But a few weeks ago, during the second stop on the tour for my new book <http://us.penguingroup.com/nf/Book/BookDisplay/0,,9781594487712,00.html?Whe…>, I found myself being interviewed in front of a Seattle audience and responding to an opening question that I had never been asked before: “Are you a Communist?” The question was intended as a joke, but like the best jokes, it played on the edges of an important and uncomfortable truth. I had just spent four years writing a book about the innovative power of open systems that work outside of or parallel to traditional market environments: the amateur scientists of the Enlightenment, university research labs, open source software platforms. In my research, I analyzed 300 of the most influential innovations in science, commerce and technology — from the discovery of vacuums to the vacuum tube to the vacuum cleaner — and put the innovators of each breakthrough into one of four quadrants. First, there is the classic solo entrepreneur, protecting innovations in order to benefit from them financially; then the amateur individual, exploring and inventing for the love of it. Then there are the private corporations collaborating on ideas while simultaneously competing with one another. And then there is what I call the “fourth quadrant”: the space of collaborative, nonproprietary innovation, exemplified in recent years by the Internet and the Web, two groundbreaking innovations not owned by anyone. L'Istituto Bruno Leoni, che aveva ospitato la visita del prof. Hal Varian a Roma qualche settimana fa, ora pubblica la versione italiana di un contributo di Varian sul tema: “Estensione della durata del diritto d’autore e opere orfane” (versione inglese del dicembre 2006) http://www.brunoleoni.it/nextpage.aspx?codice=9729 Link diretto al PDF: http://brunoleonimedia.servingfreedom.net/OP/78_Varian.pdf Una settimana fa "Domenica" del Sole24ore aveva pubblicato un estratto del paper di Varian di cui sopra; nel numero di "Domenica" di ieri Piero Attanasio (AIE) e Stefano Mauri (GEMS) "rispondono" a Varian, in realta' spesso - a mio avviso - non rimanendo sul tema e parlando di altre questioni Google-related. Grosso l'abbaglio, esempio, di Mauri quando attribuisce a Varian una posizione sui brevetti vs copyright che secondo me non ha alcun fondamento. juan carlos

Garante Privacy: Google Street View: le auto dovranno essere riconoscibili

Cari tutti, mi è stata segnalata la recente decisione del Garante Privacy sul servizio Street View di Google. Mi piacerebbe saperne cosa ne pensano gli iscritti a questa lista. Francesco Pizzetti, presidente, del dott. Giuseppe Chiaravalloti, vice presidente, del dott. Mauro Paissan e del dott. Giuseppe Fortunato, componenti e del dott. Daniele De Paoli, segretario generale; VISTO il Codice in materia di protezione dei dati personali (d.lg. 30 giugno 2003, n. 196, di seguito "Codice"); VISTA la nota del 18 settembre 2008 con la quale Google Inc. ha comunicato all'Autorità l'intenzione di rendere operativo in Italia il servizio Street View, fornendo, contestualmente, informazioni in merito allo stesso e chiarendo che esso "consente agli utenti di visualizzare le foto panoramiche delle strade di una città italiana dove il servizio è attivo" e che è possibile "fare lo zoom della foto, spostarsi con il mouse del P.C. avanti ed indietro lungo le strade e persino ruotare la visuale di 360°"; VISTA la nota di Google Inc. del 1 giugno 2010, con la quale la società, elettivamente domiciliata presso lo studio legale Hogan Lovells in Roma, ha fornito all'Autorità ulteriori elementi in merito al servizio Street View; CONSIDERATO che, secondo quanto dichiarato dalla società, le immagini sono riprese, al livello della strada, da particolari fotocamere posizionate su veicoli in grado di scattare fotografie in movimento e che, a seguito della loro acquisizione, le stesse sono inviate automaticamente al server di Google Inc. negli Stati Uniti dove si provvede all'elaborazione ed all'inserimento delle foto selezionate sul sito web di Google, mediante il quale sono oggetto di diffusione online per diversi mesi; CONSIDERATO che, in alcuni casi, le predette fotografie contengono anche dati personali, quali, ad esempio, immagini di individui o targhe di veicoli; VISTE le numerose segnalazioni pervenute a questa Autorità, relative proprio all'acquisizione di immagini da parte della società che, nel fotografare i luoghi, ha ripreso anche soggetti identificabili che non desideravano comparire sulle fotografie pubblicate online da Google; CONSIDERATO che il servizio Street View, in ragione delle sue caratteristiche, nonché sulla base degli elementi emersi dall'analisi delle predette segnalazioni, rende necessaria una riflessione più ampia sul rispetto dei principi in materia di protezione dei dati personali; RITENUTO che al trattamento di dati personali posto in essere da Google Inc. si applichino le norme del Codice, in quanto effettuato mediante strumenti situati nel territorio dello Stato (art. 5 del Codice); RITENUTA, quindi, la necessità che Google Inc., in qualità di titolare del trattamento, provveda a designare un proprio rappresentante stabilito nel territorio dello Stato ai fini dell'applicazione della disciplina sul trattamento dei dati personali; CONSIDERATO che al caso in esame risulta applicabile la disciplina relativa all'uso delle immagini e che quindi, in linea generale, non è necessario acquisire il consenso degli interessati quando