull'Europa
by Guido Noto La Diega Sept. 30, 2015

Sept. 30, 2015

http://useu.usmission.gov/st-09282015.html Safe Harbor Protects Privacy and Provides Trust in Data Flows that Underpin Transatlantic TradeStatement | Brussels, Belgium | September, 28 2015 The United States Government and the European Commission have been engaged in a very productive and substantial dialogue to improve and strengthen the Safe Harbor Framework. The framework has been critically important to the protection of individual privacy and the conduct of commerce on both sides of the Atlantic; it has served and continues to serve as a model around the world for the protection of individual privacy and flow of data across national borders. We are optimistic that our discussions will conclude soon with a positive outcome for both sides. The future of the Safe Harbor Framework, however, has now been called into question by the Advocate General's recent opinion in Maximillian Schrems v. Data Protection Commissioner. We fully respect the European Union's legal process; however, we believe that it is essential to comment in this instance because the Advocate General's opinion rests on numerous inaccurate assertions about intelligence practices of the United States. The Advocate General's opinion notes that it was required to accept the facts as found by the Irish High Court. There was, however, no actual fact-finding in this case; instead, the Irish High Court concluded, on the basis of exhibits to plaintiff's affidavits that the accuracy of his allegations regarding U.S. intelligence practices "is not in dispute." But that is simply not the case, as the public record made clear at the time, and as has been made even clearer in the subsequent two years. The United States does not and has not engaged in indiscriminate surveillance of anyone, including ordinary European citizens. The PRISM program that the Advocate General's opinion discusses is in fact targeted against particular valid foreign intelligence targets, is duly authorized by law, and strictly complies with a number of publicly disclosed controls and limitations. Moreover, the Advocate General's opinion fails to take into account that -- particularly in the last two years - President Obama has taken unprecedented steps to enhance transparency and public accountability regarding U.S. intelligence practices, and to strengthen policies to ensure that all persons are treated with dignity and respect, regardless of their nationality or place of residence. The Advocate General's opinion also errs in inviting the European Court of Justice to conclude that the current Safe Harbor Framework is inadequate because the United States and the European Commission are positively engaged in an effort to strengthen it. On the contrary, the Framework was conceived as a living document, and this is not the first time that the two sides have engaged to improve its operation. On both sides, there has been a strong desire to make sure that we improve the Framework, and these efforts should be encouraged. Moreover, the underlying issue here also goes far beyond the Safe Harbor Framework. The Advocate General's reasoning would undercut the ability of other countries, businesses and citizens to rely upon negotiated arrangements with the European Commission. Given the important privacy and trade benefits that Safe Harbor provides to EU and US citizens and businesses, we will continue to work closely with the European Commission to improve the Safe Harbor Framework. We hope that the final judgment of the European Court of Justice takes note of these efforts, inaccuracies in and far-reaching consequences of the Advocate General's opinion, as well as the significant harm to the protection of individual rights and the free flow of information that would occur if it were to follow the Advocate General's opinion. -- *Guido* Dr. Guido Noto La Diega <http://www.law.qmul.ac.uk/staff/notoladiega.html>, Postdoctoral Research Assistant in Cloud Computing Law <http://www.cloudlegal.ccls.qmul.ac.uk/project/researchers/index.html> - Queen Mary Universityof London <http://www.mccrc.eu/Pages/Research-Team.aspx> President of Ital-IoT <http://italiot.altervista.org/about-us/> - Centre of Multidisciplinary Research on the Internet of Things Avvocato <http://www.studioperrino.it/intro/index.asp> (Commercial and IP/IT Lawyer) Cultore della materia in Civil Law and Intellectual Property <http://www.unipa.it/persone/docenti/n/guido.notoladiega> - University of Palermo 67-69 Lincoln's Inn Fields London WC2A 3JB g.notoladiega(a)qmul.ac.uk +44(0)2078823386 @gui_notoladiega https://it.linkedin.com/pub/guido-noto-la-diega-ph-d/6/614/669 This e-mail and any attachment hereto are strictly confidential and are exclusively intended for the person above identified. Libertà d'espressione: Gli Ordini di blocco per ragioni di copyright vìolano la Carta dei diritti Fondamentali della UE.
by Fulvio Sarzana Sept. 30, 2015

Sept. 30, 2015

Berkman Center Webcast live oggi ore 18 - The Mozilla Delphi Cybersecurity Study: Towards a User Centric Cybersecurity Policy Agenda
by Giuseppe Futia Sept. 29, 2015

Sept. 29, 2015

The Mozilla Delphi Cybersecurity Study: Towards a User Centric Cybersecurity Policy Agenda https://cyber.law.harvard.edu/events/luncheon/2015/09/Francois *with Camille François, Josephine Wolff, Andy Ellis, and Bruce Schneier* Today, 6.00 pm Webcast live:http://cyber.law.harvard.edu/interactive/webcast http://nexa.polito.it/berkman-webcast-live <http://nexa.polito.it/berkman-webcast-live> Join us on September 29th for a discussion of the "Mozilla Delphi Cybersecurity 1.0. Study: Towards A User Centric Policy Framework," presented by lead researcher Camille François with Berkman community members Josephine Wolff, Andy Ellis, and Bruce Schneier, who participated in the study. Camille worked for several months with the Mozilla Foundation to orchestrate the study and resulting report. The study used a modified version of the Delphi research technique. More than 30 leading cybersecurity experts from a wide variety of backgrounds – including academia, civil liberties, government and military, security, and technology – participated in the study. Using a pseudonymous format to encourage candid feedback and open dialogue on the issues, the study tackles the following questions: what is the role of policy in cybersecurity? How consensual is the definition of cybersecurity? What are the current priorities for cybersecurity policy? Which issues get too little or too much attention? What are measures that a diverse set of cybersecurity actors can agree on as being both feasible and desirable? The study produced a map of priorities, issues, and solutions for cybersecurity that highlights consensus and dissensus in the space. Join us to discuss the lessons learned in this process and the report's findings. About Camille Camille François is a researcher and consultant on cyber policy, with a focus on questions relating to cybersecurity, human rights and state interactions in cyberspace. A Fellow at the Harvard Berkman Center for Internet & Society from 2013-2015, Camille focuses her work on the building of norms for cyber peace and rights-respecting cybersecurity policies, and related questions in the robotics field. She has led initiatives with institutions such as the French Prime Minister Office Task Force on Open Data & Open Government; the Mozilla Foundation; the U.S. Defense Advanced Research Projects Agency (DARPA); as well as Google, the French-American Foundation & the Software Freedom Law Center. She serves as a member of the Freedom Online Coalition international Working Group on An Internet Free and Secure. Camille has also been involved in a wide range of free culture advocacy projects and serves as a Digital Advisor for Libraries Without Borders and on the Scientific Committee of the French Wikimedia Foundation. A Fulbright Fellow, Camille holds a Masters Degree in Human Rights from the French Institute of Political Sciences (Sciences-Po) & a Masters Degree in International Security from the School of International and Public Affairs at Columbia University, where she won first prize at the Atlantic Council Cyber 9/12 National Challenge in Cyber Policy and later held a Visiting Scholarship at the Arnold A. Saltzman Institute of War and Peace Studies. She completed her Bachelor at Sciences-Po Paris, with a year as a visiting student at Princeton University, and received legal education at Paris II - Sorbonne Universités.
