Buongiorno a tutti, Per chi fosse interessato, segnalo la pubblicazione del Net Neutrality Compendium. Human Rights, Free Competition and the Future of the Internet. Il libro é il risultato di tre anni di lavori che ho avuto il piacere di coordinare nell’ambito dell’IGF Dynamic Coalition on Network Neutrality (DCNN) ed é pubblicato da Springer. Contiene contributi i.a. di Vint Cerf (VP di Google e 'padre di Internet'), Louis Pouzin (inventore del datagramma), Chris Marsden (Sussex University), Leonidas Kanellos (former Chair of BEREC), J. Scott Marcus e René Arnold (WIK Consult), Frode Sorensen (Nkom), Francesca Musiani (Sorbonne), Joe McNamee (EDRi), Primavera de Filippi (Berkman Center) e Félix Tréguer (La Quadrature du Net), e molti altri. In allegato, la terza parte del NNC, che include il rapporto annuale della DCNN, presentato all’IGF 2015. Cleaning Up U.S. Cyberspace <http://www.cfr.org/internet-policy/cleaning-up-us-cyberspace/p37333?cid=otr…> The U.S. government's effort to persuade other countries to adopt norms of responsibility for cyberspace faces a significant obstacle: computers located in the United States host much of the malicious software used to carry out cyberattacks. Botnets—groups of compromised computers under the control of a malicious actor—are regularly used to distribute spam, spy, break passwords, harvest credentials, and engage in distributed denial-of-service (DDOS) attacks. When botnets located in the United States attack computers in other countries, the victims could view the United States as either being behind the attacks or an accomplice in violation of the norms the United States is pressuring other countries to uphold. [] Yet the placement of the United States at the top of the list for botnets and DDOS attacks undermines efforts to promote norms of cyberspace responsibility. Other countries, notably Finland, have been able to nearly eliminate botnets by monitoring for infections and quarantining infected computers from the Internet. U.S. ISPs and hosting providers—such as GoDaddy and Rackspace, two companies whose powerful servers are often used to carry out malicious attacks—have resisted embracing such an approach. ISPs argue that monitoring their customers' network flows for malicious activity and notifying their customers when they detect it will be viewed as an unreasonable intrusion on customer privacy. [] Under a voluntary agreement with the Federal Communications Commission, the major ISPs have agreed to a notification protocol. However, under the agreement, ISPs only need to respond to customers who want to know if they are infected; they do not have to actively inform the customer in advance.

End-to-end encryption, which is the state of the art in providing secure communications on the internet, has become increasingly common and desirable in the wake of NSA whistleblower Edward Snowden’s revelations about mass surveillance by the government. Comey had previously argued that tech companies could somehow come up with a “solution” that allowed for government access but didn’t weaken security. Tech experts called this a “magic pony” and mocked him for his naivete. [...]

Speaker Alessandro Mantelero (Director of Privacy del Centro Nexa) Ingresso libero This event will be webcast live: http://nexa.polito.it/upcoming-events La recente decisione della Corte di Giustizia con cui è stato dichiaro invalido l’accordo *Safe Harbour fra UE e USA sui flussi di dati personali transfrontalieri* ha aperto nuovi scenari e prospettive incerte. Da un lato, emerge chiaramente l’intenzione del governo statunitense e della Commissione Europea di addivenire rapidamente ad un nuovo accordo che offra un livello di tutela adeguato ai dati personali dei cittadini europei. D’altro canto, vi sono i punti fermi posti dalla decisione, che riguardano i poteri delle autorità garanti, della Corte stessa e della Commissione, nonché i rilievi sulle criticità esistenti nella tutela offerta dall’ordinamento statunitense. In questo scenario sono già emerse le prime indicazioni, sia dall’Article 29 Data Protection Working Party, che da varie autorità garanti nazionali e dalla Commissione stessa, circa le possibili soluzioni adottabili dalle imprese per il post Safe Harbour. Alla luce di queste prime interpretazioni, l’incontro cercherà di delineare insieme ai fellows del Centro Nexa i possibili sviluppi del rapporto UE-USA in materia di trattamento dati e le implicazioni a livello globale che la pronuncia può avere, guardando in particolare alle ricadute in termini di impatto organizzativo sulle imprese. L’incontro non si soffermerà dunque sulle motivazioni della decisione (il cui testo figura tra le letture consigliate), bensì sugli scenari futuri, che verranno indagati con un taglio pragmatico ed operativo. Esso è desunto dal giudice a quo, in forza di una lettura congiunta delle previsioni sopra esaminate, che non risulta coerentemente o comunque adeguatamente argomentata. MA ...In definitiva, l’ordinanza nel suo insieme non chiarisce sufficientemente se intende ottenere una pronuncia ablativa o una pronuncia additivo-manipolativa e, per costante giurisprudenza di questa Corte (ex plurimis sentenza n. 228 del 2014; ordinanza n. 214 del 2011), ciò preclude l’esame nel merito della questione determinandone l’inammissibilità (ex plurimis ordinanze n. 101 del 2015; n. 21 del 2011, n. 91 del 2010 e n. 269 del 2009).
