...A prescindere da ogni considerazione sulla accuratezza della ricostruzione del quadro normativo e della interpretazione datane dal rimettente, è evidente che nessuna delle disposizioni impugnate, in sé considerata, dispone specificamente l’attribuzione all’autorità di vigilanza di un potere regolamentare qual è quello esercitato con l’approvazione del regolamento impugnato nei due giudizi davanti al TAR. Esso è desunto dal giudice a quo, in forza di una lettura congiunta delle previsioni sopra esaminate, che non risulta coerentemente o comunque adeguatamente argomentata. MA ...In definitiva, l’ordinanza nel suo insieme non chiarisce sufficientemente se intende ottenere una pronuncia ablativa o una pronuncia additivo-manipolativa e, per costante giurisprudenza di questa Corte (ex plurimis sentenza n. 228 del 2014; ordinanza n. 214 del 2011), ciò preclude l’esame nel merito della questione determinandone l’inammissibilità (ex plurimis ordinanze n. 101 del 2015; n. 21 del 2011, n. 91 del 2010 e n. 269 del 2009). Consiglio a tutti la lettura di questo articolo di ERIC E. SCHMIDT (Google) Eric Schmidt on How to Build a Better Web http://www.nytimes.com/2015/12/07/opinion/eric-schmidt-on-how-to-build-a-be… A parte alcune pennellate zuccherose, mi pare che si adombri una posizione destinata a far discutere: "it’s important we use that connectivity to promote the values that bring out the best in people." "We should build tools to help de-escalate tensions on social media — sort of like spell-checkers, but for hate and harassment. We should target social accounts for terrorist groups like the Islamic State, and remove videos before they spread, or help those countering terrorist messages to find their voice. Without this type of leadership from government, from citizens, from tech companies, the Internet could become a vehicle for further disaggregation of poorly built societies, and the empowerment of the wrong people, and the wrong voices." Sono parole che rispondono ad una reale urgenza, ma come per il controllo sociale (v. le telecamere in rete à la Renzi, https://medium.com/italia/io-sono-per-taggare-9fe48778512c#.uktlvl55x ) servirebbe una riflessione ben più profonda ed articolata. Perché affermazioni come queste inducono alcuni interrogativi: - chi decide quali sono "the values that bring out the best in people" ? Google ? Gli stati occidentali? - chi garantisce che questi "tools to help de-escalate tensions on social media — sort of like spell-checkers" vengano usati in maniera corretta e non diventino forme di censura (basti pensare all'impiego dei Terms of Service da parte di alcuni ISP per limitare contenuti non in linea con la propria personale/nazionale etica) ? - chi sorveglia l'uso corretto di questi tools? Una nota finale: Google che tanto ha lamentato la difficoltà di applicare il c.d. righ to be forgotten, e che paventava la censura/fine del web ora suggerisce l'adozione di " tools to help de-escalate tensions on social media"... un indubbio cambiamento di rotta verso il vaglio attivo dei contenuti. First, he contrasted the coca leaf—chewed for pain relief for thousands of years by indigenous people in South America, with little ill effect—with cocaine, a highly addictive, mind-altering substance. Then he contrasted a cob of corn with a highly processed piece of candy derived from corn syrup. Nutritious in its natural state, the concentrated sugar in corn can spark unhealthy, even addictive behaviors once poured into candy. With corn and with coca, the dose makes the poison, as Paracelsus put it. And in the modern era of “food science,” dozens of analysts may be spending millions of dollars just to perfect the “mouthfeel” and flavor profile of a single brand of chips.1 Should we be surprised, then, that Americans are losing the battle of the bulge? Food. Almost bottomless perseverance. But the most important may well be the Internet, and, more specifically, a smartphone. More than 4 million people have fled Syria’s civil war since 2011, most of them headed for the beleaguered nation’s neighbors. Faced with overcrowded camps, religious persecution, and the hostile borders of Eastern Europe, many continue on to Western Europe. More than 500,000 refugees, the majority of them from Afghanistan, Iraq, and Syria, started arriving there in October. Many of these displaced people rely upon smartphones to find safe passage. 04.12.2015 - Communication & Information Sector *Privacy expert argues “algorithmic transparency” is crucial for online freedoms at UNESCO knowledge café* “At the intersection of law and technology – knowledge of the algorithm is a fundamental right, a human right,” argued American privacy law expert Marc Rotenberg, on Wednesday, 2 December during a Knowledge Café event organized by UNESCO’s Communication and Information Sector at the Organization’s Headquarters in Paris. Rotenberg, president and executive director of the Electronic Privacy Information Center (EPIC), explained that algorithms, complex mathematical formulas and procedures through which computers process information and solve tasks, have an increasing impact on people’s lives in areas related to commerce, employment and housing. Other areas impacted include access to information and knowledge, freedom of expression, privacy and personal data protection online. Regarding access to information, he indicated that every search engine uses its own search algorithm which influences what information can be found and how results are displayed to users’ queries, as do social media and online services. As more decisions become automated and processed by algorithms, these processes become more opaque and less accountable, with risks of secret profiling and illegal discrimination. For Rotenberg, “at the core of modern privacy law is a single goal: to make transparent, the automated decisions that impact our lives.” He sees “algorithmic transparency”, the principle that data processes which impact individuals be made public, as the next stage in the development of transparency law, internet law and privacy law. The lack of algorithmic transparency in the current internet ecosystem poses a crucial challenge to defending fundamental human rights online, ranging from privacy and freedom of expression to security. In addition to algorithmic transparency, Rotenberg pointed to other emerging issues which need to be examined, notably the increasing access to drones and robots and the need for their registration. And rarely has the coverage of such a debate been so lacking in facts—especially considering that encryption is a tool reporters increasingly need to do their jobs. The deplorable terrorist attacks in Paris occurred on the evening of Friday, Nov. 13. By the end of that weekend, news organizations had published dozens of articles linking the Paris attackers with the use of encrypted messaging apps that prevent the companies that make them—and therefore governments—from easily accessing the messages their users send back and forth. By the following Monday, there were literally thousands of articles questioning whether such apps should be outlawed, spurred on by the Sunday talk shows that gave intelligence officials license to speculate on the “likely” use of encryption as a catchall excuse for why the attacks had not been detected, and to condemn the technology without a single skeptical follow-up. Coupure obligatoire de tout réseau Wi-Fi ouvert, blocage des réseaux d'anonymisation et fourniture des clés de chiffrement des messageries font partie des pistes soumises à arbitrage. La liste des mesures envisagées par le gouvernement pour renforcer la sécurité au détriment de la liberté et de la vie privée s’allonge.