la ripresa fotografica avviene in luogo pubblico, salve le limitazioni previste dalla legge, quali, ad esempio, il divieto di diffusione di fotografie quando ciò comporti pregiudizio all'onore, alla reputazione, al decoro della persona ripresa (art. 97, comma 2, della l. 22 aprile 1941, n. 633) o il divieto di diffusione di dati idonei a rivelare lo stato di salute (art. 26, comma 5 del Codice); CONSIDERATE, tuttavia, le peculiari caratteristiche delle fotografie scattate da Google Inc., che, oltre ad essere oggetto di diffusione online per un considerevole periodo di tempo, possono essere ingrandite per consentire all'utente una visualizzazione dettagliata delle stesse; CONSIDERATO che, comunque, il trattamento di dati personali svolto da Google Inc. per la fornitura del servizio Street View deve avvenire nel rispetto dei principi di liceità, proporzionalità, correttezza e necessità sanciti dall'art. 11 del Codice; RITENUTO, che, al riguardo, risulta opportuna la misura già adottata da Google Inc. di oscurare, prima della pubblicazione online, gli elementi che possono consentire un'identificazione diretta (ad esempio, i volti) o indiretta (ad esempio, le targhe dei veicoli) degli interessati; CONSIDERATO che resta fermo – ai sensi dell'art. 7 del Codice - il diritto di opposizione degli interessati rispetto ai dati personali che li riguardano, e che, in tal senso, la società già assicura agli interessati l'esercizio di tale diritto, mediante una particolare procedura di "segnalazione" online; CONSIDERATO che Google Inc. deve garantire l'effettivo esercizio dei diritti di cui all'art. 7 anche quando, nonostante la procedura di oscuramento posta in essere, gli interessati siano comunque, anche se solo indirettamente, riconoscibili; RITENUTO che risulta necessario, comunque, che gli interessati siano informati in modo idoneo ai sensi dell'art. 13 del Codice in relazione all'acquisizione di immagini da parte di Google Inc., affinché costoro possano scegliere di sottrarsi alla "cattura" delle immagini, allontanandosi dal luogo oggetto di ripresa; CONSIDERATO che le modalità con le quali attualmente è fornita l'informativa agli interessati, in relazione al trattamento di acquisizione delle immagini, risultano del tutto insufficienti, in quanto consistono nella sola pubblicazione, sul sito web della società, dell'indicazione generica delle città in cui transitano le vetture di Street View, alcune ore prima del loro passaggio, nonché di un testo contenente alcune informazioni sul servizio Street View che tuttavia non soddisfa pienamente i requisiti di cui all'art. 13 del Codice; CONSIDERATO, tuttavia, che il rilascio dell'informativa a ciascun interessato oggetto di riprese da parte di Google Inc. comporterebbe un impiego di mezzi obiettivamente sproporzionati rispetto al diritto tutelato; CONSIDERATO che il Garante, per effetto dell'art. 13, comma 3, del Codice, può prescrivere al titolare del trattamento l'adozione di misure semplificate per fornire un'idonea informativa agli interessati; RITENUTA, pertanto, l'opportunità di adottare nei confronti di Google Inc. un provvedimento prescrittivo ai sensi degli artt. 143, comma 1, lett. b) e 154, comma 1, lett. c) del Codice; RILEVATA la necessità che Google Inc. informi gli interessati, in relazione all'acquisizione di immagini fotografiche, individuando con un sufficiente livello di approssimazione le località visitate dalle vetture di Street View tenendo conto della ampiezza delle suddette località (ad esempio per le grandi città è necessario indicare i quartieri in cui circoleranno le vetture). Ciò, mediante pubblicazione della notizia sul sito web della società, nei tre giorni antecedenti rispetto all'inizio della raccolta delle immagini; RILEVATA, altresì, la necessità che Google Inc. fornisca idonea e preventiva informativa anche tramite la pubblicazione, sulla pagina di cronaca locale di almeno due quotidiani, di un avviso – per ogni regione visitata - che informi sui luoghi in cui circoleranno le vetture; RILEVATA la necessità che analogo avviso preventivo sia diffuso anche per il mezzo di almeno un'emittente radiofonica locale; RILEVATA, altresì, la necessità che Google Inc. predisponga, sulle vetture con le quali acquisisce le immagini fotografiche, cartelli o adesivi ben visibili che indichino, in modo inequivocabile, che si stanno acquisendo immagini fotografiche istantanee oggetto di pubblicazione online mediante il servizio Street View; CONSIDERATO che resta comunque ferma la necessità che Google Inc. renda un'informativa completa di tutti gli elementi indicati dall'art. 13 del Codice, disponibile sul sito web della società; TENUTO CONTO che, ai sensi dell'art. 162, comma 2-ter del Codice, in caso di inosservanza del presente provvedimento prescrittivo è applicata in sede amministrativa la sanzione del pagamento di una somma da trentamila euro a centottantamila euro; RISERVATO ogni ulteriore accertamento e intervento in merito ad ulteriori profili relativi all'acquisizione di immagini per il servizio Street View; RISERVATA, con autonomo procedimento, la verifica dei presupposti per contestare la violazione amministrativa concernente l'inidoneità dell'informativa resa da Google Inc. (artt. 13 e 161 del Codice); VISTA la documentazione in atti; VISTE le osservazioni dell'Ufficio formulate dal segretario generale ai sensi dell'art. 15 del regolamento del Garante n. 1/2000; RELATORE il prof. Francesco Pizzetti; TUTTO CIÒ PREMESSO IL GARANTE: dispone, ai sensi degli artt. 143, comma 1. lett. b) e 154, comma 1, lett. c) del Codice, che Google Inc. entro trenta giorni dalla notificazione del presente provvedimento: a) provveda a designare un proprio rappresentante stabilito nel territorio dello Stato ai fini dell'applicazione della disciplina sul trattamento dei dati personali; b) provveda ad informare gli interessati, relativamente all'acquisizione di immagini fotografiche, individuando con un sufficiente livello di approssimazione le località visitate dalle vetture di Street View tenendo conto della ampiezza delle suddette località, mediante pubblicazione della notizia sul sito web della società, nei tre giorni antecedenti rispetto all'inizio della raccolta delle immagini; c) provveda ad informare gli interessati anche tramite la pubblicazione, sulla pagina di cronaca locale di almeno due quotidiani, nonché mediante diffusione per mezzo di un'emittente radiofonica locale, di un preventivo avviso – per ogni regione visitata - che informi sui luoghi in cui circoleranno le vetture; d) predisponga, sulle vetture attraverso le quali acquisisce le immagini fotografiche, cartelli o adesivi ben visibili che indichino, in modo inequivocabile, che si stanno acquisendo immagini fotografiche istantanee oggetto di pubblicazione online mediante il servizio Street View. Our ability to gain and maintain superiority in cyberspace has become essential to our ability to deliver global reach, power, and vigilance. As an integral member of the joint warfighting team, the Air Force is committed to growing, sustaining, and presenting highly skilled and well-equipped forces to joint force commanders who can deliver decisive effects in, from, and through cyberspace, while assuring our mission against an asymmetric cyber threat. Freedom of action in the cyberspace domain enables our command, control, communication, computers, intelligence, surveillance, and reconnaissance capabilities. Our modern defenses, industrial base, and global commerce, as well as that of our nation’s enemies, depend on free use of land, sea, air, space, and cyberspace. Leverage in cyberspace affords influence and control across all other domains. This leverage increases our forces’ access, speed, reach, stealth, and precision. You promised to bring increased truthfulness and transparency to our public policy and law, including the Freedom of Information Act. You promised that wherever possible, important policy decisions would be made in public view, and not as the result of secret special interest deals hidden from the American people. > > Your Administration's negotiation of ACTA has been conducted in stark contrast to every one of these promises. In the interest of brevity, we'll focus here on the three principal ways in which your Administration's negotiation of ACTA undercuts the credibility of your previous promises. > > First, ACTA's negotiation has been conducted behind closed doors, subject to intense but needless secrecy, with the public shut out and a small group of special interests very much involved. The United States Trade Representative (USTR) has been involved in negotiations relating to ACTA for several years, and there have been drafts of portions of the agreement circulating among the negotiators since the start of negotiations. Despite that, the first official release of a draft text took place only in April, 2010. And following that release the USTR has not held a single public on-the-record meeting to invite comments on the text. Worse, in every subsequent meeting of the negotiating parties, the U.S. has blocked the public release of updated text. The U.S. often has acted alone in banning the distribution of the revised text, contrary to the strong majority view of other negotiating partners to promote public inspection and comment. Because the negotiations have operated on a consensus basis, the U.S. vote against transparency has been dispositive. > > This degree of secrecy is unacceptable, unwise, and directly undercuts your oft-repeated promises of openness and transparency. Rather than seeking meaningful public input from the outset, your Administration has allowed the bulk of the public debate to be based upon, at best, hearsay and speculation. Yet, ACTA is a trade agreement setting out a range of new international rules governing intellectual property; as the G-8 called it, a "new international framework." It is not (the claims of the USTR notwithstanding) related in any way to any standard definition of "national security" or any other interest of the United States similarly pressing or sensitive. The Administration's determination to hide ACTA from the public creates the impression that ACTA is precisely the kind of backroom special interest deal - undertaken in this case on behalf of a narrow group of U.S. content producers, and without meaningful input from the American public - that you have so often publicly opposed. > > Second, the Administration has stated that ACTA will be negotiated and implemented not as a treaty, but as a sole executive agreement. We believe that this course may be unlawful, and it is certainly unwise. > > Now that a near-final version of the ACTA text has been released, it is clear that ACTA would usurp congressional authority over intellectual property policy in a number of ways. Some of ACTA's provisions fail to explicitly incorporate current congressional policy, particularly in the areas of damages and injunctions. Other sections lock in substantive law that may not be well-adapted to the present context, much less the future. And in other areas, the agreement may complicate legislative efforts to solve widely recognized policy dilemmas, including in the area of orphan works, patent reform, secondary copyright liability and the creation of incentives for innovation in areas where the patent system may not be adequate. The agreement is also likely to affect courts' interpretation of U.S. law. > > The use of a sole executive agreement for ACTA appears unconstitutional. The President may only make sole executive agreements that are within his independent constitutional authority. The President has no independent constitutional authority over intellectual property or communications policy, the core subjects of ACTA. To the contrary, the Constitution gives primary authority over these matters to Congress, which is charged with making laws that regulate foreign commerce and intellectual property. ACTA should not be pursued further without congressional oversight and a meaningful opportunity for public debate. > > The USTR has insisted that ACTA's provisions are merely procedural and only about enforcing existing rights. These assertions are simply false. Nearly 100 international intellectual property experts from six continents gathered in Washington, DC in June, 2010 to analyze the potential public interest impacts of the officially released text. Those experts - joined by over 650 other experts and organizations - found that "the terms of the publicly released draft of ACTA threaten numerous public interests, including every concern specifically disclaimed by negotiators." The expert statement notes that: > > * Negotiators claim ACTA will not interfere with citizens' fundamental rights and liberties; it will. > * They claim ACTA is consistent with the WTO Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS); it is not. > * They claim ACTA will not increase border searches or interfere with cross-border transit of legitimate generic medicines; it will. > * And they claim that ACTA does not require "graduated response" disconnections of people from the internet; however, the agreement encourages such policies. > > Academics and other neutral intellectual property experts have not had time to sufficiently analyze the current text and are unlikely to do so as long as there is no open public forum to submit such analysis in a meaningful process. Rather than create such a forum, the USTR has released text accompanied by the announcement that the negotiations are finished and the time for public comment, which was never granted in the first instance, is over. This is not meaningful, real-time transparency, and it is certainly not the kind of accountability that we were expecting from your Administration. We know enough to know that ACTA's provisions are of significant interest to the general public, because they touch upon a wide range of public interests and are likely to alter the substantive law governing U.S. citizens. It is clear that before ACTA negotiations proceed further, Congress must be involved. > > Third, and finally, we are concerned that the purpose that animates ACTA is being deliberately misrepresented to the American people. The treaty is named the "Anti-Counterfeiting Trade Agreement". But it has little to do with counterfeiting or controlling the international trade in counterfeit goods. Rather, this agreement would enact much more encompassing changes in the international rules governing trade in a wide variety of knowledge goods - whether they are counterfeit or not - and would establish new intellectual property rules and norms without systematic inquiry into effects of such development on economic and technical innovation in the U.S. or abroad. These norms will affect virtually every American and should be the subject of wide public debate. > > Our conclusion is simple: Any agreement of this scope and consequence must be based on a broad and meaningful consultative process, in public, on the record and with open on-going access to proposed negotiating text and must reflect a full range of public interest concerns. For the reasons detailed above, the ACTA negotiations fail to meet these standards. > > While you cannot go back in time, you still have the opportunity to allow for meaningful public input, even at this late date. Accordingly, we call on you to direct the USTR to halt its public endorsement of ACTA and subject the text to a meaningful participation process that can influence the shape of the agreement going forward. Specifically, we call on you to direct USTR to: > > 1. Signal to other negotiators that the U.S. will not sign ACTA before the conclusion of a meaningful public participation process and another round of official negotiations where public participation is encouraged; > 2. Hold a meaningful open, on-the-record public hearing on the draft text, the results of which will be used to determine what proposed changes to the agreement the administration will propose; > 3. Renounce its position that the agreement is a "sole executive agreement" that can tie Congressional authority to amend intellectual property laws without congressional approval and instead pledge to seek congressional approval of the final text; > 4. Consider reforms to the USTR's industry trade advisory committee (ITAC) process that would allow for a wide range of official advisors; > 5.
